TITLE OF BILL:

An act to amend the election law, in relation to requiring the county
seat in Seneca county to have at least one polling place designated for
early voting

 
PURPOSE:

Requires the county seat in Seneca County to have at least one polling
place designated for early voting.

 
SUMMARY OF PROVISIONS:

Section one of this bill amends paragraph (a) of subdivision 2 of
section 8-600 of the Election Law to provide that the county seat of
Seneca County may be a designated as an early polling site for the
purposes of such law. (Amends Chapter 344 of 2020).

Section two is the effective date.

 
JUSTIFICATION:

Chapter 344 of the laws of 2020 requires each county board of elections
to include at least one early voting site in the municipality with the
highest population in such county based on the latest federal decennial
census. Chapter 344 also provides that, to the extent practicable, if
such municipality has public transportation routes, such polling place
shall be situated along such transportation routes.

In the case of Seneca County, the Town of Seneca Falls, which is the
largest municipality in Seneca County, is located in close proximity to
the county seat, Waterloo. The Seneca County seat, Waterloo, is also
served by public transportation routes. Additionally, having this poll-
ing site located in the Seneca County Office Building along with the
Board of Elections is both beneficial for voters and instrumental in the
efficient use of time, money and resources. Thus, under these special
circumstances, it is appropriate to authorize Seneca County to designate
the county seat, Waterloo, as an early voting site in compliance with
Chapter 344.

EFFECTIVE DATE:
By its terms, this act will be considered to have taken effect on Janu-

 AN ACT to amend the election law, in relation to  requiring  the  county
   seat  in  Seneca  county to have at least one polling place designated
   for early voting

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  (a)  of  subdivision 2 of section 8-600 of the
 election law, as amended by chapter 344 of the laws of 2020, is  amended
 to read as follows:
   (a)  The  board  of elections shall designate polling places for early
 voting, which may include the offices of the  board  of  elections,  for
 persons  to  vote  early pursuant to this title; provided, however, that
 the municipality with the highest population in each county based on the
 latest federal decennial census, OR THE COUNTY SEAT  IN  SENECA  COUNTY,
 shall  have  at least one polling place designated for early voting, and
 to the extent practicable if such municipality has public transportation
 routes, such polling place shall be situated along  such  transportation
 routes.  There  shall be so designated at least one early voting polling
 place for every full increment of fifty thousand  registered  voters  in
 each county; provided, however, the number of early voting polling plac-
 es  in  a  county  shall  not  be required to be greater than ten unless
 required by any other provision of law, and a  county  with  fewer  than
 fifty  thousand  voters  shall  have  at  least one early voting polling
 place.
   § 2. This act shall take effect immediately.
