BILL NUMBER: S8931 SPONSOR: GAUGHRAN TITLE OF BILL: CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 5 of article 8 of the constitution, in relation to the exclu- sion of indebtedness contracted for sewage facilities PURPOSE: To enable counties, cities, towns and villages to finance construction and reconstruction of sewage treatment facilities without limiting their capacity to finance other essential capital requirements. SUMMARY OF PROVISIONS: Section 1 of this bill amends Paragraph E of Section 5 of Article 8 of the Constitution to extend, until January 1, 2034, the authority of counties, cities, towns and villages to exclude from their constitu- tional debt limits indebtedness contracted for the construction and reconstruction of facilities for the conveyance, treatment and disposal

GAUGHRAN -- (at request of the State Comptroller) -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 5 of article 8 of the constitution, in relation to the exclusion of indebtedness contracted for sewage facil- ities Section 1. Resolved (if the Assembly concur), That paragraph E of section 5 of article 8 of the constitution be amended to read as follows: E. Indebtedness contracted on or after January first, nineteen hundred sixty-two and prior to January first, two thousand [twenty-four] THIR- TY-FOUR, for the construction or reconstruction of facilities for the conveyance, treatment and disposal of sewage. The legislature shall prescribe the method by which and the terms and conditions under which the amount of any such indebtedness to be excluded shall be determined, and no such indebtedness shall be excluded except in accordance with such determination. § 2. RESOLVED (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
