S T A T E O F N E W Y O R K ________________________________________________________________________ 5256 2021-2022 Regular Sessions I N S E N A T E February 27, 2021 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT in relation to the number of signatures of enrolled voters needed on a designating petition for any town office to be filled by all the voters of certain towns and the number of signatures required on a designating petition for a village election; and to provide for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding subdivision 2 of section 6-136 of the election law: (a) the number of signatures of enrolled voters needed on a designat- ing petition for any town office to be filled by all the voters of towns containing more than twenty-five thousand and not more than one hundred thousand inhabitants, according to the last preceding federal enumer- ation, shall be two times the number of election districts in such town or three hundred signatures, whichever is less; (b) the number of signatures of enrolled voters needed on a designat- ing petition for any town office to be filled by all the voters of towns containing twenty-five thousand inhabitants or less, according to the last preceding federal enumeration, shall be two times the number of election districts in such town or one hundred and fifty signatures, whichever is less. § 2. Notwithstanding subdivision 2 of section 6-204 of the election law and paragraph b of subdivision 3 of section 15-108 of the election law, the number of signatures required on a designating petition for a village election shall be one and one-half per centum of the number of enrolled voters of the party residing in the village. § 3. This act shall take effect immediately and shall expire and be deemed repealed on December 31, 2021. HARCKHAM, MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Elections -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the election law, in relation to the number of signa- tures of enrolled voters needed on a designating petition for any town office to be filled by all the voters of certain towns; relates to the number of signatures required on a designating petition for a village election; and to provide for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraphs (k) and (l) of subdivision 2 of section 6-136 of the election law, as amended by chapter 22 of the laws of 2021, are amended and a new paragraph (m) is added to read as follows: (k) For any other office to be filled by the voters of a political subdivision containing more than one assembly district, county or other political subdivision, not to exceed the aggregate of the signatures required for the subdivisions or parts of subdivisions so contained; [and] (l) For any county legislative district, one hundred fifty signa- tures[.]; AND (M) FOR ANY OFFICE TO BE FILLED BY ALL THE VOTERS OF TOWNS CONTAINING ONE HUNDRED THOUSAND INHABITANTS OR LESS, NOT TO EXCEED THE NUMBER OF SIGNATURES REQUIRED BY PARAGRAPH (J) OF THIS SUBDIVISION, OR TWO TIMES THE NUMBER OF ELECTIONS DISTRICTS IN SUCH TOWN, WHICHEVER IS LESS. § 2. Notwithstanding subdivision 2 of section 6-204 of the election law and paragraph b of subdivision 3 of section 15-108 of the election law, the number of signatures required on a designating petition for a village election shall be one and one-half per centum of the number of enrolled voters of the party residing in the village.
