TITLE OF BILL:

An act to amend the education law, in relation to requiring private food
service management companies to disclose ingredient lists and nutri-
tional information for all the meals they provide school districts and
requiring such school districts to publish this information on their
website

 
PURPOSE OR GENERAL IDEA OF BILL:

To require private foodservice companies to disclose ingredient lists
and nutritional information for all meals they provide to school
districts and for school districts to publish this information online

 
SUMMARY OF PROVISIONS:

Section 1 amends article 19 of the education law by adding a new section
923 that requires all private food service management companies to
disclose ingredient lists and nutritional information to school

districts so they can post them online.

 
JUSTIFICATION:

Making sure parents, legal guardians, and students have access to what
they eat in schools is extremely important for the wellbeing of children
in New York State. This piece of legislation will require private compa-
nies who are contracted by school districts to supply meals to disclose
ingredient lists and nutritional information about what they are supply-
ing. This legislation will allow for transparency between private compa-
nies who produce meals for school districts and students, parents,
and/or legal guardians.  This legislation will hopefully start a conver-
sation to understand what is in our school lunches and also help start a
dialogue that will lead to students eating healthier meals in school.

 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:

None

 
EFFECTIVE DATE:
This act shall take effect on the one hundred twentieth day after it
shall have become a law.

 AN ACT to amend the education law, in relation to requiring private food

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section 923 to
 read as follows:
   §  923.  INGREDIENT  AND NUTRITIONAL INFORMATION REQUIREMENTS. A.  ALL
 CONTRACTS TO PROVIDE,  MAINTAIN  AND  OPERATE  CAFETERIA  OR  RESTAURANT
 SERVICE  BY  A  PRIVATE  FOOD  SERVICE  MANAGEMENT COMPANY SHALL INCLUDE
 PROVISIONS REQUIRING SUCH PRIVATE FOOD  SERVICE  MANAGEMENT  COMPANY  TO
 DISCLOSE   INGREDIENTS  LISTS  AND  NUTRITIONAL  INFORMATION  TO  SCHOOL
 DISTRICTS FOR ALL MEALS THAT SUCH COMPANY PROVIDES.
   B. ALL INGREDIENTS  LISTS  AND  NUTRITIONAL  INFORMATION  PROVIDED  TO
 SCHOOL  DISTRICTS  SHALL BE PUBLISHED AND PUBLICLY SHARED ON SUCH SCHOOL
 DISTRICT'S WEBSITE.

   B.  ALL  INGREDIENTS  LISTS  AND  NUTRITIONAL  INFORMATION PROVIDED TO
 SCHOOL DISTRICTS SHALL BE PUBLISHED AND PUBLICLY SHARED ON  SUCH  SCHOOL
 DISTRICT'S WEBSITE.
   §  2. This act shall take effect July 1, 2023.  Effective immediately,
 the addition, amendment and/or repeal of any rule or  regulation  neces-
 sary  for  the  implementation  of  this  act  on its effective date are
 authorized to be made and completed on or before such date.
