4 President, just to explain my vote briefly.
5 I am certainly not opposed to
6 singing the National Anthem at any graduation.
7 It's just that I am not -- I have never been to
8 a graduation where the National Anthem is not
9 sung and, in fact, there are basically two or
10 three national anthems that are sung at
11 graduations, always the National Anthem of our
12 United States and sometimes the negro national
13 anthem, sometimes the national anthem of Puerto
14 Rico, sometimes other national anthems depending
15 on who the majority of the people are in the
16 audience and who are there participating and in
17 whose honor the event is being held and who are
18 graduating.
19 So Senator, I must -- I must
20 clarify my vote. It is not because I am against
21 the singing of this song that celebrates all of
22 our -- our collective American experience, but
23 it is because I'm opposed to using it as a test

1 of any one of our -- our commitment to the
2 ideals of this United States. We all are, and I
3 think that this is totally unnecessary, but I do
4 support in no uncertain terms the singing of the
5 National Anthem as we do at each one of our
6 sessions here and as I've heard at every single
7 graduation that I've been to in my life.

9 SENATOR LEVY: Mr. President,
10 last night we discussed this issue and the CHPS
11 issue and Senator Jones rightfully asked, is
12 there a message on 8512? We don't have an
13 answer on that, but we've got to do this bill as
14 it relates to the Transit Authority; but I have
15 to say that I am very upset and concerned, and I
16 think every member of this chamber should be
17 because the MTA and the second floor represented
18 not only to us but to the Assembly that this
19 bill had to be done before midnight last night
20 or the Transit Authority would not be able to
21 meet its payroll, and here we are at 6:15 on the
22 next day notwithstanding -- notwithstanding the
23 representations were made -- that were made that

1 a payroll couldn't be met in the amount of this
2 bill, and here is this bill today to fulfill the
3 purpose, the "drop dead" date that we had last
4 night, and certainly there had to be a mis
5 representation not only to leadership but to
6 members. Otherwise we would not have been doing
7 that bill last night, and I want to serve notice
8 that I am going -- I, on behalf of every member
9 of this chamber, am going to find out who made
10 the representations that came from the MTA and
11 who made the representations that came from the
12 second floor, particularly as it relates to the
13 Transit Authority and the MTA, and Senator
14 Galiber and I talked about it last night.
15 This is just a consistent pattern
16 that comes from that Authority, and that
17 consistent pattern is that we have ongoing false
18 misrepresentations as it relates to financial
19 needs. They don't play by the same rules and
20 regulations and laws that everybody else plays
21 by. They make representations to us and change
22 the facts to bend the conclusion that they seek
23 and I think that collectively we've got a

1 responsibility to find out how did we get these
2 representations last night that they were going
3 to have $4 million plus in costs if we didn't
4 pass a bill to permit them rightfully to meet
5 their payroll, but wrongfully on the
6 representations that are made, and you can be
7 assured of that, of the fact that on all of our
8 behalf, I am going to seek that answer from
9 Stangl and from Kiepper as well as from the
10 second floor.
