BILL NUMBER: S7884 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the public health law, in relation to designated essen- tial support persons for individuals with disabilities PURPOSE: To clarify that a legal guardian of an individual with a disability is also someone who can designate an essential support person on the indi- vidual's behalf, in addition to the individual. SUMMARY OF PROVISIONS: This bill amends Chapter 689 of the Laws of 2021 to also allow the legal guardian of an individual with a disability as someone who can designate an essential support person on the individual's behalf, in addition to the individual.

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to designated essen- tial support persons for individuals with disabilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 2 of section 2828 of the public health law, as amended by a chapter of the laws of 2021 amending the public health law relating to prohibiting general hospitals from disallowing individuals with disabilities from having an essential support person accompany them for the duration of their hospitalization, as proposed in legislative bills numbers S. 1035-A and A. 4685-A, is amended to read as follows: (b) An individual with a disability OR THE LEGAL GUARDIAN FOR THE INDIVIDUAL shall be allowed to designate a single primary essential support person to assist with COMMUNICATING medical NEEDS and MANAGING everyday needs during hospitalization and such essential support person shall be limited to such individual's parent, spouse or caretaker. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2021 amending the public health law relating to prohibiting general hospitals from disallowing individuals with disabilities from having an essential support person accompany them for the duration of their hospitalization, as proposed in legislative bills numbers S. 1035-A and A. 4685-A, takes effect.
