BILL NUMBER: S1087 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the busi- ness enterprise was unsuccessful in obtaining the contract PURPOSE: This bill would require that minority and women-owned businesses be informed of the reason that they were not awarded a State or municipal contract. SUMMARY OF PROVISIONS: Section 1 requires corporations provide notice to each minority or women-owned business enterprise that unsuccessfully bid on contract(s) within 30 days of awarding a contract.

COMRIE, COONEY, RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Corpo- rations, Authorities and Commissions AN ACT to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the business enterprise was unsuccessful in obtaining the contract THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause IV of subparagraph (H) of paragraph (j) of subdivi- sion 3 of section 2879 of the public authorities law, as added by chap- ter 174 of the laws of 2010, is amended and a new subparagraph (I) is added to read as follows: IV. consult the most recent disparity study pursuant to article fifteen-A of the executive law[.]; AND (I) A REQUIREMENT THAT, WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE CORPORATION AWARDING THE CONTRACT PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 2. Section 143 of the economic development law is amended by adding a new subdivision 6 to read as follows: 6. WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE AGENCY AWARD- ING THE CONTRACT SHALL PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 3.
