LEGISLATIVE RESOLUTION honoring Investigator Darryl D. O'Shei upon the
occasion of his designation as the recipient of a Superintendent's
Commendation Award at the 34th Annual New York State Police Awards Day
Ceremony on May 20, 2010

WHEREAS, The quality and sanctity of community life are cherished
values, worthy of safeguarding; this Legislative Body is moved to honor
those who preserve and protect such values, lauding particularly their
unwavering courage and dedication in the daily performance of their
duties; and
WHEREAS, Attendant to such concern, and in full accord with its long-
standing traditions, this Legislative Body is justly proud to honor
Investigator Darryl D. O'Shei, of VCIT, Troop A Headquarters in Batavia,
upon the occasion of his designation as the recipient of a Superinten-
dent's Commendation Award; and
WHEREAS, A Trooper since April 30, 1997, he received the award in
recognition of his outstanding police work at the 34th Annual State
Police Awards Day Ceremony, held at the New York State Police Academy in
Albany on Thursday, May 20, 2010; and
WHEREAS, On June 6, 1992, the body of John S. Rutledge, with multiple
gunshot wounds, was found in a ditch along Sawyer Road in the Town of
Carlton, Orleans County; and
WHEREAS, The New York State Police subsequently conducted an extensive
investigation, during which numerous interviews were conducted leading
to the location of the alleged murder weapon and the identification of
Joyce Powell as the primary suspect in the case; unfortunately, with
very little substantive information or physical evidence developed, the
case eventually went cold; and
WHEREAS, In August 2003, Investigator O'Shei was assigned to continue
the investigation into this cold case homicide; over the next six-plus
years, he diligently pursued every possible investigative lead, he rein-
terviewed all the principals in the case, and identified and interviewed
many new witnesses; and
WHEREAS, The efforts Investigator O'Shei put forth in his investi-
gation led to the development of new evidentiary information resulting
in an Orleans County Grand Jury indictment of Joyce Powell and Shaliq
Reed for Murder 2nd Degree; and
WHEREAS, Unlike many cold case homicide investigations, this one was
not solved in a laboratory; it was solved with old-fashioned police
work, utilization of Investigator O'Shei's exemplary interview skills,
and his dedication to his profession; and
WHEREAS, Investigator O'Shei's superlative efforts during this inves-
tigation and the high degree of professionalism, determination, and
tenacity he demonstrated successfully closed a 17-year-old homicide
case; and
WHEREAS, In keeping with the finest traditions of the New York State
Police, Investigator Darryl D. O'Shei has distinguished himself by his
exemplary achievement and outstanding performance on behalf of the
community he so faithfully and courageously serves; and
WHEREAS, The dedicated efforts of public servants, such as Investi-
gator Darryl D. O'Shei, who unselfishly devote their lives to the pres-
ervation of order and the protection of others are worthy of the full
praise of this Legislative Body and the people of the State of New York;
now, therefore, be it
RESOLVED, That this Legislative Body pause in its deliberations to
honor Investigator Darryl D. O'Shei upon the occasion of his designation
as the recipient of a Superintendent's Commendation Award at the 34th

Annual New York State Police Awards Day Ceremony on May 20, 2010; and be
it further
RESOLVED, That a copy of this Resolution, suitably engrossed, be tran-
smitted to Investigator Darryl D. O'Shei.
