BILL NUMBER: S6001 SPONSOR: BROOKS TITLE OF BILL: An act in relation to authorizing Choice for All, Inc. to file an appli- cation for retroactive real property tax exemption PURPOSE: The purpose of this bill is to provide Choice For All Inc. the ability to file for a retroactive property tax exemption. SUMMARY OF PROVISIONS: Section 1 authorizes the Village of Freeport to accept an application for property tax exemption for Choice for All Inc. Section 2 is the enacting clause.

S T A T E O F N E W Y O R K ________________________________________________________________________ 6001 2021-2022 Regular Sessions I N S E N A T E March 25, 2021 ___________ Introduced by Sen. BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing Choice for All, Inc. to file an appli- cation for retroactive real property tax exemption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the village of Freeport is hereby authorized to accept from Choice for All, Inc. an application for exemption from real proper- ty taxes pursuant to section 420-a of the real property tax law for the 2021 assessment roll, for the parcel owned by such organization, with such parcel being located in the village of Freeport at 358 N Main Street, otherwise known as: section 55, block 363, lot 663. If accepted, the application shall be reviewed as if it had been received on or before the taxable status date established for such roll. If satisfied that such organization would otherwise be entitled to such exemption if such organization had filed an application for exemption by the appropriate taxable state date, the assessor of the village of Freeport, upon approval by board of trustees of the village of Freeport, may grant exemption from all taxation beginning on the date of the conveyance of such parcel to such organization on the effective date of this act and cancel taxes, fines, penalties and interest remain- ing unpaid, and repay any taxes, fines, penalizes and interest paid by such organization, and make appropriate correction of the subject roll. § 2. Notwithstanding any other provision of law to the contrary, the assessors of both the village of Freeport and the county of Nassau, are hereby authorized to accept from Choice for All, a not-for-profit organization, an application for exemption from real property taxes pursuant to section 420-a of the real property tax law, with respect to the 2018-2019 and 2019-2020 assessment rolls, for the parcels owned by such not-for-profit organization, with such parcels being located at 358 North Main Street, in the village of Freeport, county of Nassau, other- wise known as Section 55, Block 363, Lot 663. If accepted, the applica- tion shall be reviewed as if it had been received on or before the taxa- ble status date established for such rolls. If satisfied that such not-for-profit organization would otherwise be entitled to such exemption if such organization had filed an application for exemption by the appropriate taxable status date, the assessor, upon approval by both the village of Freeport and the county of Nassau, may grant exemption from all taxation and make appropriate corrections to the subject rolls. If such exemption is granted and such not-for-profit organization, therefore, shall have paid any tax with respect to the subject rolls, the applicable governing body or tax department shall, in its sole discretion, provide for the refund of those taxes paid and cancel those taxes, fines, penalties, liens or interest remaining unpaid. § 2. This act shall take effect immediately.
