TITLE OF BILL:

An act to amend the tax law, in relation to providing grants related to
the expansion and support of crisis intervention services and diversion
programs

 
PURPOSE:

To direct $10 million of the Public Safety Communications surcharge
revenue to support Crisis Intervention Services and diversion programs
for law enforcement officers, 911 dispatchers, and other first respon-
ders.

 
SUMMARY OF PROVISIONS: Section 1:

- Require the Division of Homeland Security and Emergency Services to
use surcharge revenue allocated to them strictly to support the interop-
erable communications program.

- Allocate $10 million annually to support crisis intervention services
and diversion programs developed or approved by the Office of Mental
Health in conjunction with the Division of Criminal Justice Services.

- Require an annual report to the Governor and Legislature stating the
progress of the program

Section 2: Effective Date

 
JUSTIFICATION:

The Public Safety Communications surcharge raises over $200 million a
year. This bill seeks to take a small portion of that to give additional
training to those answering and responding to 911 calls.  The bill will
fund programs that seek to reduce the amount that law enforcement offi-
cers are the first responders to individuals in mental distress and
provide training so that law enforcement has the knowledge and skills to
de-escalate situations when they are the first to respond. Dispatchers,
EMS, and other first responders would also be eligible for training to
help ensure that the distressed individual receives the proper response
they need as quickly as possible.

 AN ACT to amend the tax law, in relation to providing grants related  to
   the  expansion  and support of crisis intervention services and diver-
   sion programs

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs (d) and (e) of subdivision 6 of section 186-f of
 the  tax  law,  paragraph  (d)  as amended and paragraph (e) as added by
 section 39 of part B of chapter 56 of the laws of 2010, are amended  and
 a new paragraph (f) is added to read as follows:
   (d) To provide the costs of debt service for bonds and notes issued to
 finance  expedited  deployment  funding  pursuant  to  the provisions of
 section three hundred thirty-three of the county law and section sixteen
 hundred eighty-nine-h of the public authorities law; [and]
   (e) [services] SERVICES and expenses that support the [operations  and
 mission  of] INTEROPERABLE COMMUNICATIONS PROGRAM WITHIN the division of
 homeland security and emergency services as appropriated by the legisla-
 ture[.];
   (F) THE SUM OF TEN MILLION DOLLARS ANNUALLY  SHALL  BE  USED  FOR  THE
 PROVISION  OF  GRANTS  RELATED  TO  THE  EXPANSION AND SUPPORT OF CRISIS
 INTERVENTION SERVICES AND DIVERSION PROGRAMS AS DEVELOPED OR APPROVED BY
 THE NEW YORK STATE OFFICE OF MENTAL  HEALTH,  IN  CONJUNCTION  WITH  THE
 DIVISION  OF CRIMINAL JUSTICE SERVICES FOR LAW ENFORCEMENT OFFICERS, 911
 DISPATCHERS OR CALL TAKERS, AND  FIRST  RESPONDERS,  TO  BE  DISTRIBUTED
 PURSUANT TO A PLAN DEVELOPED BY THE COMMISSIONER OF THE OFFICE OF MENTAL
 HEALTH  AND  THE  COMMISSIONER  OF  THE  DIVISION  OF  CRIMINAL  JUSTICE
 SERVICES. SUCH PLAN SHALL CONSIDER FACTORS SUCH AS POPULATION AND NUMBER
 OF STAFF ELIGIBLE FOR SUCH TRAINING. THE COMMISSIONER OF THE  OFFICE  OF
 MENTAL  HEALTH  AND THE COMMISSIONER OF THE DIVISION OF CRIMINAL JUSTICE
 SERVICES SHALL PROVIDE A REPORT TO  THE  GOVERNOR  AND  THE  LEGISLATURE
