18 SENATOR MALTESE: Mr. President,
19 I have the honor today to recognize a team
20 that has achieved a great many victories. But
21 more important than that, they have brought
22 distinction and honor to a great Catholic high
23 school in Queens County and Middle Village,
24 Christ the King Regional High School.
25 While I have had the honor of

1 serving my constituents for 18 years, I have
2 had the honor of being chairman of Christ the
3 King Regional High School, and before it
4 became a regional high school, for almost
5 30 years. In those 30 years, we've had great
6 teams, boys and girls, in all sports. We now
7 have one of the greatest of the teams. That
8 team is our girls basketball team.
9 All the members of this august body
10 have joined in cosponsoring the resolution
11 that we are discussing now.
12 The team, in addition to finishing
13 the season undefeated, it won its 17th
14 consecutive state title and city title. In
15 addition, by winning the New York State
16 Federation Class AA Tournament, the Christ the
17 King Regional High School Girls Basketball
18 Team finished on top of USA Today's Super 25
19 for the fifth time in the 23 years of the
20 ratings, and of course that led to its being
21 recognized as the number-one team in the
22 nation by USA Today.
23 In addition, the girls basketball
24 team has now won 57 consecutive games --
25 that's 57 consecutive games -- and finished

1 number one in the nation in 1990, '93, '98 and
2 2005.
3 Whereas, the success of the team is
4 due in great part to the efforts of Coach Bob
5 Mackey, the assistant coaches, Jill Cook and
6 Maureen McHugh, in addition assisted by our
7 representative, our trustees liaison, Bob
8 Normandia, and the executive secretary,
9 Dolores St. Louis.
10 The loyalty and enthusiasm
11 exhibited by the school I think is reflected
12 in the great playing of the girls, assisted
13 and led by their coach and assistant coaches.
14 It is resolved by this legislative
15 resolution that this legislative body pause in
16 its deliberations to congratulate the Christ
17 the King Regional High School Girls Basketball
18 Team and its members, Lorin Dixon, Jael Pena,
19 Nicole Caldera, Aimee Levine, Demi Quintana,
20 Michelle Gatti, Shannon Walsh, Melissa
21 Wysocki, Kera Streat, Sky Lindsay, Tina
22 Charles -- I'll pause at this moment to say
23 she has been ranked by USA Today the
24 number-one player in the country, and
25 well-liked and respected by her teammates and

3 We have another school visiting us
4 today. It happens to be a school from Senator
5 Bruno's district. We have with us the three
6 second grades from the Bell Top Elementary
7 School, part of the East Greenbush School
8 District that is within Rensselaer County.
9 With us today are Mrs. Wilkes's class,
10 Mrs. Warren's class, and Mrs. Smart's class.
11 So we have all of the second-graders from Bell
12 Top Elementary here.
13 I also happen to have one young
14 second-grader here with me at my desk. This
15 is Conner Wright, familiar to some of you in
16 this chamber as he's grown up over the years.
17 And he is grooming to be the successor to
18 Senator Bruno.

16 SENATOR BRUNO: Mr. President,
17 colleagues, we together in this house, with
18 the Assembly, passed the budget. The budget
19 was on time, it was a responsible budget, it
20 met -- as we perceived it, with 211 or 212
21 legislators, it met the needs of the people of
22 this state, in records for education,
23 educating our young people, the greatest asset
24 that we have in this state, in healthcare
25 restorations -- quality healthcare, critically

1 important to everybody here in this state --
2 and, hugely, tax relief.
3 Because, even though we have set
4 previous records in tax cuts, with the
5 leadership of Governor Pataki and both houses,
6 we are still the highest-taxed people in the
7 United States per capita. We have overworked,
8 overburdened, overtaxed taxpayers in this
9 state.
10 With the good government, we have
11 had a surplus this year. We feel that it's
12 appropriate and we reflected in the budget a
13 property tax cut that over two years gets
14 close to 1 billion, 600 million. We have a
15 child credit that is 400 to 600 million. We
16 have denied fees that approach a half a
17 billion dollars that were submitted.
18 So we're talking about the
19 neighborhood of $3 billion, with the action
20 that we took, stays with the overtaxed people
21 of this state. We think this was responsible,
22 we think it's responsive, we think it's
23 critical that this budget becomes law.
24 Now, we have been deliberating with
25 the Executive. Based on the court decision

1 that took place three years ago -- that, by
2 the way, was a 4-3 decision. It didn't
3 declare, you know, any decisive mandate, any
4 decisive winner. It basically said in certain
5 areas the Legislature cannot change the
6 language as submitted by the Executive. In
7 certain areas.
8 Now, that has been a challenge for
9 us to get a budget done as we would perceive
10 the legality of what we're doing. Now, our
11 counsels indicate to us, the Assembly counsels
12 have indicated to us that what we did was
13 legal, constitutionally legal. We then,
14 dealing with the Executive, did a cleanup
15 bill. The cleanup bill was intended to do
16 just that, to try and meet some of the
17 contention from the Executive to make things
18 legal constitutionally. We didn't think it
19 was necessary. We did it anyway. The
20 Governor vetoed that bill.
21 We are certain that the Governor
22 went above and beyond any authority the courts
23 ever intended. Above and beyond. Now, we
24 have learned counsels here who serve in the
25 Senate. We have people who serve in both

1 houses; I don't know how many of them. But
2 they all can't be wrong. They believe that
3 the Executive has gone way beyond what the
4 courts ever intended.
5 Now, that calls for clarity. And
6 that calls for litigating whether the
7 Legislature in this state, all 212 elected
8 officials, have any rights on behalf of the
9 people in the budget process.
10 Now, we have tried for weeks to get
11 this resolved with the Executive. And as of
12 the moment, we have failed. The Executive,
13 with their Budget Division, has been dug in in
14 certain areas, that it's their way and very
15 little compromise. And we, we -- I can share
16 with you now -- we could get very close to
17 where the Executive is. The Assembly can't.
18 At least that's the perception.
19 And when you stand up under these
20 circumstances and say anything, you
21 potentially alienate somebody, some group.
22 And I don't mean to do that. But I'm trying
23 to create some clarity because there appears
24 to be some confusion as to where we are.
25 We have been consistent. We are

1 going to get relief for the taxpayers of this
2 state. We're going to do that. And we are
3 going to get a result, through this budget,
4 for the taxpayers of this state. They deserve
5 it. It's their money and no one else's that
6 created this $4 billion-plus surplus.
7 So having said that, while we've
8 been negotiating, we don't have an agreement.
9 If we could have negotiated an agreement, the
10 Governor's office would have resubmitted,
11 there wouldn't be any litigation or potential
12 litigation because we'd be three ways
13 together: Assembly, Senate, and Executive.
14 We are not there.
15 Secondly, we have the prerogative
16 of overriding. The Assembly overrode what
17 they passed first. It rests with the Senate
18 to override what we passed first and what they
19 send over. And we will send over what we pass
20 here first.
21 The third part of this is
22 potentially to litigate our differences. The
23 problem with litigating is it takes a while to
24 go through the courts. Can't do it in a week
25 or a month. It will take, potentially, years.

1 Meaning what? It means that a benefit that we
2 need the people of this state to have, many of
3 them will not have. And that will be tragic.
4 That will be unfortunate.
5 So that's where we are. We're
6 starting the process of overriding. I've been
7 on with the Governor this morning. We're
8 going to continue to talk to the Governor.
9 We're talking to the other leaders this
10 morning, last night, the day before, on
11 Sunday.
12 And I am going to continue to talk
13 as we go through this process. Because it
14 would be a lot better if we could get the
15 Assembly, with us, to come a compromise with
16 the Executive and not head into a process that
17 is going to end up in the courts on some parts
18 of this budget. And those parts are property
19 tax rebates, healthcare that we have restored,
20 some of the other economic development
21 dollars, specifically. And that's very, very
22 troublesome.
23 So we're starting this process
24 because presently I don't think we have an
25 alternative. Because I have no certainty that

1 if we don't start now -- if we wait till
2 Monday, if we wait till May, if we wait till
3 June -- that we're going to be in any
4 different place than we are right now. So it
5 just seems, on behalf of the people of this
6 state, prudent to continue to this process of
7 governing.
8 And the process of governing in
9 this state is the Governor prepares a budget,
10 which he did, by January 17th; he submits it
11 to the Legislature. By their own testimony
12 before the courts, it is then up to the
13 Legislature to return that budget, which we
14 have done.
15 It's the prerogative of the
16 Executive to accept or veto, which they have
17 done. It is the prerogative,
18 constitutionally, of the Legislature to have
19 the last word on behalf of the 18.6 million
20 people in this state on what happens to the
21 money that we collect in taxes and fees.
22 The constitution says the
23 Legislature is supposed to have the last word.
24 And this should be the last word. There's 212
25 legislators involved in this process, the most

1 open public process that anyone has ever
2 experienced in getting a budget done.
3 And it would be comforting to think
4 that the people will be the beneficiaries and
5 we won't end up in the courts. But that's
6 going to be the Executive's decision.
7 As we speak, we are going to
8 continue to talk to the Executive, continue to
9 talk to the Assembly, to see if we can
10 reconcile whatever differences that we have to
11 get to a comfort and comfortable place. I
12 don't know what that outcome will be, but we
13 feel compelled to continue the process as it's
14 constitutionally laid out on behalf of the
15 people of this state.
16 I have a feeling that Senator
17 Paterson has something to say before we call
18 up this first bill.

23 SENATOR PATERSON: Since I was
24 asked, Mr. President, Senator Bruno just
25 affirmed that this would be the most open and

1 public process that anyone has experienced in
2 any historical period in the Legislature. We
3 in the Senate Minority are happy to have
4 participated and helped Senator Bruno so he
5 can actually say that. Because he couldn't
6 have said it a few days ago.
7 But in December of 2004, the
8 New York State Court of Appeals issued a
9 decision relating to the budget process, to
10 the language of the budget process and the
11 respective powers of the executive branch and
12 the legislative branch, by a vote of four to
13 three. The three justices that dissented, in
14 my opinion -- and it's just my reading of the
15 court decision -- did not as much disagree
16 with the finding but disagreed with the volume
17 in which the powers should be distributed and
18 the priority in which they should be
19 distributed.
20 This has made the legislative
21 process a little more difficult and the items
22 in the process a little harder to negotiate.
23 But nonetheless, we've gone forward this year
24 in a process.

1 two weeks, has vetoed 212 of the legislative
2 bills that were in the budget that was voted
3 on, on time, at the end of March. However, he
4 is citing the constitutionality of the
5 language for his veto and, moreover, has
6 stated that he does not, on constitutional
7 grounds, want to take any action even if this
8 budget is overridden, preempting, in many
9 respects, the legislative duty and rights.
10 And as Senator Bruno just defined,
11 this seems to be outside of the court ruling
12 even of 2004. He cites the ruling in a
13 different case involving the mayor of the City
14 of New York as precedent, where a fair perusal
15 of the facts would show an extreme difference
16 between the facts in the case involving Mayor
17 Bloomberg and the case at hand. And
18 therefore, on constitutional grounds, we
19 submit that the overrides are proper and that
20 there cannot be any preemption at this point
21 by the Governor.
22 And so we go forward in this
23 process with a budget that was negotiated, and
24 a budget that four different conferences came
25 together and had 10 conference committees that

1 interacted in the process, and feel that this
2 is the best course for the state to take.
3 This conference has stood for
4 reform. Senator Bruno said that this is the
5 most open and public process that we've
6 experienced. We want to make sure that we can
7 stand back at some point in the future and
8 guarantee the public that that is the case.
9 In the last few days, we have made
10 the argument that the discretionary money, the
11 member items and other resources that we
12 distribute to the public, have to be open and
13 have to be available. They have to be listed
14 and they have to be accessible. And we stand
15 on that principle.
16 Those who have a cynical view of
17 government wanted to know what it is we wanted
18 in the process, what we were negotiating for
19 ourselves, why the Senate Democrats are
20 holding up the process for some type of
21 special compensation that we think we should
22 receive.
23 I'm sad that they feel that way,
24 and I'm sorry that they have no conscience.
25 They think everybody else is just like them.

1 They think in terms of what can be received
2 personally. They think of the panoply of
3 wealth and the arrogance of power. They don't
4 think about the public.
5 We are thinking about the public.
6 And this is why we stood on those grounds.
7 Any negotiations that I have with the Majority
8 Leader based on our share in discretionary
9 money had already been held and have pretty
10 much been arrived upon. This was an argument
11 beyond that. This was an argument about what
12 really is the integrity in government, just in
13 case there's anyone out there that can hear me
14 that still worries about it.
15 The reality is that there is a
16 rising fear about the process in Albany, there
17 is a continuing climate of distrust of
18 government and public servants. And as I look
19 around the room at my colleagues, I don't see
20 that. I see a number of hardworking people
21 who put in long hours, who represent districts
22 all over this state, who believe in things and
23 come here and often fight long into the
24 evening and past the process to try to
25 persuade their colleagues of the nature of

1 their argument.
2 And unfortunately, it is
3 misunderstood in the past couple of decades.
4 Unfortunately, late budgets, rising inflation,
5 increased property taxes, and certainly a
6 challenged educational system has in many
7 respects caused the public to become
8 dispirited and confused about what our role is
9 and what we are trying to do as public
10 servants in government.
11 What we asked and what we have
12 received, thanks to my conversations with the
13 Majority Leader and the Speaker --
14 conversations on which I will elaborate
15 further at another time -- is an understanding
16 that when money leaves the door at any point
17 there will be disclosure within 30 days of any
18 distribution of any contracts to agencies that
19 would relieve -- vouchers that would
20 inevitably go to not-for-profit or other
21 organizations that serve the public.
22 This is an open process that as of
23 today, and we hope going forward, will become
24 a new process. It is the commitment of the
25 leadership of the legislative conferences that

1 we will now have an openness about the items
2 for which the -- that are paid for by taxpayer
3 dollars.
4 This is the only way we can
5 operate. This is the public's money. I
6 actually heard one of my colleagues comment on
7 a television station about eight years ago
8 that the public doesn't need to know about
9 these things. That is the type of attitude
10 that we are curtailing as of today.
11 The public is going to know. It's
12 the public's money. And frankly, my advice to
13 public servants is the best way to view the
14 public is to think that each taxpayer is a
15 genius, because you are holding resources that
16 they worked hard for.
17 And so I would like to thank,
18 though he's not in the chamber, the Speaker of
19 Assembly and the Majority Leader for their
20 cooperation in this particular process of
21 trying to bring transparency to government,
22 which I think, as Judge Oliver Wendell Holmes
23 once said, is the best disinfectant, the
24 sunlight on a situation.
25 And although some are having

1 trouble adjusting to this process, that's what
2 wrong with the process in the first place,
3 that it has allowed individuals to become
4 cynical, to disbelieve, to misunderstand, to
5 become parochial, to become pedestrian, to
6 become antithetical to a process that was set
7 up where we represent people here in the
8 Legislature rather than thwart them.
9 And I think that it often is
10 difficult to try to make this point. It is
11 often intimidating to try to change a process
12 such as this. But we are committed to
13 actually changing it.
14 The discussion or the beliefs or
15 the wonderment of why individuals would go
16 forward to try and fix a system that has been
17 dysfunctional for two decades often diminishes
18 into personal and in many respects rather
19 cynical views of why it's being done. But we
20 here in the Senate Democratic conference, I
21 think along with our colleagues in the
22 Republican conference, want to assure the
23 public that we hear the concerns, we
24 understand the mistrust. We certainly are
25 going to try to improve upon a system for

1 which there is no greater.
2 Our country, the greatest country
3 that's ever existed in the world, was founded
4 on the basis of individualism and integrity,
5 where people were encouraged to participate in
6 government and to be represented in a way that
7 reflects the collective view of our society.
8 And I think that there can be nothing more
9 evident of that as when you recognize where a
10 government's priorities are by how it spends
11 its money and you recognize how responsive
12 government is to the people by informing them
13 where the money is going.
14 Those are our principles. Those
15 are our beliefs. And we respectfully stand on
16 them.

3 Senator Paterson, in all the good things that
4 you have to say about governing.
5 But I want to remind my colleagues
6 that since I've been leader in this house, we
7 have had the most open Senate in the history
8 of the Senate. And I want to remind you that
9 expenditure, public expenditure review people
10 tried to do for twenty years -- we got it
11 done. So every six months, every dollar that
12 goes out of the Senate is public.
13 You see TV cameras here, you see
14 cameras -- who initiated that? We initiated
15 that here in the Senate. What could be more
16 public and open?
17 Conference committees. Who
18 initiated that? And we always line-item. We
19 had others who governed that we had to budget
20 with that preferred to do it differently.
21 So in this business, as we learn,
22 we negotiate, you compromise and you
23 legislate. If you don't compromise, you don't
24 govern. And unfortunately, that's kind of
25 what has happened here in this whole process

2 in a positive way from here.

9 28-year-old young lady who arrived at West

14 before that was an assistant coach at DePaul.
15 She was dealing with young cadets
16 between the ages of 18 and 22. She molded
17 them. She made them something special. The
18 number-one player in the league came from West
19 Point. The most improved player came from
20 West Point. And the coach of the year was
21 Maggie Dixon.
22 Maggie Dixon expressed so much
23 confidence in the cadets, and the cadets in
24 her. It's an awful shame that a 28-year-old
25 dedicated individual who had so much to offer

8 override of this bill, but not because I
9 support the Governor's position on tax and
10 revenue. But I also can't support this
11 house's position, as I couldn't when we
12 originally passed the bill.
13 This bill takes, on an annualized
14 basis in its second year, $2.5 billion out of
15 the state budget. And if we're going to take
16 that money out of the state budget, we have to
17 answer the question -- and we have not yet --
18 how would we replace that money and who are we
19 cutting these taxes for versus who will we be
20 cutting services to without this state
21 revenue.
22 So as I argued when we passed bill
23 originally and I voted against the bill
24 originally, a model of STAR property tax
25 rebates that is inequitable both based on

1 geography, whether you are a renter or a
2 homeowner, and is regressive from a tax
3 perspective based on income, is not the right
4 model of revenue changes in the state of
5 New York.
6 While there's lots of debate of
7 over what we should or shouldn't be doing in a
8 child credit, I don't support the model we
9 passed and I also don't support the Governor's
10 model, which would take $600 million out of
11 the state budget that we might argue ought to
12 be directly into our school system for the
13 children of the state, since in fact we are
14 still out of compliance with court orders

16 There are good pieces of this bill,
17 as I talked on when we debated the bill on the
18 floor. But overall, this is not a justifiable
19 bill. So overriding the Governor's veto of it
20 I also see as not justifiable.
21 We still have done nothing to
22 address our debt crisis in this state. We are
23 still moving forward even today with approving
24 pork-barrel items where we may even borrow
25 more money without any explanation of how the

1 money will be spent. We have still not dealt
2 with the over $27 billion of tax expenditures
3 and credits exemptions and evaluating what the
4 impact is of this entire budget book on the
5 taxpayers of New York State.
6 While we would all like to reduce
7 people's taxes -- and I would argue if we were
8 fair and honest in our evaluation of our tax
9 policies in New York State, we might find that
10 we could, in fact, progressively reduce taxes
11 for those most in need in the state of
12 New York without ending up having to go into
13 even greater debt. But that is not the
14 position we are in at this point, and we have
15 failed our assignment on the rest of the
16 project of evaluating our revenue and our
17 spending and our tax expenditure budgets.
18 So I will not vote to override the
19 Governor's veto of this bill, as I could not
20 vote for this bill originally.
