ESTABLISHING a plan setting forth the methodology
for allocating a certain appropriation for the
2018-2019 state fiscal year, for additional grants
in aid to certain school districts, public
libraries, and not-for-profit institutions
RESOLVED, That pursuant to and as required by subdivision 5 of
section 24 of the state finance law, moneys appropriated in section 1 of
chapter 53 of the laws of 2018 which enacts the aid to localities
budget, as added by section 2 of chapter 54 of the laws of 2018, under
the office of prekindergarten through grade twelve education program for
the education department from the local assistance account, for
additional grants in aid to certain school districts, public libraries,
and not-for-profit institutions shall be allocated only pursuant to a
plan setting forth an itemized list of grantees with the amount to be
received by each, or the methodology for allocating such appropriation.
Such plan shall be subject to the approval of the temporary president of
the senate and the director of the budget and thereafter shall be
included in a resolution calling for the expenditure of such monies,
which resolution must be approved by a majority vote of all members
elected to the senate upon a roll call vote. Provided, however, that the
funds appropriated herein shall be made available on or after April 1,
2019. Notwithstanding section 40 of the state finance law or any
provision of law to the contrary, this appropriation shall lapse on
March 31, 2020. The methodology for allocating such appropriation is as
follows:
The state education department shall pay directly to each New York
state charter school an amount equal to three hundred dollars multiplied
by the total number of students enrolled in such charter school as
reported to the state education department's basic educational data
system by each such charter school as of February 1, 2019 for the
2018-19 school year.
Provided further, if the total amount would exceed the available
appropriation, such payments shall be prorated so that the total amount
paid to charter schools herein shall not exceed the appropriation total.
