 Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the general business law,  in  relation  to  prohibiting
   supply chain surcharges on consumer goods or services
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The general business law is amended by adding a new section
 390-d to read as follows:
   § 390-D. SUPPLY CHAIN SURCHARGE PROHIBITED. 1.  FOR  THE  PURPOSES  OF
 THIS  SECTION THE TERM "SUPPLY CHAIN SURCHARGE" SHALL MEAN A FEE IMPOSED
 ON A GOOD OR SERVICE DUE TO THE LACK OF  RAW  MATERIALS  IN  THE  SUPPLY
 CHAIN OR DUE TO ANY OTHER SUPPLY CHAIN ISSUE.
   2.  NO  SELLER  IN  ANY  SALES TRANSACTION SHALL IMPOSE A SUPPLY CHAIN
 SURCHARGE ON A CONSUMER. THE DISPLAY PRICE FOR ANY GOOD OR SERVICE SHALL
 INCLUDE ALL COSTS ASSOCIATED WITH SUCH GOOD OR SERVICE INCLUDING BUT NOT
 LIMITED TO TAXES AND FEES.
   3. ANY SELLER WHO VIOLATES THE PROVISIONS OF  THIS  SECTION  SHALL  BE
 GUILTY  OF A MISDEMEANOR PUNISHABLE BY A FINE NOT TO EXCEED FIVE HUNDRED
 DOLLARS FOR EACH OFFENSE.
   § 2. This act shall take effect immediately.
