BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law, in relation to authorizing the village of Freeport to have a second associate village justice THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The village law is amended by adding a new section 3-303-a to read as follows: § 3-303-A ADDITION VILLAGE JUSTICE, VILLAGE OF FREEPORT. THE VILLAGE OF FREEPORT, A VILLAGE WITH ONLY A VILLAGE JUSTICE AND AN ASSOCIATE VILLAGE JUSTICE, IS HEREBY AUTHORIZED TO ADOPT A RESOLUTION TO AUTHORIZE THE APPOINTMENT OF A SECOND ASSOCIATE VILLAGE JUSTICE TO SERVE WHEN REQUESTED BY THE VILLAGE JUSTICE OR IN THE ABSENCE OR INABILITY OF THE VILLAGE JUSTICE OR CURRENT ASSOCIATE JUSTICE TO SERVE. NOTHING IN THIS SECTION SHALL SERVE TO MODIFY OR AFFECT THE CURRENT VILLAGE JUSTICE OR ASSOCIATE VILLAGE JUSTICE IN SUCH VILLAGE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10130-01-1

The village of Freeport, a village with one village justice and one associ- ate village justice, is hereby authorized to adopt a resolution at least one hundred fifty days prior to any village general election and subject to a permissive referendum, to authorize the appointment of a second associate village justice to serve when requested by the village justice or in the absence or inability of the village justice or current associ- ate justice to serve. Nothing in this section shall serve to modify or affect the current village justice or associate village justice in such village. § 2. This act shall take effect immediately.
