Payment of fines, disposition thereof and related matters

* § 2021. Payment of fines, disposition thereof and related matters.

1. A fine imposed and paid before commitment, must be received by the
court, and unless otherwise provided by law, shall be the property of
the town in which the offense was committed if the fine was imposed by a
town court. If, however, the fine was imposed by a village court for an
offense committed in a village, then, unless otherwise provided by law,
the fine shall be the property of the village in which the offense was
committed. All such fines shall be paid to the state comptroller by the
court on or before the tenth day of the month next succeeding their
collection. Notwithstanding the foregoing provisions of this
subdivision, all fines imposed for the violation of a village local law,
ordinance or regulation, unless otherwise provided by law, shall be the
property of such village, whether or not the village has established the
office of village justice.

2. If the defendant is committed in default of the payment of a fine,
he may pay it, and any surcharge and/or crime victim assistance fee, to
the sheriff or superintendent or municipal official of the facility to
whom the defendant was committed who shall, within thirty days after the
receipt thereof, unless otherwise provided by law, pay the same to the
justice of the court that rendered the conviction.
