RESOLUTION OF THE ASSEMBLY for the Impeachment of
Governor Andrew M. Cuomo

WHEREAS, Governor Andrew M. Cuomo is currently facing investigations
by the Federal Bureau of Investigation (FBI) and U.S. Attorney for the
Eastern District regarding COVID-19 related deaths in nursing homes; as
well as an investigation by the New York State Attorney General
regarding sexual harassment claims against him; and

WHEREAS, The four Legislative Leaders and numerous state legislators
and local officials have called on Governor Cuomo to resign or consider
stepping down from office, illustrating a severe lack of trust and
credibility of the Governor during a critical time when New York State
continues to deal with the public health, economic and social impacts of
COVID-19; and

WHEREAS, The Legislature and Executive must expeditiously commence
with comprehensive budget negotiations in order to finalize the spending
plan for the 2021-22 Fiscal Year by the mandatory deadline of April 1,
2021; and

WHEREAS, It has been chronicled in the press that unlawful or
improper methods have been used or pursued by public officers and
wrongful acts done to cover-up the number of COVID-19 related nursing
home and long-term care facility deaths, by intentionally underreporting
the true death toll by fifty percent; and upon further information and
belief willfully and corruptly altered a July report "Factors Associated
with Nursing Home Infections and Fatalities in New York State During the
COVID-19 Global Health Crisis" issued by the New York State Department
of Health, to significantly undercount nursing home related deaths; and

WHEREAS, A transcript has been released of a meeting in which a top
aide to the Governor admitted that the administration froze information
on COVID-19 related nursing home deaths in response to a request from
the U.S. Department of Justice; and

WHEREAS, It has been alleged by one member of the Assembly that the
Governor threatened the member's career as political retribution; and

WHEREAS, Recent widely and publicly available reports by the press
contain allegations by at least four former employees of the Executive
detailing pervasive sexual harassment by the Governor; and

WHEREAS, The laws of New York State provide protection for all
individuals from unlawful discrimination and harassment; and

WHEREAS, Governor Cuomo has otherwise committed actions of willful
and corrupt misconduct; and

WHEREAS, Given the above instances of willful and corrupt
misconduct, the Governor is hereby deemed unfit to serve in his public
office and should be removed from said office upon the adoption of this
resolution; now, therefore, be it


RESOLVED, That Andrew M. Cuomo, Governor of the State of New York,
be and hereby is impeached for willful and corrupt misconduct in office
and high crimes and misdemeanors.
