TITLE OF BILL:

An act to amend the highway law, in relation to designating a portion of
the state highway system as the "Firefighter Robert Fowler Memorial
Highway"

 
PURPOSE:

Designates all that portion of state highway system constituting state
route two hundred and fifty-nine between Lyell Avenue and state route
thirty-one in the village of Spencerport, as the "Firefighter Robert
Fowler Memorial Highway".

 
SUMMARY OF PROVISIONS:

Section 1 designates the portion of state highway to be renamed as the
"Firefighter Robert Fowler Memorial Highway". Section 2 outlines that
the renaming is ceremonial, and that the commissioner of transportation
shall install and maintain the signage for the designation. Section 3 is

the effective date.

 
JUSTIFICATION:

On Saturday, February 22, 1997, at 9am, Robert "Bob" Fowler of the
Spencerport Volunteer Fire Department was responding to a call of 70+
mile-per-hour winds blowing the windows out of a storefront in the
Village of Spencerport. Along with his 15 year old son Tim, who served
in the department explorer program, Firefighter Fowler was on the way to
the firehouse to respond to the call, when at the intersection of Route
259 and Lyell Avenue, heavy winds blew over a 40 foot tree, causing it
to fall onto the length of the car, crushing it. Tim, sitting in the
passenger seat, ducked down and the airbag covered him; partially
protecting him from the force, suffering serious back injuries from
which he has recovered, however, Firefighter Fowler took the full blow
of the tree and died instantly.

Firefighter Fowler joined the Spencerport Fire Department in 1974 and
served the people of his community for over years. In addition to
responding to calls to protect lives and property, he also assisted the
fire department behind-the-scenes. He knew how important family support
was to volunteer firemen and, therefore, how important it was for the
fire department to support families. For many years, he organized the
Christmas Party for the children of department members.  He also worked
on the annual Easter and Halloween Parties, including setting up the
haunted house, being there when he was needed.

Firefighter Robert'"Bob" Fowler was survived by his wife Gail and sons
Alan and Tim.

 AN ACT to amend the highway law, in relation to designating a portion of
   the state highway system as the "Firefighter  Robert  Fowler  Memorial
   Highway"
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The highway law is amended by adding a new section 344-n to
 read as follows:
   § 344-N. PORTION OF THE STATE HIGHWAY SYSTEM TO BE DESIGNATED  AS  THE
 "FIREFIGHTER  ROBERT  FOWLER  MEMORIAL HIGHWAY". ALL THAT PORTION OF THE
 STATE HIGHWAY SYSTEM CONSTITUTING STATE  ROUTE  TWO  HUNDRED  FIFTY-NINE
 BETWEEN LYELL AVENUE AND STATE ROUTE THIRTY-ONE IN THE VILLAGE OF SPENC-
 ERPORT,  TOWN  OF OGDEN, COUNTY OF MONROE, SHALL BE DESIGNATED AND KNOWN
 AS THE "FIREFIGHTER ROBERT FOWLER MEMORIAL HIGHWAY".
   § 2. The commissioner of transportation shall provide for the  instal-
 lation  and  maintenance of adequate signing of the state highway system
 as designated pursuant to section one of this  act.  However,  to  avoid
 confusion  and  to limit any possible disruption of commerce, the desig-
 nation called for pursuant to section one of this act shall  be  one  of
 ceremonial  nature  and  the  official name of such highway shall not be
 changed as a result of this act.
   § 3. This act shall take effect immediately.
