 4   Senator Phillips, read it in its entirety, and

 6                ACTING PRESIDENT GRIFFO:   The

 8                THE SECRETARY:   Legislative 

 9   resolution by Senator Phillips, commemorating the 

10   9th Annual St. Baldrick's Shave Off and the 

11   4th Annual Ladies Night, in honor of Aiden 

12   Binkley.  

13                "WHEREAS, The State of New York 

14   takes great pride in helping to increase 

15   awareness and understanding of childhood cancers  

16   which affect citizens across our great state and 

17   throughout the nation; and 

18                "WHEREAS, It is the sense of this 

19   Legislative Body to recognize that the quality 

20   and character of life in the communities across 

21   New York State are reflective of the concerned 

22   and dedicated efforts of those organizations, 

23   individuals, and events which devote themselves 

24   to the welfare of the community and its 

25   citizenry; and

 1                "WHEREAS, Attendant to such concern,  

 2   and in full accord with its long-standing 

 3   traditions, this Legislative Body is justly proud 

 4   to commemorate the 9th Annual St. Baldrick's 

 5   Shave Off and the 4th Annual Ladies Night, in 

 6   honor of 11-year-old Aiden Binkley, a resident of 

 7   Floral Park, New York, who passed away on 

 8   December 30, 2010, after losing his battle with 

 9   Stage 4 rhabdomyosarcoma; Aiden is one of 1,600 

10   St. Baldrick's honored kids; and 

11                "WHEREAS, This Legislative Body is 

12   further proud to recognize the outstanding 

13   efforts of Aiden's Army to raise funds for 

14   childhood cancer research in honor of Aiden 

15   Binkley; and 

16                "WHEREAS, The St. Baldrick's Shave 

17   Off was held on Saturday, April 28, 2018, in the 

18   parking lot of Trinity Restaurant in Floral  

19   Park, New York; one of the largest St. Baldrick's 

20   events on Long Island to date, 200 people got 

21   their heads shaved and $400,000 was raised; and 

22                "WHEREAS, The St. Baldrick's Ladies 

23   Night was held on Thursday, April 26, 2018, at 

24   The Inn at New Hyde Park, New Hyde Park, 

25   New York, hosted by the Wednesday Mother's Club,

 1   a local club which has represented the 

 2   Floral Park community for 70 years; this 

 3   favorable event raised $146,000; and 

 4                "WHEREAS, More children are lost to 

 5   cancer in the United States than any other 

 6   disease, in fact, more than many other childhood 

 7   diseases combined; before they turn 20, about one 

 8   in 285 children in the United States will have 

 9   cancer, and worldwide, a child is diagnosed  

10   every two minutes; and 

11                "WHEREAS, Only 4 percent of 

12   United States federal funds for cancer research 

13   is solely dedicated to childhood cancer  

14   research; the St. Baldrick's Foundation was 

15   established to fill this gap by providing funding 

16   to research programs worldwide through local 

17   fundraising events; and 

18                "WHEREAS, St. Baldrick's Foundation 

19   is a well-respected national organization which 

20   operates via the local level through neighborhood 

21   head-shaving events and 'Do What You Want' 

22   fundraising initiatives; nearly half a million 

23   shaved heads later, they are still the most 

24   popular fundraiser; and 

25                "WHEREAS, Kids with cancer often

 1   lose their hair during treatment; as a 'shavee,'  

 2   an individual will shave their head to show their 

 3   support, and in the process, inspire friends and 

 4   family to donate to childhood cancer research; 

 5   and 

 6                "WHEREAS, The remarkable donors and 

 7   volunteers of St. Baldrick's Foundation have 

 8   enabled the organization to fund over 

 9   $230 million in childhood cancer research grants 

10   which are given to more than 300 institutions 

11   throughout the United States; and 

12                "WHEREAS, In 2008, Father John 

13   O'Farrell at Our Lady of Victory in Floral Park,  

14   New York, asked Bob GaNun to shave his head for 

15   kids with cancer; the next year, Bob and his 

16   wife, Tricia, moved the head-shaving event to the 

17   Trinity Restaurant, where it has become an annual 

18   occasion for their village; and 

19                "WHEREAS, At the heart of the event 

20   is Aiden Binkley, whom volunteer event organizer 

21   Bob GaNun met when Aiden was battling cancer; in 

22   response to the tragic loss of Aiden, his young 

23   brothers, Jake and Devin, formed Aiden's Army in 

24   2011, to inspire kids to shave their heads for 

25   St. Baldrick's Foundation; and

 1                "WHEREAS, Aiden's Army is unique due 

 2   to 90 percent of those who get their heads shaved 

 3   are children; in 2014, St. Baldrick's Ladies  

 4   Night was formed when the Wednesday Mother's Club 

 5   teamed up with Aiden's Army, and concurrently ran 

 6   a cupcake sale, raising $1,000 in a few short 

 7   hours; four years later, the cupcake sales 

 8   evolved into an annual St. Baldrick's Ladies 

 9   Night Dinner, which has raised $200,000 

10   cumulatively; and 

11                "WHEREAS, Today, through the 

12   steadfast efforts of Aiden's brothers, his 

13   parents, Lisa and Michael Binkley, and his aunt, 

14   Terry Binkley Paterno, who serves as chairperson 

15   of St. Baldrick's Ladies Night, Floral Park's 

16   annual hometown shave event continues to honor 

17   Aiden's memory and his positive attitude, which  

18   has inspired many throughout the last 

19   seven years; when Aiden was diagnosed, he truly 

20   believed he got cancer to cure cancer; and 

21                "WHEREAS, Since its first shave 

22   event, Aiden's Army and St. Baldrick's Ladies 

23   Night has raised more than $2,000,000 for cancer  

24   research; in 2018, the two Village of Floral Park 

25   events were ranked sixth in the world for

 1   donations raised for the St. Baldrick's 

 2   Foundation; currently, through increased 

 3   childhood cancer research, approximately 

 4   90 percent of kids with the most common type of 

 5   cancer will live; and 

 6                "WHEREAS, This Legislative Body is 

 7   pleased to have the opportunity to express its 

 8   highest admiration for Aiden's Army and 

 9   St. Baldrick's Foundation, and to wish both 

10   organizations continued success in all their 

11   worthy endeavors; now, therefore, be it 

12                "RESOLVED, That this Legislative 

13   Body pause in its deliberations to commemorate 

14   the 9th Annual St. Baldrick's Shave Off and the 

15   4th Annual Ladies Night, in honor of Aiden 

16   Binkley; and be it further 

17                "RESOLVED, That a copy of this 

18   resolution, suitably engrossed, be transmitted to 

19   Aiden's Army."

20                ACTING PRESIDENT GRIFFO:   Senator 

21   Phillips.

22                SENATOR PHILLIPS:   Yes.  So 

23   Mr. President, thank you.  

24                And I rise today to welcome the 

25   Binkley family and to honor the Binkley family

 1   and to honor Aiden, who passed away, as the 

 2   resolution said, on December 30, 2010, at the 

 3   young age of 11, after losing his courageous 

 4   battle with cancer.

 5                In July 2008, Aiden was diagnosed 

 6   with a rare form of cancer called 

 7   rhabdomyosarcoma.  And as his father said today, 

 8   sadly, because he's had to say that word so many 

 9   times in his life, he says it off the tip of his 

10   tongue.

11                During Aiden's illness the Binkley 

12   family learned about St. Baldrick's Foundation, 

13   which hosts thousands of these local events to 

14   raise funds for childhood cancer.  As mentioned 

15   in the resolution, in 2009 Aiden participated in 

16   his first St. Baldrick's Shave Off, which 

17   occurred in Floral Park thanks to Bob GaNun, who 

18   is also here today.  Thank you, Bob.

19                At the event, people shaved their 

20   heads in unity with children who have lost their 

21   own hair during their cancer treatment.  Numerous 

22   friends, families and community members turned 

23   out in droves to show their support for Aiden by 

24   shaving their heads.

25                At the event, Aiden took off his

 1   baseball cap.  And according to his family, as he 

 2   stood amongst his new friends, he smiled and said 

 3   "For the first time, I feel normal."

 4                Well, I never met Aiden.  I have 

 5   learned he was a special kid who could light up a 

 6   room -- friendly, smart, caring, artistic.  He 

 7   was a big fan of the New York Jets -- we won't 

 8   say anything about that -- especially Quarterback 

 9   Mark Sanchez, whom he established a personal 

10   friendship with.

11                Shortly after Aiden passed away, his 

12   brothers, Jake and Devin, took their grief and 

13   their sorrow and formed this Aiden's Army, to 

14   inspire kids all over the place to shave their 

15   heads for the St. Baldrick's event.

16                The Floral Park event is now one of 

17   1,000 annual events worldwide.  This year 

18   200 people shaved their heads in honor of Aiden 

19   and helped raise over $400,000.

20                As a complement to this, as the 

21   resolution said, the Wednesday Mothers Club of 

22   Floral Park partnered up and created the 

23   St. Baldrick's Ladies Night in 2014.  And they 

24   started as a cupcake sale, which raised over a 

25   thousand dollars in just a few hours.  And they

 1   thought, Shoot, if we can raise a thousand 

 2   dollars in a couple of hours, think what else we 

 3   can do.

 4                So I know I was graciously invited 

 5   to their event this past year, and I had no idea 

 6   what I was going to walk into.  And I walked into 

 7   over 700 women who were there to raise money for 

 8   the St. Baldrick's Foundation, which raised over 

 9   200,000 in that one night.  

10                Since the inception of the first 

11   Shave Off in 2009, total donations raised in 

12   Floral Park has exceeded $2.5 million.  Now, for 

13   those of you that don't know Floral Park, it's 

14   not a large community.  And this really is what 

15   community is all about:  coming together and 

16   working for a cause.  Their success has made the 

17   Floral Park St. Baldrick's events the sixth top 

18   fundraiser in the world for the foundation.

19                One day while they were driving to 

20   treatment, Aiden told his mother that he thought 

21   the reason he got cancer was so that he could 

22   help find a cure.  

23                So to each of you who have loved and 

24   cared for Aiden, I have no doubt that he is 

25   looking down on you at all times and thanking you

 1   for continuing his effort to find a cure for 

 2   cancer.  So God bless you.  Thank you for joining 

 3   us in the Senate today.

22   to continue to raise awareness -- not only in 

23   Aiden's name, but in order to try to achieve more 

24   efforts to secure funding in this fight against 

25   childhood cancer.

 2   your adversity, all of our hard work and your 

 3   efforts.  God bless you all.

 9   like to introduce you to my seatmate.  This is 

10   Senator Akshar.  And you're going to understand 

11   why I just introduced him to you.  The Lions 

12   captured the New York State Class B Boys 

13   Basketball Championship defeating Seton Hall --

17   Veterans Memorial Arena in Binghamton, New York.

20                SENATOR TEDISCO:   -- Senator Akshar 

21   represents Seton Hall Catholic and that arena, 

22   and he was in the gym that day.  And he has told 

23   me that you played an outstanding game.  His team 

24   tried their very best to make up for it.  He has 

25   challenged me to a one-on-one contest.  I've

 1   agreed to play left-handed and spot him 19 out of 

 2   21.  And he thinks he has a chance.

 4                SENATOR TEDISCO:   No, he's a 

 5   hustler on the team.  But he says he'll come back 

 6   next year, but unfortunately I think you will 

 7   too.

 8                The victory earned Mekeel Christian 

 9   Academy the school's first ever state 

10   championship, finishing with an overall record of 

11   25 and 4.  Outstanding.

12                During the season, the team enjoyed 

13   the number-one ranking in New York State for a 

14   period of 13 straight weeks.  Players Deonte 

15   Holder and Jordan Jackson were News Channel 13 

16   All-Stars in the Capital Region, and senior 

17   Carter Stewart was named the tournament's Most 

18   Valuable Player and will be taking his talents to 

19   Binghamton University in the fall.  So you can 

20   watch him rub it in a little bit more as he 

21   scores a lot of points there, but helps your 

22   school over there.  

23                Head Coach Chad Bowman earned career 

24   win number 400 in the state championship game.  

25   So congratulations to you, Coach.  That's an

 2                In addition to the members of the 

 3   team, with us today are the school's other 

 4   assistant coaches -- Assistant Coaches Mike Show, 

 5   George Stewart, Khristian Collins, and Adrian 

 6   Barcelon -- and Athletic Director Dan Decker.  

 7                Truly an outstanding team, working 

 8   together to win an unbelievable championship in a 

 9   25-and-4 record.

10                Mr. President, please welcome to the

21   Mr. President.

22                The full version of the resolution 

23   goes into the intricate deals of what meningitis 

24   is all about, the five subgroups of meningitis, 

25   and a little bit about the progress that the

 1   State of New York has made in promoting 

 2   vaccination against meningitis.

 3                The reason I rose today is because 

 4   we're joined by Patti Wukovits and Nancy Quinn, 

 5   Patti's mother, and they're here because of the 

 6   tragic circumstance to Patti's daughter Kimberly.  

 7                Kimberly was 17, healthy, ready to 

 8   graduate from high school, and came home one day 

 9   complaining of aches and pains and a fever, and 

10   within 24 hours had to be admitted to the 

11   emergency room, where they suspected bacterial 

12   meningitis.  And within weeks, she was subject to 

13   heart and kidney failure and passed away.  

14                At the time, she had vaccinations 

15   against some of the strains of meningitis but 

16   now, years after she passed away, we have 

17   vaccines against all.  

18                And it's a very surprising disease, 

19   strikes without any warning, and can bring just 

20   tragedy to any family.  So Patti Wukovits has 

21   started the Kimberly Coffey Foundation to spread 

22   the word about meningitis.  

23                And we in this state have only made 

24   some progress.  We did pass a law in 2015 in 

25   regard to children entering grades 7, 8 and 12 be

 1   immunized.  We also required warning pamphlets 

 2   and all that to people going into college.  But 

 3   that's not far enough.  To the two or three 

 4   higher education institutions that have 

 5   experienced a wave of meningitis in the campus, 

 6   they immediately require everybody to get 

 7   inoculated.  

 8                After we worked on the warning 

 9   pamphlet legislation, it was interesting -- to a 

10   person, people who had helped us in this house 

11   and the other house said to themselves, When my 

12   kid goes to college, I'm going to get them 

13   inoculated against meningitis.  

14                So we have a ways to go.  We can 

15   prevent future tragedies that Patti Wukovits and 

16   her mother, Nancy Quinn, went through.  And I 

17   just wanted to thank you.  

18                And Mr. President, they've joined us 

19   in the gallery.  And if you can just acknowledge 

20   their presence, I would appreciate it.

 9   lucky bidders to win a day in Albany hosted by 

10   myself and Assemblymember Jeff Dinowitz.  I 

11   understand that the bidding was wild, it got up 

12   to a lot of money, but they were very gracious in 

13   agreeing to win this bid.

14                So I want to recognize them today 

15   and praise them for their hard work.  They're 

16   accompanied by their kids.  They're enjoying the 

17   day.

12                This bill was written to honor the 

13   legacy of Bailey Bates.  Bailey Bates was a 

14   19-year-old autistic man from Poughkeepsie who 

15   tragically committed suicide in July of 2017 

16   after con artists preyed on his disability and 

17   targeted him for that reason to exploit him 

18   financially.  

19                Under current state law, despite 

20   evidence that the perpetrators knowingly took 

21   advantage of his vulnerability when preying on 

22   him, the accused stand only to be charged with 

23   minimal counts of endangerment and grand larceny, 

24   and they will not be held accountable for the 

25   role they played in his death.

 1                Bailey's mother has been a champion 

 2   for this legislation and to ensure that his 

 3   legacy is one that helps to empower New Yorkers 

 4   by actively working to deter these kinds of 

 5   shameful crimes.  

 6                As someone who has lost a loved one 

 7   to suicide, I know firsthand how traumatic this 

 8   experience can be.  I cannot imagine to cope with 

 9   that hurt only to find out that heartless 

10   criminals who sought to exploit a vulnerable 

11   person played a direct role in causing the loss.  

12                We have a duty to ensure that 

13   prosecutors have the tools they need to properly 

14   hold these despicable perpetrators and those like 

15   them accountable.  That is the goal of Bailey's 

16   Law.  

17                When I first heard Bailey's story, I 

18   immediately began researching the issue and 

19   discovered another alarming parallel when I 

20   discovered that seniors across our country are 

21   committing suicide as a direct result of falling 

22   victim to a financial scam.  

23                American seniors are bilked out of 

24   almost $37 billion each and every year, and too 

25   many are either unable or unwilling to come

 1   forward about the abuse.  A quick Google search 

 2   will reveal several news reports detailing the 

 3   fact that too often seniors who have been 

 4   victimized are turning to suicide.  And just like 

 5   in Bailey's case, there's simply no justice when 

 6   this happens.  These scammers are able to go back 

 7   out into society and prey on other vulnerable 

 8   victims.  

 9                As the Aging chair, I thought this 

10   bill would provide an important opportunity to 

11   give law enforcement another important tool to 

12   help them prevent another all-too-silent 

13   epidemic, elder abuse.  

14                I thank my colleagues for 

15   recognizing the importance of this bill today, 

16   and I urge my colleagues in the Assembly to make 

17   its passage a priority at the end of session so 

18   that we can more effectively empower and protect 

19   vulnerable New Yorkers.

21   for Capital Aid for the schools.  This bill 

22   requires that the State Education Department 

23   wisely conduct a study and determine whether 

24   Westchester should be placed within that region 

25   or more appropriately within the Long Island/

 2   belong there, and it will make a huge difference 

 3   to all the schools in our district.
