TITLE OF BILL:

An act relating to legalizing, validating, ratifying and confirming a
transportation contract for the West Hempstead Union Free school
district

 
PURPOSE OR GENERAL IDEA OF BILL:

To provide a deadline waiver to the West Hempstead School District so
that they may receive reimbursement for a bus transportation contract
from the State Education Department.

 
SUMMARY OF PROVISIONS:

Section 1 amends Paragraph a of subdivision 5 of section 3604 of the
education law.

Section 2 directs the State Education Department to consider the specif-

ic contracts indicated in Section 1 of the bill.

Section 3 sets the effective date.

 
JUSTIFICATION:

This bill allows the State Education Department to consider reimburse-
ment for a school bus transportation contract for the West Hempstead
School District. Specifically, the contract addressed in the bill is
E252155 from the 2017-2018 school year.

The contract is for legitimate student transportation costs incurred by
the district and is a reimbursable expense through the State Education
Department. The aid cannot be reimbursed without special legislation due
to technical errors in filing deadlines. Without the restoration of this
transportation aid, the school district would be faced with either
cutting the quality and scope of its educational programs or raising
real property taxes. This would place an undue burden on district resi-
dents and present hardships to many in the West Hempstead community.

 AN ACT relating to legalizing, validating, ratifying  and  confirming  a
   transportation  contract  for  the  West  Hempstead  Union Free school
   district

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. All the acts done and proceedings heretofore had and taken
 or caused to be had and taken by the West Hempstead  Union  Free  School
 District  and  by  all  officers,  employees  or  agents  of such school
 district relating to  or  in  connection  with  transportation  contract
 E252155 of the 2017-2018 school year, and all acts incidental hereto are
 hereby legalized, validated, ratified and confirmed, notwithstanding any
 failure   to  comply  with  the  contract  award,  approval  and  filing
 provisions of the education law, the general municipal law or any  other
 law  or  any  other  statutory authority, rule or regulation, other than
 those filing provisions defined in  paragraph  a  of  subdivision  5  of
 section  3604  of the education law, in relation to any omission, error,
 defect, irregularity or illegality in such proceeding had and taken.
   § 2. The department of education is hereby directed  to  consider  the
 aforementioned contract for transportation aid as valid and proper obli-
 gations of the West Hempstead Union Free School District.
   § 3. This act shall take effect immediately.
