BILL NUMBER: S1347 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the executive law, in relation to exempting hot tubs or spas from certain standards of the New York state uniform fire prevention and building code PURPOSE: This chapter amendment makes changes to provisions L.2022 c.651 amending the executive law relating exempting hot tubs or spas with safety covers from certain provisions of law, as proposed in legislative bills S.7858 and A.8646, to clarify that hot tubs with covers are exempt from the other requirements of the subdivision and swimming pools with covers are exempt from paragraph b of the subdivision. SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the executive law, in relation to exempting hot tubs or spas from certain standards of the New York state uniform fire prevention and building code THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph c of subdivision 14 of section 378 of the execu- tive law, as amended by a chapter of the laws of 2022 amending the exec- utive law relating to exempting hot tubs or spas with safety covers from certain provisions of law, as proposed in legislative bills numbers S. 7858 and A. 8646, is amended to read as follows: c. hot tub or spa with a safety cover which complies with American Society of Testing and Materials International standard F1346 (2003) or any similar standard which may be approved by the council [or] SHALL BE EXEMPT FROM THE PROVISIONS OF THIS SUBDIVISION AND ANY swimming pool, other than a hot tub or spa, with an automatic power safety cover which complies with American Society of Testing and Materials International standard F1346 (2003) or any similar standard which may be approved by the council shall be exempt from the provisions of PARAGRAPH B OF this subdivision. § 2. Paragraph c of subdivision 14 of section 378 of the executive law, as added by chapter 234 of the laws of 2007, is relettered para- graph d. § 3. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 amending the executive law relating to exempting hot tubs or spas with safety covers from certain provisions of law, as proposed in legislative bills numbers S. 7858 and A. 8646, takes effect.
