§ 27-0920. Reports.

1. Subject to the moneys available to the department for such
purposes, the department shall submit to the governor, the temporary
president of the senate and the speaker of the assembly on an annual
basis a complete and detailed report setting forth:

(a) The status of all permits issued and pending for the treatment,
storage, transportation or disposal of hazardous wastes pursuant to
section 27-0707 and section 27-0913 of this chapter.

(b) The types and amounts of financial assurances which have been
required pursuant to this section.

(c) Any other matters that the department determines relevant for
inclusion.

2. On-site environmental monitors at commercial hazardous waste
facilities which utilize secure landburial facilities as a primary
disposal technique shall prepare a calendar-based quarterly report on
the facility including a list of any violations observed and the actions
taken to correct them, a list of any fines or penalties levied during
the period covered, the status of any construction, improvement or
expansion projects at the facility, any pertinent information or trends
derived from monitoring devices and any other information useful to
describing the operational status of the facility. The reports shall be
made on a standard form as determined by the department and shall be
filed within twenty days after the end of each calendar quarter with the
appropriate department regional office, with the facility and with any
municipality and county within which the facility is located. Each
monitor assigned to the facility during a report period shall sign the
report and shall be available to answer questions posed by the
municipalities or facility operator concerning the activities described
in each such report. Quarterly reports shall be kept on file at the
appropriate regional office and made available to the public.
