 AN ACT to amend the state finance law, in relation to guidelines by  the
   state procurement council
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 161 of the state finance law is amended by adding a
 new subdivision 2-a to read as follows:
   2-A. THE GUIDELINES ESTABLISHED PURSUANT TO THIS SECTION SHALL INCLUDE
 A PREFERENCE FOR ANY BUSINESS LOCATED IN A COUNTY WITHIN THE STATE  THAT
 HAS  EXPERIENCED  NEGATIVE POPULATION AS DETERMINED BY THE LATEST AVAIL-
 ABLE ANNUAL ESTIMATES OF RESIDENT POPULATION BY THE UNITED STATES BUREAU
 OF CENSUS.
   § 2. This act shall take effect on the sixtieth  day  after  it  shall
