The following bills were approved in the NYS Senate.  Senator Gallivan's vote is noted for each bill.

S659 This bill would amend Article 71 of Environmental Conservation Law (ECL) to expand the Department of Environmental Conservation's (DEC) powers for General Civil Penalty (section 71-4003) to also include injunctive relief, revoking/suspending a permit/certificate, or deny a pending renewal application.  NAY

S3179A Decreases the permitted amount of polycyclic aromatic hydrocarbons (PAHs) allowed in coal tar pavement products from 10,000mg/kg to 1,000 mg/kg. NAY

S4424A Enacts the "anti-waiver of employment rights act" to invalidate any express or implied contractual provision waiving or otherwise limiting any employee's substantive or procedural rights, remedies, or claim. AYE

S6227 Provides that the commissioner of education may promulgate rules and regulations for a health education curriculum to include menstrual disorders, including but not limited to, endometriosis. AYE

S1461 This bill amends the administrative code of the City of New York to extend the answer time when a major capital improvement rent increase has been filed to ninety days. Additionally, it requires that applications for major capital improvement rent increases include copies of all required building permits associated with the project. NAY (Limit investment in rental properties)

S3406 Amends section 382 of the executive law as it relates to increasing the penalties for building code violations when the condition is deemed an imminent threat to the safety and welfare of the building's occupants by the local government. NAY (Onerous penalty structure. Local Governments already authorized to issue fines for violation of the uniform building code.)

S78 Requires colleges, universities, professional, proprietary and graduate schools to provide written notice to all students of the institution's tuition liability policy. AYE

S6273A  Authorizes and directs the commissioner of education to conduct a study on the number of children who are caregivers and how being a caregiver impacts their education. AYE

S2611 The bill permits participation in bingo games by minors (under 18 years of age) who are accompanied by an adult. AYE

S1130 This bill prohibits housing providers from refusing to rent to or impose differential terms on individuals receiving rental supplements from public, private, or non-profit assistance that will be paid directly to the housing provider. NAY (Should be up to property owner.)

S2447 This bill would add a new section to the Executive Law that states "Notwithstanding any federal or local statute to the contrary, a person or persons bringing intentional discrimination or retaliation claims under this article shall be required to prove that an unlawful motivation was a motivating factor and not "the sole motivating factor" or a "but-for cause" of the challenged treatment." AYE

S3261 "This bill would authorize the distributors of cannabis products to elect to file returns annually instead of quarterly." AYE

S6181 This bill would amend the Cannabis Law to clarify that employment at any licensee under the Cannabis Law satisfies employment requirements for parole, probation or other state supervision unless the terms and conditions of said parole, probation, or state supervision explicitly prohibit such employment. NAY (Taxes decision away from parole officer.)

S487 COSPONSOR Designates August thirty-first of each year as a day of commemoration to be known as "Overdose Awareness Day." AYE

S3574 Requires each county assessing authority to send a second notice and a second copy of the application for SCHE to those previously granted an exemption on the latest completed assessment roll thirty days prior to the taxable status date when the assessing authority has not already received a completed application. AYE

S5003A Rededicates the Franklin Delano Roosevelt Mid-Hudson bridge to Franklin and Eleanor Roosevelt. AYE

S4408 Amends environmental conservation law to allow the department of environmental conservation to enter into leases or easements for the purpose of aiding in the siting and connectivity of renewable energy installations, as well as the transmission and distribution of electricity from those installations on state forest lands classified as reforestation lands. Such action is not permitted to interfere with reforestation areas. NAY (Potential loss of reforestation areas.)

S378 Directs the education department and OCFS to prepare posters and pamphlets with information regarding higher education funding opportunities for foster youth. AYE

S5392 Allows for foreign not-for-profit corporations to obtain a certificate of authority to engage in engineering for conservation efforts associated with wetlands - both tidal and freshwater. AYE

S1424 Prohibits discrimination of students on school property or at a school function based on religious attire, clothing or facial hair. AYE

S6274 To include veterans with service-related disabilities among those who receive preferences in the Affordable Home Ownership Development Program. AYE

S315 Establishes a temporary New York craft beverage permit for all New York state manufactured liquor, spirits, wine, beer, cider and mead for events located in a municipality with a population of less than one million. AYE

S5277 This bill would expand who can hold membership in an adult-use cannabis cooperative license by removing the requirement that a licensed be a natural person. AYE

S4467 The bill would amend the Workers' Compensation Law section 25 (9) to provide for the enrollment of a surviving spouse, a surviving domestic partner, a dependent child or children, or any other person entitled to a death benefit in direct deposit for compensation payments. AYE

S4473 Clarifies that the statutory damages available for certain wage violations are not punitive in nature and are designed to be liquidated damages rather than penalties or to compensate workers for the employer's failure to prevent wage theft and for the harm to employees that results from such failure. NAY (Overly punitive if administrative error.)
