The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted for each bill.
S8752 CHAPTER AMENDMENT - Requires contractors and subcontractors performing construction work for covered renewable energy systems to have apprenticeship agreements; relates to the effectiveness of provisions of law related thereto. Amends the underlying chapter by changing the effective date and clarifying the bill's application. AYE
S8753 CHAPTER AMENDMENT - Amends the underlying chapter to limit the application of the mechanical insulation energy savings program to certain building types and to limit the size of competitive grant awards. Establishes the mechanical insulation energy savings program to provide grants for qualified mechanical insulation expenditures to school districts, public hospitals, public housing buildings, and political subdivisions that have completed a qualified audit. AYE
S8756 CHAPTER AMENDMENT - Adds to the list of persons eligible to execute an anatomical gift where the decedent did not make such a gift, nor provide any information that they did not want to donate, to include a close friend (defined as anyone 18 years of age or older, who was a close friend or a relative other than a spouse, child, parent, brother or sister, and who maintained regular contact with the patient as to be familiar with the patient’s activities, health and religious or moral beliefs, and who presents a signed statement to that effect to the attending practitioner) of the decedent. Amends the underlying chapter to extend effective date to 180 days. AYE
S8761 CHAPTER AMENDMENT - Provides an owner or lessee access to adjoining property to make improvements or repairs for certain circumstances. Amends the underlying chapter by broadening the definition of state entity and clarifying the general liability insurance requirements. AYE
S8764 CHAPTER AMENDMENT - Requires utilities to fully describe their capital expenditures in rate cases and requires the burden of proof to show that a capital expenditure is just and reasonable be on the utility. Amends the underlying chapter to limit the application of this bill to a major change in rates and clarifies that the PSC shall consider the operation of the distribution system among other factors when examining capital expenditures. AYE
S8767 CHAPTER AMENDMENT -Requires the office of parks, recreation and historic preservation to develop and approve operational safety plans prior to the deployment of any employee in hazardous conditions. Amends the underlying chapter by clarifying (1) evacuation plan procedures and (2) agency responsibilities in multi-agency deployments. AYE
S8768 CHAPTER AMENDMENT - Provides that a mortgagee (mortgage lender) receives a payment at the location and in the manner specified by the mortgagee, then the mortgagee must accept and may not return or destroy any payment receive in reliance on a payoff statement and must promptly apply such payment to the unpaid principal, interest or any other amounts due under the mortgage. Amends the underlying chapter by clarifying when a mortgagee may return, destroy, or otherwise refuse a payment made pursuant to the terms of a payoff letter. AYE
S8787 CHAPTER AMENDMENT - Amends the underlying chapter to provide that in the absence of a contract between a licensed harness racing corporation and a representative horsemen's organization, the previously negotiated contract related to welfare, medical, or retirement plans will be automatically extended for a one-time period of twelve months. AYE
S8790 CHAPTER AMENDMENT - Authorizes municipalities to offer a real property tax exemption for active military service members. Amends the underlying chapter by clarifying the definition of "armed forces" to include those service members who are Guard or Naval Militia members who may be activated to a combat zone under Title 10 of the United States Code and considered "armed forces." The amendment also specifies that a service member currently receiving any other property tax exemption on another assessment roll would be ineligible for this tax exemption on the same roll. AYE
S8802 CHAPTER AMENDMENT -This bill seeks to expand continuing care retirement communities (CCRCs) throughout New York. Amends the underlying chapter by maintaining Department of Financial Services oversight and making technical conforming changes. AYE
S8806 CHAPTER AMENDMENT - Directs counties, in coordination with their regional emergency medical services councils, to develop and maintain comprehensive county emergency medical system plans that provide for coordinated emergency medical systems within such counties. Amends the underlying chapter by requiring the Department of Health (the "Department") to publicly post the county plan model on its website, to remove the requirement that county plans become effective upon the Department's verification, and to provide the Department with 60 days to review plans and provide written feedback. AYE
S8820 CHAPTER AMENDMENT - Amends the underlying chapter that directs the Public Service Commission (PSC) to require all pole owners and attachers to submit certain identification information to the PSC by adjusting reporting requirements to include all third party attachers and removing additional penalties for failing to comply with existing regulations and certain industry standards. AYE
S8827 CHAPTER AMENDMENT - Requires warning labels on social media platforms which provide an addictive feed, autoplay, infinite scroll, like counts, and/or push notifications; directs the commissioner of mental health to design the warning label. Amends the underlying chapter amendment by amending the legislative intent, and redefining the scope of the law to be limited to social media platforms that offer an addictive feed, autoplay and/or infinite scroll. AYE
S8834 COSPONSOR CHAPTER AMENDMENT - Relates to non-Indian trespass and drug trafficking activities within Indian lands, and to criminal law enforcement activities within Seneca nation lands. Amends the underlying chapter by clarifying that people passing through Native or tribal lands on a highway, road, path, etc., are not considered to have entered those lands and clarifies that the agreements the Seneca Nation may enter into with local law enforcement do not supersede any existing Laws, rules, or regulations nor do they carry the force of Law. AYE
S8772 CHAPTER AMENDMENT - This bill amends the Insurance Law in relation to cost-sharing requirements for high deductible health insurance (HDHI) plans with health reimbursement or health savings accounts (HSAs). Amends the underlying chapter by removing the exemption for high-deductible health plans from cost-sharing limitations up to the IRS minimum deductible. AYE
S8774 CHAPTER AMENDMENT - This bill would amend LAB 954 related to certain provisions on elevator licensing and temporary elevator mechanics. Amends the underlying chapter by changing the effective date, providing the Department of Labor With additional oversight authority, and removing additional requirements. AYE
S8795 CHAPTER AMENDMENT - Extends paid family leave benefits to certain construction employees who shall be eligible for family leave benefits if they were employed for at least twenty-six of the last thirty-nine weeks by any covered employer which is signatory to a collective bargaining agreement. Amends the underlying chapter by making technical amendments, changing the effective date, and clarifying the eligibility for benefits related to the paid family leave period. AYE
S8800 CHAPTER AMENDMENT - Requires rates paid for rehabilitation and opioid treatment be pursuant to certain fee schedules published by the office of addiction services and supports. Amends the underlying chapter by directing the Office of Mental Health to publish information adequate to calculate the rates that would be paid for such treatment pursuant to the medical assistance program. AYE
S8804 CHAPTER AMENDMENT - Authorizes increased equity withdrawals by certain non-public residential health care facilities; establishes the nursing home worker recruitment and safety fund. Amends the underlying chapter to exclude private non-public nursing homes under the Special Focus Facility program, nursing homes subject to the denial of payment from Medicaid and Medicare, and nursing homes subject to enforcement action by the department in the last 18 months that resulted in a finding of deficiency from making equity withdrawals. AYE
S8807 CHAPTER AMENDMENT - Specifies that professional liability insurance insurers cannot deny coverage or increase rates solely based on legal use or prescription of certain gender-affirming care-related drugs; prescribes procedures for warrants issued in other jurisdictions for electronic data related to legally protected health activities; provides for additional procedural methods for protection of legally protected health activities. NAY
S8814 CHAPTER AMENDMENT - Prohibits the sale of kratom to individuals under the age of twenty-one. Amends the underlying chapter by changing the effective date from immediate to 180 days, requiring online notices in addition to physical signs, clarifying ability of the Attorney General to seek injunctive relief after violations, and adding clarifications on fines assessed. AYE
S8818 CHAPTER AMENDMENT - Requires tower services contracts between New York State or any of its agencies and a private company to require certified safety trainings for tower climbers, as well as share details about the private entity's contractors and subcontractors, including identifying business information. Amends the underlying chapter by changing the effective date, transferring the bill's provisions to the State Finance Law, and requiring OGS oversight. AYE
S8831 CHAPTER AMENDMENT - Regulates automated decision-making by government agencies. Amends the underlying chapter amendment by repealing the requirements of disclosure of automated decision making tools by government agencies, amending the scope of tools to be automated employment decision tools, and clarifying its applicability to SUNY and CUNY. It also clarifies that local governments shall report on their use of automated employment decision making tools to the extent practicable. AYE
S8832 CHAPTER AMENDMENT - Relates to rechargeable battery recycling. Refines battery safety measures, further define the parameters of e-bike and e-scooter retailer participation in the program, augment manufacturer requirements, require a study of e-bike and e-scooter battery collection performance. AYE
S8758 CHAPTER AMENDMENT - Authorizes a practitioner in any institutional dispenser to administer controlled substances for use off their premises, as emergency treatment to a patient as authorized by the FDA for purpose of initiating maintenance treatment, detoxification treatment, or both to an addict or habitual user. Amends the underlying chapter by modifying an additional reference to the term addict. AYE
S8763 CHAPTER AMENDMENT - Requires the District Attorney to provide a written summary of a disposition to a crime victim following an acquittal after trial or the sentencing of any defendant for a felony. Amends the underlying chapter by specifying that the district attorneys provide the written summary to the victim by mail, electronically, or any other reasonable and secure means of written communication. AYE
S8769 CHAPTER AMENDMENT - Enacts the "Lieutenant Joseph Banish mental health act" which establishes a law enforcement peer support program. Amends the underlying chapter by limiting when a peer support participant may disclose confidential communication to members of the same law enforcement agency and clarifies that nothing within the statute shall prevent or limit required disclosure concerning child abuse, mandatory extreme risk protection orders, or as required by any court order. Further, the Division of Criminal Justice Services will approve training courses and, if necessary, develop rules and regulations. AYE
S8773 CHAPTER AMENDMENT - Enacts the monarch preservation plan requiring the department of environmental conservation to take feasible actions to conserve monarch butterflies and the unique habitats they depend upon for successful migration. Amends the underlying chapter by refining the agency's role regarding alternative pest management practices and clarifying when agricultural land is subject to the underlying chapter. AYE
S8785 CHAPTER AMENDMENT - Requires the department of veterans' services to provide information on the department's website on volunteer opportunities available to veterans. Amends the underlying chapter by clarifying that the Department of Veterans' Services will provide information on volunteer opportunities, and, where the opportunities include volunteer fire departments and emergency services providers, the Department will consult with applicable agencies to identify the most effective ways to provide information on those volunteer opportunities. AYE
