2021-S7333 (ACTIVE) - Summary

Provides that a public body of a municipal corporation may conduct a meeting via video conference if the public body: provides an opportunity for the public to contemporaneously view and listen to such meeting online, makes a video recording of the meeting and posts the recording on the public body's website within five business days of the meeting; makes related provisions.

   printed to be committed to the Committee on Rules
 
 AN ACT to amend the public officers law, in relation to conducting meet-
   ings of public bodies via video conference technology  or  via  simul-
   taneous video conference and in-person

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (c) of section 103 of the public officers law, as
 added by chapter 289 of the laws of 2000, is amended to read as follows:
   (c) (I) A public body that uses videoconferencing to conduct its meet-
 ings shall provide an opportunity for the public to attend,  listen  and
 observe at any site at which a member participates.
   (II)  IN  THE ALTERNATIVE, A PUBLIC BODY OF A MUNICIPAL CORPORATION AS
 DEFINED IN SECTION SIXTY-SIX OF THE GENERAL CONSTRUCTION LAW MAY CONDUCT
 A MEETING VIA VIDEO CONFERENCE OR VIA SIMULTANEOUS VIDEO CONFERENCE  AND
 IN-PERSON IF THE PUBLIC BODY: (1) PROVIDES AN OPPORTUNITY FOR THE PUBLIC
 TO CONTEMPORANEOUSLY VIEW AND LISTEN TO SUCH MEETING ONLINE; (2) MAKES A
 VIDEO  RECORDING  OF  THE  MEETING;  AND  (3) POSTS THE RECORDING ON THE
 PUBLIC BODY'S WEBSITE WITHIN FIVE BUSINESS DAYS  OF  THE  MEETING.    IN
 ADDITION,  UPON  REQUEST OF A MEMBER OF THE PUBLIC, THE PUBLIC BODY MUST
 MAKE AVAILABLE A SPECIFIC LOCATION WITHIN THE JURISDICTION OF THE MUNIC-
 IPAL CORPORATION FOR THE PUBLIC TO  VIEW  AND  LISTEN  TO  SUCH  MEETING
 ONLINE,  PROVIDED  THE  REQUEST  IS  RECEIVED AT LEAST FORTY-EIGHT HOURS
 PRIOR TO THE TIME THE MEETING IS SCHEDULED TO BEGIN.
   § 2. This act shall take effect immediately.
