§ 400. Method of commencing action or special proceeding.
Section three hundred four of the civil practice law and rules shall
not apply in this court. An action is commenced in this court and
jurisdiction acquired by service of a summons. A special proceeding is
commenced and jurisdiction acquired by service of a notice of petition
or order to show cause.
