LEGISLATIVE RESOLUTION urging Governor David A. Paterson to recommend
the use of a Project Labor Agreement for the construction of the Global
Foundries facilities at the Luther Forest Technology Campus Project,
located in the Town of Malta, County of Saratoga, State of New York

WHEREAS, The Luther Forest Technology Campus located in the Town of
Malta, County of Saratoga, State of New York, is the site of the
proposed Global Foundries silicon wafer manufacturing facility (to be
known as Fab 2); and
WHEREAS, Once operational, this facility will be the only independent-
ly-managed, advanced semiconductor manufacturing foundry in the United
States, bucking the trend of manufacturing industries leaving the United
States; and
WHEREAS, To complete this project, Global Foundries will receive near-
ly $1.2 billion in state aid, $600 million in state grants, along with
$28 million in tax incentives from the Saratoga County Industrial Devel-
opment Agency (IDA); and
WHEREAS, The building of this facility is expected to generate more
than 1,400 construction jobs over the eighteen-month period of
construction, resulting in approximately five million man hours of work
to be completed; and
WHEREAS, On February 9, 2009, President Barack Obama issued Executive
Order 13502, which recommended the use of Project Labor Agreements in
order to promote efficient administration and completion of projects;
and
WHEREAS, There have been discussions among the parties regarding a
Project Labor Agreement for this project, one of the largest upstate New
York economic development projects in the history of the State; and
WHEREAS, Other economic development projects in this region of the
State such as the IBM Clean Room Design Services Project in Fishkill
(Dutchess County), the GAP Distribution Warehouse (Dutchess County), the
Albany Courthouse Project (Albany County), the Rensselaer School Project
(Rensselaer County), the South Glens Falls School (Saratoga County),
Woodbury Commons (Orange County) and Harriman Commons (Orange County)
have contained Project Labor Agreements; and
WHEREAS, The use of a Project Labor Agreement for the construction of
the Luther Forest Technology Park Project will facilitate its completion
on time, on budget, as well as create labor harmony; and
WHEREAS, The substantial public dollars committed to this project of
nearly $1.2 billion represents a significant state interest in this
project with the creation of local construction jobs to alleviate the
increased unemployment rate in this region of New York State, along with
the creation of 1,400 permanent direct jobs at the Saratoga County site
and more than 5,000 indirect jobs in the region; and
WHEREAS, The present economic crisis in the State of New York, with
unemployment in the Capital Region - Saratoga County rising to over 7.6
percent and adjacent areas of Warren County having an unemployment rate
of 10 percent, makes it unacceptable for out-of-state workers to be
considered for employment on this project; now, therefore, be it
RESOLVED, That this Legislative Body pause in its deliberations to
urge Governor David A. Paterson to recommend the use of a Project Labor
Agreement for the construction of the Global Foundries facilities at the
Luther Forest Technology Campus Project, located in the Town of Malta,
County of Saratoga, State of New York; and be it further
RESOLVED, That a copy of this Resolution, suitably engrossed, be tran-
smitted to The Honorable David A. Paterson, Governor of the State of New
York.
