   printed to be committed to the Committee on Disabilities
 
 AN ACT to amend the public health law, in relation  to  blanket  service
   limits in the early intervention program
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 2559-c to read as follows:
   §  2559-C.  BLANKET  SERVICE LIMITS PROHIBITED. THE COMMISSIONER SHALL
 NOT IMPOSE  PREDETERMINED  LIMITATIONS,  INCLUDING  LIMITATIONS  ON  THE
 LENGTH,  DURATION, FREQUENCY, INTENSITY, METHOD OF DELIVERY, GROUP SIZE,
 OR STAFF RATIOS, ON ALLOWABLE SERVICES UNDER THIS TITLE. THE COMMISSION-
 ER SHALL NOT IMPOSE PROGRAM-WIDE SERVICE LIMITATIONS THAT  RESTRICT  THE
 ABILITY  OF  AN  INDIVIDUALIZED  FAMILY  SERVICES PLAN TEAM TO CREATE AN
 INDIVIDUALIZED PLAN OF EARLY INTERVENTION SERVICES MOST APPROPRIATE  FOR
 EACH CHILD AND FAMILY.
   § 2. This act shall take effect immediately.
