TITLE OF BILL:

An act authorizing the conveyance of real property at the State Univer-
sity of New York College at Delhi

 
PURPOSE:

To authorize the exchange of parcels of realty between the State of New
York, on behalf of the State University of New York Technical College at
Delhi and the College Foundation at Delhi in order to facilitate the
construction and operation of a hotel.

 
SUMMARY OF PROVISIONS:

Section 1 of the legislation states the intent underscoring this legis-
lation.

Section 2 of the legislation provides that, notwithstanding the

provisions of any other law, the State of New York may convey to College
Foundation at Delhi a parcel of real property, now owned or to be owned
by the State,under the jurisdiction of SUNY Delhi, described in section
3 of the legislation, in exchange for the conveyance by the College
Foundation at Delhi to the State, for the benefit of SUNY Delhi, of four
parcels of real property described in section 4 of the legislation, upon
such terms and conditions as the parties may agree.

Section 5 of the legislation provides that it shall take effect imme-
diately.

 
EXISTING LAW:

The Public Lands Law ("PLL") governs the manner in which the State of
New York may convey title lands owned by the State. Once a State entity
determines that land is no longer useful or necessary for the purposes
of the State entity (PLL 30-A), the Commissioner of General Services is
authorized to sell the property at public auction (PLL 33(1) or to
convey title to a municipality for certain uses (PLL 34).

 
JUSTIFICATION:

The purpose of this legislation is to authorize the exchange of parcels
of real property between the State of New York and the College Founda-
tion at Delhi to facilitate the construction and operation of a hotel in
support of SUNY Delhi's hospitality management program. In absence of
the legislation, SUNY Delhi would lack authority to convey its parcel to
the College Foundation at Delhi since the provisions of the Public Lands
Law would otherwise apply.

The College Foundation at Delhi would acquire a 7.2-acre parcel, the
Brown Athletic Fields, located on Main Street in the Village of Delhi.
This property is adjacent to the SUNY Delhi campus. It is currently used
as an athletic field and will be developed for the site of a future
hotel that will provide experiential learning opportunities for SUNY
Delhi's Hospitality Management and Culinary academic programs. Further,
the hotel will provide substantial economic development benefit to
village of Delhi, Delaware County, and the region. Following the
exchange, the athletic fields will be relocated to another campus prop-
erty. The legislation allows SUNY Delhi to exchange a parcel of land now
owned by the State and under the jurisdiction of the SUNY Delhi for
parcels of land of similar value owned by the College Foundation at
Delhi. The parcels SUNY Delhi would be acquiring are: B-1 Route 10/Bell
Hill, a 180.19-acre parcel surrounding and contiguous to the SUNY Delhi
main campus a critical piece of property of future College growth/use;
B-2 Golf Course Maintenance Property, a 6.86-acre property used as an
applied learning laboratory for SUNY Delhi's Golf and Sports Turf
Management programs, this facility will also serve as an emergency shel-
ter for animals housed at the college farm (on SUNY Delhi's Valley
Campus); B-3 Outdoor Education Center, a 38.2-acre property developed by
the college's applied sciences programs that serves as a learning labo-
ratory for those programs; and B-4 Arbor Hill Property, a 15.2-acre
property in close proximity to SUNY Delhi's Valley Campus, will allow
for future growth and development of SUNY Delhi's Valley Campus and
serve as a secondary relocation site for farm animals in the event of
emergency.

Both parties consider such an exchange of property advantageous for
their respective campus projects. The College Foundation at Delhi's
parcels affords opportunities for integration of the academic program
inclusion and will allow for future development of the SUNY Delhi
campus.

 AN ACT authorizing the conveyance of real property at the State  Univer-
   sity of New York College at Delhi
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Legislative findings. The legislature finds that the  State
 University  of  New  York,  Agricultural  and Technical College at Delhi
 ("University") is in need of additional facilities to fulfill its legis-
 latively mandated  mission  of  providing  educational  experiences  and
 applied  learning  opportunities  to  its  students.  Specifically,  the
 College Foundation  at  Delhi,  Inc.    ("Foundation")  has  offered  to
 construct,  maintain  and  operate  a  hotel to support the University's
 hospitality management program on a site that is  currently  state-owned
 land. To effectuate this development, the Foundation would exchange four
 parcels  of  land to be put to future academic purposes with a parcel of
 state-owned land located in the Town of Delhi.
   The legislature further finds that granting the trustees of the  State
 University  of  New York the authority and power to exchange the subject
 land will ensure such activity will promote the continued investment  in
 tourism and economic development in the surrounding community.
   § 2. Notwithstanding any other provision of law, the state of New York
 is authorized to convey to the College Foundation at Delhi, Inc. all its
 rights, title and interest in the real property and improvements thereon
 described  as  Parcel  A  in section three of this act, now owned by the
 state of New York and under the jurisdiction of the State University  of
 New York College at Delhi, in exchange for the conveyance by the College
 Foundation  at  Delhi, Inc. to the state of New York, for the benefit of
 the State University of New York College at Delhi, of  all  its  rights,
 title  and  interest  in  the  real  property  and  improvements thereon
 described as Parcels B-1, B-2, B-3, and B-4 in section four of this act,

 owned by the College Foundation at Delhi,  Inc.,  upon  such  terms  and
 conditions  as  the  parties  shall agree. The conveyances authorized by
 this act may be made upon such terms and conditions as the state of  New
 York and the College Foundation at Delhi, Inc. may agree.
   §  3.  The property authorized by this act to be conveyed by the State
 University of New York at Delhi to the College Foundation at Delhi, Inc.
 is generally described as that parcel of real property with improvements
 thereon consisting of a total of approximately 7.28 acres owned  by  the
 State  University  of New York at Delhi. The description in this section
 of the parcel to be made available pursuant to this act is not meant  to
 be a legal description, but is intended only to identify the parcel:
   ALL  that  certain  plot,  piece or parcel of land situate, lying, and
 being in the Village of Delhi, County of Delaware and State of New York,
 being bounded and described as follows:
   PARCEL A
   BEGINNING at a point on at the northwesterly corner  of  Appropriation
 Map 11.
   RUNNING  THENCE  South 68 degrees 30 minutes 40 seconds East along the
 northerly bounds of Appropriation Map 11 a distance of 82.00 feet  to  a
 point;
   THENCE North 89 degrees 50 minutes 50 seconds East along the northerly
 bounds of Appropriation Map 12 a distance of 513.92 feet to a point;
   THENCE  South 22 degrees 30 minutes 20 seconds West along the easterly
 bounds of Appropriation Map 12 a distance of 701.78 feet to a point;
   THENCE North 68 degrees 30 minutes 40 seconds West along the southerly

 bounded and described as follows:
   BEGINNING at a point on the northerly side of New York State Route 10,
 said point being the most  southerly  corner  of  the  herein  described
 parcel  of  land, thence continuing along the lands of Sherwood Mountain
 Farm Irrevocable Trust (DB 1380 PG 122) the following nine  (9)  courses
 and distances:
