TITLE OF BILL:

An act in relation to authorizing certain health care professionals
licensed to practice in other jurisdictions to practice in this state in
connection with the Winter World University Games; and providing for the
repeal of such provisions upon expiration thereof

 
PURPOSE:

This legislation allows health care professionals to perform services at
the Winter World University Games, Lake Placid 2023, scheduled from Jan.
12, 2023 to Jan. 22, 2023. The bill permits such professionals to begin
practicing upon athletes' expected arrival in the state on Jan. 5, 2023
and remains in effect until Jan. 25, one day after the teams' antic-
ipated departure.

 
SUMMARY OF PROVISIONS:

Section 1 - Permits health care professionals licensed or certified by a

foreign government to provide professional services to athletes and
staff in relation to the Winter World University Games, Lake Placid
2023.

Section 2 - Permits health care professionals licensed or certified in
other states and territories to provide professional services to
athletes and staff in relation to the Winter World University Games,
Lake Placid 2023.

Section 3 - Provides effective date and date of repeal.

 
JUSTIFICATION:

Beginning the first week of January 2023, athletes, coaches, VIPs, and
staff will arrive in the North Country for the Winter World University
Games, Lake Placid 2023.

From Jan. 12 through Jan. 22, about 1,700 athletes, representing 50
countries, will compete in sports such as hockey, speed skating, ski
jumping, curling, figure skating and biathlon.

An athletic event of this scale will require significant medical
resources from specialists hailing from throughout the U.S. and the
world. Some teams will bring their own medical staff. The organizer,
North Country Sports Council, also intends to provide medical personnel.

The games are a significant event for New York's Olympic region.  Compe-
titions are scheduled at venues throughout the North Country, including
many of the state's Olympic facilities.

Buffalo's World University Games in 1993 were a premier event for that
region, and the Legislature approved legislation similar to this bill
prior to its commencement.

This act shall take effect on Jan. 5, 2023 and shall expire and be

 AN ACT in relation to  authorizing  certain  health  care  professionals
   licensed  to practice in other jurisdictions to practice in this state
   in connection with the Winter World University  Games;  and  providing
   for the repeal of such provisions upon expiration thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any other provision of law to the contrary,
 any person who is licensed or  certified  as  a  physician,  physician's
 assistant, massage therapist, physical therapist, chiropractor, dentist,
 optometrist,  nurse,  nurse  practitioner, emergency medical technician,
 podiatrist or athletic trainer  by  a  foreign  government  may  provide
 professional  services within this state without a license in connection
 with the Winter World University Games, Lake Placid 2023. Such  services
 shall  be  limited  to  athletes and personnel in relation to the Winter
 World University Games, Lake Placid 2023, between the dates  of  January
 5, 2023 and January 25, 2023.
   §  2.  Any person who is licensed or certified to practice as a physi-
 cian, physician's  assistant,  massage  therapist,  physical  therapist,
 chiropractor, dentist, optometrist, nurse, nurse practitioner, emergency
 medical  technician,  podiatrist or athletic trainer in another state or
 territory, who is in good standing in such state or territory,  and  who
 has  been  appointed  by  the Adirondack North Country Sports Council to
 provide professional services at an event in this  state  sanctioned  by
 the  Adirondack  North  Country Sports Council, may provide such profes-
 sional services to athletes and team personnel registered to train at  a
 location  in  this  state or registered to compete in an event conducted
 under the sanction of the Adirondack North  Country  Sports  Council  in
 this  state  without  first being licensed pursuant to the provisions of
 title 8 of the education law or certified pursuant to the provisions  of

 the  public  health  law,  as  may be applicable. Such services shall be

JUSTIFICATION:

personnel. However, not all teams will have their own staff, and the
medical personnel available in New York will not provide enough
resources for the anticipated medical needs associated with the Games.

The games are a significant event for New York's Olympic region.  Compe-
titions are scheduled at venues throughout the North Country, including
many of the state's Olympic facilities.

Buffalo's World University Games in 1993 were a premier event for that
region, and the Legislature approved legislation similar to this bill
prior to its commencement.
