BILL NUMBER: S5981 SPONSOR: MYRIE TITLE OF BILL: An act to repeal subdivision 2 of section 189 of the correction law and paragraph (b) of subdivision 5 of section 60.35 of the penal law relat- ing to the collection of an incarceration fee PURPOSE: To eliminate the collection of an incarceration fee. SUMMARY OF SPECIFICATION PROVISIONS: Section 1 repeals subdivision 2 of section 189 of the correction law. Section 2 repeals paragraph b of subdivision 5 of section 60.35 of the penal law. Section 3 provides an effective date.

MYRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to repeal subdivision 2 of section 189 of the correction law and paragraph (b) of subdivision 5 of section 60.35 of the penal law relating to the collection of an incarceration fee THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 189 of the correction law is REPEALED. § 2. Paragraph b of subdivision 5 of section 60.35 of the penal law is REPEALED. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10648-01-1
