Senator Schneiderman and Assemblyman Espaillat Crack Down on Immigration Services Fraud
Groundbreaking Legislation Requires State Licenses For Private Service Providers
And Stiffer Penalties For Lawbreakers
“Crooked businesses are preying on immigrant communities by promising them the world, stealing millions of dollars and delivering nothing in return. Shamefully, these scam artists have turned the American Dream into an absolute nightmare for too many families across this state. This legislation sends a clear message to the unscrupulous businesses who are profiting off the exploitation of the most vulnerable New Yorkers among us: you will be held accountable,” said Senator Eric Schneiderman, the lead sponsor of the bill.
Across New York, fraudulent service providers are making millions of dollars by ripping off immigrant communities for what they think are rushed or necessary applications for life-altering legal documents: green cards, entrance visas for family members, or the passports to leave and enter the country. In reality, many of these so-called service providers leave immigrant communities with nothing at all, while helping themselves to large fees.
Many of these providers falsely claim that they are attorneys or have close connections with the U.S. Citizenship and Immigration Services, oftentimes using titles such as notary-public or “notario” to deceive people into believing that they are legitimate. Victims of these scams not only stand to lose large sums of money, but also are likely to suffer harm to their immigration status.
"I am strongly in support of this Bill, immigrants are one of the most vulnerable groups in our society and it is the responsibility of lawmakers to protect them," said Senator Kevin Parker, a sponsor of the bill.
“This bill will punish unscrupulous scammers who target and exploit immigrants and their families. We cannot allow these organizations to continue to rob immigrants of their hard-earned savings and tear their families apart. Predators - who prey on victims trying to secure a better life in this country, only to see their dreams shattered - will be brought to justice,” said Assemblymember Espaillat, the sponsor of the bill in the Assembly.
“As an organization that sees firsthand the immigration consequences wrought by the shoddy work of unscrupulous immigration service providers, the Schneiderman/Espaillat bill will go a long way to protect the most vulnerable immigrants among us," said Angela Fernandez, Executive Director of Northern Manhattan Coalition For Immigrants’ Rights. “We welcome and celebrate Senator Schneiderman and Assemblyman Espaillat's leadership in tackling this issue head on by introducing this long overdue bill.”
“Fraudulent and unauthorized immigration services pose a major threat to our communities and our economy. Immigrant communities deserve protection from fraud, just like everyone else does. The Schneiderman/Espaillat bill will protect vulnerable communities from being victimized by ruthless, greedy con artists,” said Moisés Pérez, Executive Director of Alianza Dominicana.
The New York Immigration Assistance Services law was enacted in 2004 to protect immigrants from being exploited by establishing new standards and protections to effectively regulate the activities of those who would take advantage of them.
However, recent prosecutions by Attorney General Cuomo have demonstrated that the 2004 reforms were not enough to prevent bad actors from taking advantage of immigrant communities. Aggressive and innovative, the Schneiderman/Espaillat bill will enact a comprehensive registration mechanism so that the State can monitor, investigate and prosecute those who seek to defraud immigrant communities.

Innovadora legislación requiere a los proveedores privados adquirir una licencia estatal y estipula fuertes penalidades para los que violen la ley
NUEVA YORK.- El Senador Eric T. Schneiderman (D-Manhattan/Bronx) y el Asambleísta Adriano Espaillat (D-Manhattan) anunciaron una innovadora legislación hoy para combatir a los estafadores que proveen servicios legales fraudulentos y trámites relacionados con el estatus migratorio en Nueva York. Para eliminar esta engañosa practica, el proyecto de ley Schneiderman-Espaillat, requiere que los proveedores de servicios de inmigración privados obtengan una licencia y crea un banco de datos sobre proveedores de servicios para que los potenciales clientes puedan verificar rápidamente si la persona que están utilizando esta registrado apropiadamente. El proyecto además establece fuertes penalidades a los proveedores que violen la ley.
"Negocios corrompidos están 'cazando' en comunidades de inmigrantes, prometiéndoles el mundo, robándole millones de dólares sin resolverle nada. Descaradamente, estos artistas de la estafa han convertido el sueño americano en una verdadera pesadilla para demasiadas familias en todo el Estado. Esta legislación le envía un claro mensaje a los negocios inescrupulosos que se están beneficiando con la explotación de los neoyorquinos más vulnerables: ustedes pagarán por sus hechos", dijo el Senador Eric Schneiderman, principal patrocinador del proyecto legislativo.
A nivel del Estado de Nueva York, proveedores fraudulentos de servicios están acumulando millones de dólares, estafando a comunidades inmigrantes haciéndoles creer que necesitan llenar solicitudes apresuradamente o documentos legales para obtener: tarjetas de residencia, visas para familiares o pasaportes para salir o entrar del país. En realidad, mucho de estos llamados proveedores de servicios no proveen absolutamente nada, al tiempo que cobran altas tarifas.
Muchos de estos "proveedores" se hacen pasar por abogados o alegan tener conexiones con la oficina de Servicios de Inmigración y Naturalización de los Estados Unidos, muchas veces usando el titulo de notario público o "notario" para engañar a personas que creen que son legítimos. Las victimas de estos fraudes no solamente pierden altas sumas de dinero, pero además pueden sufrir complicaciones en su estatus migratorio.
"Este proyecto castigará a estafadores inescrupulosos que explotan a inmigrantes y sus familias. No podemos permitirle a estas negocios continuar robándole a los inmigrantes sus ahorros ganados con tanto sacrificio, ni seguir destruyendo a estas familias. Estos depredadores que se dedican a cazar victimas que están tratando de asegurar una mejor vida en este país, solo para ver sus sueños destruidos, serán llevados a la justicia", dijo el Asambleísta Espaillat, patrocinador del proyecto legislativo en la Asamblea Estatal.
"Como una organización que ha visto de primera mano las consecuencias en el estatus migratorio que inescrupulosos proveedores de servicios, sabemos que el proyecto Schneiderman/Espaillat viene a proteger a los mas vulnerables inmigrantes entre nosotros", dijo Angela Fernández, Directora Ejecutiva de la Coalición por los Derechos de los Inmigrantes del Norte de Manhattan. "Nosotros le damos la bienvenida y celebramos el liderazgo del Senador Schneiderman y el Asambleísta Adriano Espaillat al enfrentar este problema de frente al introducir un proyecto que se necesitaba desde hace mucho tiempo".
“Servicios de inmigración fraudulentos y no autorizados presentan una gran amenaza a nuestras comunidades y economía. Las comunidades inmigrantes merecen protección del fraude, al igual que el resto de la población. El proyecto de ley Schneiderman/Espaillat protegerá comunidades vulnerables para que no sean victimizadas por inescrupulosos estafadores,” dijo Moisés Pérez, director ejecutivo de Alianza Dominicana.
La ley de Asistencia Migratoria de Nueva York fue promulgada en el 2004 para proteger a los inmigrantes de ser explotados, estableciendo nuevos estándares y protecciones para regular efectivamente las actividades de aquellos que intentaban aprovecharse de ellos.
Sin embargo, sometimientos recientes por la oficina del Procurador General Andrew Cuomo ha demostrado que la reforma del 2004 no es suficiente para prevenir que estafadores se aprovechen de comunidades inmigrantes. Agresivo e innovador, el proyecto Schneiderman Espaillat establecerá mecanismos de registro para que el Estado pueda monitorear, investigar y someter a aquellos que intenten engañar a los clientes.
