The following bills were approved in the NYS Senate.  Senator Gallivan's vote is noted for each bill.

S4369 Would provide a new Title within Article 9 of Environmental Conservation Law to create a Memorial Lands Facility permit, which is a property, other than a cemetery, that is primarily used for the respectful disposition of cremated remains.  AYE

S4995 Directs DEC to designate a representative for each environmental conservation region of the state to serve as the point of contact for municipalities to aid in the acquisition of resources and funding for water projects. AYE

S349 Relates to expanding the definition of agency; includes entities created by an agency or that are governed by a board of directors or similar body a majority of which is designated by one or more state or local government officials in the definition of agency under the public officers law. AYE

S2271 Prohibits an employer, licensing agency or employment agency from requesting or requiring that a prospective employee disclose his or her age, date of birth or date of graduation from an educational institution on an initial employment application or during an interview, except in the case of a bona fide occupational qualification or need. NAY

S2304 This bill would add a new section 54-b of the legislative law to create a new standing committee on conference to resolve differences between similar, but not identical, bills and resolutions which have passed the senate and assembly. NAY (Unnecessary. Rules already provide for this.)

S6283 Adds a non-voting member from the division of service-disabled veterans' business development to the state cannabis advisory board. AYE

S2329 Requires review of all motor vehicle repair shop applicants which includes community input; establishes a list of factors that shall be considered when making such decisions. NAY (Procedures already in place.)

S205 COSPONSOR Establishes that when an actor threatens to disseminate or publish a still or video image depicting such other person with one or more intimate parts exposed or engaging in sexual conduct with another person, including a still or video image created or altered by digitization, where such person may reasonably be identified from the still or video image itself or from information displayed in connection with the still or video image within the provisions of unlawful dissemination or publication of an intimate image. AYE

S4478 Requires the department of labor to provide a document on workplace rights to any minor seeking working papers and to make such document available in other languages and to school officials who issue working papers. AYE

S1855 Requires that the State Board for Professional Medical Conduct to adopt a zero-tolerance policy for sexual misconduct and the office of professional medical conduct must publish the policy and make available on its website. AYE

S1615 This legislation provides that dependent persons under the age of eighteen shall not be listed in eviction petitions or warrants, and that the records pertaining to the eviction proceeding of a person under the age of eighteen shall be sealed. This bill also has provisions that seal records pertaining to children who have been named in eviction warrants. NAY

S5257B Requires mandatory background checks for persons employed by or volunteering at any business, organization, or entity that regularly provides instructional, recreational or extracurricular services to minors, including but not limited to dance studios, gymnastic schools, martial arts academies, sports training facilities, music schools and performing arts schools, tutoring and academic enrichment centers; provides for enforcement and penalties; prohibits certain people from owning such businesses. AYE

S3277 Establishes a process for designating transfer-on death beneficiaries for farming implements involving filing a document with the commissioner of agriculture and markets. AYE

S934A Requires the owner, licensee or operator of a generative artificial intelligence system to conspicuously display a notice on the system's user interface that is reasonably calculated to consistently apprise the user that the outputs of the generative artificial intelligence system may be inaccurate. AYE 

S2598A Expands the training time for local municipalities in relation to the open meetings law; requires at least one hour of such training be provided by the committee on open government or an appropriate entity in relation to compliance with the open meetings law and if not provided, a justification shall be given.  AYE

S4692 Requires that free menstrual products be provided in the commonly used bathrooms of private universities. NAY (Unfunded mandate. Cost to private colleges unknown.)

S4470A Amends Executive Law ยง 840(4)(d)(2) to add to the model law enforcement code to provide guidelines for the best practices regarding the discharge of a firearm at a moving vehicle. AYE

S627 Amends education law to prohibit Gubernatorial or Mayoral appointees from serving as trustees to the State or City University system. Restricts paid employees serving at the pleasure of the Governor, in the cases of the SUNY and CUNY boards, and/or the Mayor, in the case of the CUNY Board, from serving as a trustee. AYE

S516A Requires motor vehicle repair shops to disclose whether parts supplied are under warranty and the estimate for all parts and labor; provides that no work can be done without the consent of the customer; provides for fines for violations of such provisions. AYE

S3249 Authorizes driving schools to offer a driver education course approved by the Commissioner.  AYE

S2491 This bill prohibits a party in a criminal case from exercising a peremptory challenge to a prospective juror on the basis of such juror's race, color, national origin, ancestry, gender, gender identity, religion, religious practice, age, disability, or sexual orientation. NAY (Could lead to dismissal even with no purposeful discrimination.)

S2236A This bill would amend the Labor Law to expand the definition of wages in the context of wage theft to include payment of wages to include compensation that is not payable solely at the employer's discretion, such as bonuses. requires certain notices; expands enforcement provisions. AYE

S2278A Requires hospitals to have a registered professional nurse as a sitting and voting member of the governing entity responsible for developing a hospital's strategic plan, structure, systems, policies and programs. NAY (Imposition on private business.)

S2400 Requires the NYS DOH to establish a blood clot and pulmonary embolism policy workgroup. Such workgroup will consist of health care providers, patients, family members of patients who have died from blood clots, advocates and other interested parties and associations. AYE

S3078 Requires that companies that suffer a data breach provide free credit monitoring services to effected persons for up to one year following the breach. AYE

S6734A Provides that elections to fill an increased number of seats on a school board will be conducted at the first annual meeting after the meeting during which number of seats was increased. AYE

S374 This bill amends the Lobbying Act to expand the provisions of the act so that acts to influence nominations or confirmations are viewed as lobbying under the act, and thus are subject to reporting requirements of the act. NAY (Overly cumbersome. Retroactive. Democratic process should allow people to speak up for/against.)

S5105 Directs the commissioner of the office of addiction services and supports to promulgate rules and regulations for providers operating in rural locations while taking into account the extra challenges encountered by such providers, including but not limited to, increased and additional expenses. AYE

S8741 Establishes the interagency elder justice task force consisting of representatives of state agencies whose work involves elder justice to create greater collaboration and develop overarching strategies, systems, and programs with a goal of protecting older adults from abuse and mistreatment.  AYE

S7202A Repeals the Unlawful Dissemination or Publication of an Intimate Image statute, and replace with new offenses of Unlawful Dissemination or Publication of an Intimate Image in the 1st (class D felony), 2nd (class E felony) and 3rd degree (class A misdemeanor). AYE

S1148 Provides voting membership to existing non-voting rider representatives on the MTA Board, provides for enhanced representation of MTA riders with disabilities. AYE

S4925 Requires training to reduce abusive conduct and bullying in the workplace as part of a written workplace violence prevention program. AYE

S1535 Authorizes the PSC to provide a penalty in the event a combination utility company is determined to have failed to reasonably comply with provisions of the Public Service Law, an order or regulation which protects the overall reliability and continuity of combination utility company services including but not limited to restoring service or otherwise meeting the requirements of an emergency service plan following a major outage event or emergency. AYE

S1050 This bill would require DOCCS to notify an inmate's next of kin or personal representative by electronic means immediately prior to transferring the inmate and would allow the inmate to make at least one personal telephone call, free of charge, immediately prior to an inmate's transfer, except under exceptional circumstances when allowing so would create an unacceptable risk to the safety of inmates or staff. NAY (Could pose safety risk for staff and incarcerated persons.)

S6318A COSPONSOR Requires instruction in arts and music education to be incorporated into curriculums for all public school students; requires school districts to ensure that appropriately certified teachers are providing such education; authorizes rules and regulations consistent with such provisions. AYE

S417 This bill redefines the "margin of victory" when recanvassing (recount) votes. Currently, it is the "margin between all votes cast in the entire contest." NAY (No useful purpose.)

S569 Authorizes county boards of elections to establish county-wide polling places. NAY (Potential to limit voter access. Difficult implementation.)

S7962 GONZALEZ Sets the timeline for candidate declination from ten days to seven days. AYE

S2051 Relates to allowing bed and breakfasts to sell cider, liquor, beer and wine on the licensed premises. Also eliminates the requirement that patron must be an overnight guest in order for a bed and breakfast to sell them an alcoholic beverage. AYE

S7332 Relates to the provision of regulatory information to small businesses through the establishment of a small business regulatory nexus by certain agencies. AYE
