LEGISLATIVE RESOLUTION commemorating the 40th Anniversary of the United
States Supreme Court decision in Roe v. Wade

WHEREAS, It is the sense of this Legislative Body to recognize the mile-
stones which have substantially impacted the lives of the citizens of
this state; and
WHEREAS, Forty years ago today, on January 22, 1973, the United States
Supreme Court announced its decision in Roe v. Wade, finding that a
woman's right to decide whether to become a parent deserves the highest
level of constitutional protection; and
WHEREAS, The Roe v. Wade decision struck down a Texas statute that had
made it a crime to perform an abortion unless a woman's life was at
stake, recognizing for the first time that the constitutional right to
privacy "is broad enough to encompass a woman's decision whether or not
to terminate her pregnancy"; and
WHEREAS, To reach its decision in Roe, the U.S. Supreme Court drew on
decades of case law that established that the government cannot inter-
fere with certain personal decisions about procreation, marriage, and
other aspects of family life; and
WHEREAS, The legalization of abortion after the Roe v. Wade decision
drastically reduced the complications and deaths from illegal abortions,
which were the cause of 17 percent of all deaths due to pregnancy and
childbirth in 1965, before the Roe decision; and
WHEREAS, The Supreme Court's decision in Roe v. Wade greatly increased
the ability of women to control their own reproductive lives and thus
determine their future; women, men, children, and families have lived
healthier lives since the historic Roe v. Wade decision; and
WHEREAS, The New York State Legislature has long been a leader on
women's health care, passing legislation in 1970 to make New York one of
the first states to make abortion legal and continuing to lead the
nation in safeguarding women's health; now, therefore, be it
RESOLVED, That this Legislative Body pause in its deliberations to
commemorate the 40th Anniversary of the United States Supreme Court's
Roe v. Wade decision.
