The following bills were approved in the NYS Senate.  Senator Gallivan's vote is noted for each bill.

S3590A This bill creates the Climate Resilient New York Act. This would establish the Office of Climate Resiliency. The office would be charged with coordinating the resilience task force and providing strategic direction for climate resilience initiatives. A PRINT - Updates title to reflect 2026. AYE

S5852 Requires insurance reimbursement for the total direct and indirect practice expenses associated with vaccinations. Would apply to all types of private and individual health insurers, reimbursing any primary care practice, including independent physicians, hospital systems, FQHCs, etc. NAY (Expense to the state and enormous mandate on health plans.)

S8334A Requires insurance reimbursement for vaccination for severe acute respiratory syndrome coronavirus 2. Also requires Medicaid to cover the cost of pharmacist provided COVID-19 vaccination. A PRINT - Adds language allowing the Commissioner of DOH to base determinations of Covid vaccine coverage requirements in the Medicaid program on recommendations of any number of listed "scientific authorities" which includes American Academy of Pediatrics, etc. NAY (Arbitrary new language.)

S8853 This legislation makes corresponding amendments to applicable sections of the Public Health Law and Social Services law (Medicaid) to specify that when promulgating regulations establishing immunization requirements/schedules generally, the NYS DOH should utilize “generally accepted medical standards and based on recommendations of the American Academy of Pediatrics, the American Academy of Family Physicians, the American College of Obstetricians and Gynecologists, the American College of Physicians, the Advisory Committee on Immunization Practices, or other similarly nationally or internationally recognized scientific organizations”. NAY (Arbitrary new language.)

S610A This bill allows for not-for-profit schools to have an expedited approval process for new curriculum or programs of study, provided that they do not require a master plan amendment or lead to professional licensure. AYE

S5340B Allows medical assistants to administer vaccines while under appropriate supervision of a physician, nurse practitioner or physician assistant. NAY (Arbitrary new language.)

S5706A  Authorizes certain nursing students to administer certain vaccines pursuant to patient specific orders or nonpatient specific orders; authorizes physicians and certified nurse practitioners to prescribe and order a patient specific order or non-patient specific order to a nursing student to administer certain vaccines. NAY (Arbitrary new language.)

S7025B COSPONSOR Authorizes registered pharmacy technicians to administer the same immunizations as licensed pharmacists under direct supervision of such licensed pharmacist.  AYE

S8496C Relates to the establishment of regulations for administering immunizations taking into consideration the recommendations of the American Academy of Pediatrics, the American Academy of Family Physicians, the American College of Obstetricians and Gynecologists, the American College of Physicians, the advisory committee on immunization practices, any interstate body established for purposes of reviewing and making recommendations regarding immunization coverage and access, or other similar nationally or internationally recognized scientific organizations. NAY (Arbitrary new language.)

S3071A This bill would create a task force on school transportation safety. It would have 18 total members. It would be responsible for studying and making recommendations on existing state laws and regulations and developing a plan to implement additional school bus and pedestrian safety measures. AYE

S3189 Requires the office of temporary and disability assistance to make publicly available on its website information regarding waivers, rental supplement plans and shelter supplement plans. AYE

S2613 Requires the state to keep state lottery winners' identities anonymous to the general public unless the lottery winner gives their consent. AYE

S490 Amends the crime of course of sexual conduct against a child in the 1st degree and 2nd degree to include the element of at least one additional act of sexual conduct with the child when that child is less than 17 years of age (current statute applies only to a child less than 11 years old or 13 years old). Also amends the crime of predatory sexual assault against a child to include the crime of a course of sexual conduct against a child in the 1st degree when the person was 18 years old or more and the victim was less than 13 years of age. AYE

S6217 Amends the Workers' Compensation Law by raising the limit for treatment costing less than $1,000 to $1,500 to be done without prior approval and clarifying that the list of pre-authorized procedures shall be issued and maintained solely for the purpose of expediting authorization of treatment of injured workers and not be used as a basis for denying treatment not contained therein. AYE

S8830 CHAPTER AMENDMENT - The bill seeks to ensure that victims of economic abuse are not held liable for coerced debt by allowing the alleged victim of coerced debt to bring an action against a creditor to establish that the debt in question was coerced.  AYE (Amendments address prior problems with bill.)

S3569 Allows prospective tenants of rent controlled or rent stabilized housing accommodations to request the complete rent history of such housing accommodations. NAY (Redundant and unnecessary given that these are already rent controlled apartments.)

S3665 Amends the real property tax law to make buildings and structures used for the on-farm processing and retail sale of crops produced on-farm eligible for the state farm building tax exemption. AYE

S1783B Prohibits the misrepresentation or collection of certain fees related to the delivery, usage, and storage of liquified petroleum. A seller could provide a rebate to a consumer equal to the price paid by that consumer for liquified petroleum gas that is removed from a liquified petroleum gas tank by the seller and resold. B PRINT - Makes minor technical changes. NAY (Bill language confusing and could lead to hidden costs for consumers.)

S2261 COSPONSOR Provides that family members of paid professional firefighters who died in the line-of-duty may obtain a "Survivor of the Bravest" license plate; provides for the annual service charge collected to be deposited into the department of motor vehicles distinctive license plate development fund. AYE

S678A Provides that where the total number of commercial food fish license, commercial crab permits, commercial whelk and conch licenses, and marine and coastal district party and charter boat license applications from persons who were not issued such license in the previous year exceeds the number of licenses that are available, the department of environmental conservation shall randomly select recipients of the available licenses from among those applications received by the first business day of the applicable license year; provides for a temporary authorization where in the event of a temporary emergency, a licensee or permittee may provide written authorization for a person to temporarily undertake any licensed activities on the licensee's or permittee's behalf; makes related provisions. AYE

S115A This bill would increase access to resources for culturally diverse arts and culture organizations that advocate for diversity, equity and inclusion, racial and social justice, and cultural preservation. NAY (Not necessary.)

S5041 Amends executive law to define a victim of sexual offense as including any victim of any act constituting an offense of unlawful dissemination or publication of an intimate image or threats to commit such an offense.  AYE (Delegation in the affirmative.)

S29 This bill requires coroners, pathologists, medical examiners, or other persons qualified to conduct examination of a deceased persons to report to the Department of Health if the person was afflicted with Lyme or other tick-borne diseases, as determined by the commissioner or such corners, pathologists, medical examiners, or other persons qualified. AYE

S51 This bill would amend the vehicle and traffic law section 311 to authorize insurance coverage by a risk retention group (RRG) to include coverage to commuter vans, pre-arranged for-hire vehicles and accessible vehicles. AYE

S1225 This legislation revises the procedures of the Medicaid Evidence Based Benefit Review Advisory Committee, in relation to material changes in the coverage status of a particular item, health technology or service, as well as any matter relative to new health technology assessment or medical evidence for which an applicant has submitted a complete application to the Department. AYE

S2555 Ensures that when land is disposed of by public authorities, the names of all beneficial owners of the property shall be disclosed via an explanatory statement that will be publicly available. AYE

S1285A  Purpose is to amend the criminal procedure law, in relation to jury deliberations. Allows the court to provide the jury with written instructions of any elements of offense or of any defense, when requested by the jury and by what the court deems proper.  AYE

S2292B Enacts the whale awareness act directing the department of environmental conservation to establish recommendations and educational materials for reduction of marine mammal interactions. Requires the recommendations and educational materials developed to be distributed to individuals registering vessels in New York State and amends the Navigation Law to include information about federal prohibitions on marine mammal harassment as part of the state's boating safety education program. AYE

S1305A Requires that general hospitals that provide mastectomy surgery, lymph node dissection or lumpectomy provide information to such patients concerning options for breast reconstruction. AYE

S933 Establishes the position of chief artificial intelligence officer and such person's functions, powers and duties; including, but not limited to, developing statewide artificial intelligence policies and governance, coordinating the activities of any and all state departments, boards, commissions, agencies and authorities performing any functions using artificial intelligence tools; makes related provisions. AYE
