§ 9-0903. Recreation facilities.

1. The department shall have care, custody, control and management of
the Lake George beach facility in Warren county, the Belleayre mountain
ski center in Ulster and Delaware counties, the Whiteface mountain ski
center and the New York world war veterans memorial highway in Essex
county and the Gore mountain ski center and the Prospect Mountain
Veteran's Memorial Highway in Warren county. The New York world war
veterans memorial highway in Essex county and the Prospect Mountain
Veteran's Memorial Highway in Warren county shall continue to be
maintained by the Department of Transportation.

2. The commissioner shall have the power and is authorized to impose
and provide for the collection of such fees or charges as he may deem
necessary and for the best interests of the state for the use of all
facilities and their appurtenances. All moneys received therefrom shall
be deposited in the State Treasury pursuant to the provisions of the
State Finance Law.

3. The department shall have the supervision and jurisdiction over all
locks and adjacent state property between the Saranac river and lower
Saranac lake and between lower Saranac and middle Saranac lake in the
county of Franklin and make such improvements and repairs thereto from
time to time as may be necessary.

4. The commissioner shall have the power and is authorized to
encourage investment by the private sector for the provision of
equipment and capital improvements for concession facilities operated at
the Belleayre Mountain ski center and the Gore Mountain ski center by
entering into concession license agreements for extended periods not to
exceed ten years in total. Such extended term shall be for the purpose
of assuring a concessionaire of adequate protection against loss of
investment in structures, fixtures, equipment, supplies and other
improvements, and the length of such term shall have a direct
relationship to the period required to amortize the investment. The bid
prospectus submitted to prospective bidders shall contain specific
information concerning the nature of the capital improvements or
equipment to be provided by the successful bidder.
