Golden: New York Department Of State Designates Brooklyn Communities As Cease And Desist Zone

Brooklyn- State Senator Marty Golden (R-C, Brooklyn) today is announcing that following a year long effort, working with the community residents and homeowners, the Madison Marine area of Kings County has been extended as part of the non-solicitation area as designated by the New York State Department of State, an area that extends west to Ocean Avenue and south to Emmons Avenue.

Due to the numerous complaints of solicitation by real estate brokers, Senator Golden and his staff first met with the Department of State in December, 2006, to discuss the possibility of extending the Cease and Desist zone, in response to complaints received about the negative impact solicitations were having on the community’s quality of life. Senator Golden and the Madison Marine Civic Association submitted written testimony at a public hearing hosted by the New York State Department of State this past September.

Madison Marine has been officially added to the State Department of State’s Regulation which has been amended to now include this community. The regulation states: Pursuant to State Rules and Regulations (19NYCRR 175.17(c) ), Community Planning Districts 9, 10, 11 and 12 in Bronx County, All of Queens County, and Canarsie, Mill Basin, Mill Island, Bergen Beach, Futurama, Marine Park and now Madison Marine in Kings County are cease and desist zones.

Senator Marty Golden stated, "This is a tremendous victory for the people of the Madison Marine community who have long been forced to deal with these regular and often annoying solicitations as it relates to their homes and property. Local residents who have achieved part of the American dream, as a homeowner, should not be subjected to this real estate sales approach. If someone wants to sell their house, they will list their house for sale, and thus in accordance with their family plan and schedule, they will decide when the right time to sell or move is."

Owners of residential property in one of these areas who are not on the July 2007 Cease and desist list and wish to be added to this cumulative listing, specifically all residents of the newly added Madison Marine Community, must complete the owners statement and return it to the Department of State. By sending in the special request form, the homeowner requests the Department of State, by virtue of the power vested in The Secretary of State pursuant to Article 12A of the Real Property Law to issue a Cease and Desist Order to all licensed brokers and salespersons from solicitation of the undersigned, until such time as they notify The DOS to the contrary in writing.

Homeowners added to the list indicate that these owners are not desirous of selling such property and hereby revoke the invitation to solicit for the sale or purchase of such property in any manner whatsoever. Further, the regulation prevents homeowners from receiving any communication of whatever nature relating to such sale or purchase from any real estate broker or salesperson. Completion of this form and the issuance of a Cease and Desist Order does not prevent an owner from selling or listing his or her home for sale with a real estate broker.
