2 very much, Mr. President. Who had asked for
3 the explanation?
4 ACTING PRESIDENT FLANAGAN:
5 Senator Squadron requested the explanation.
6 SENATOR FUSCHILLO: Okay.
7 Senator, the original Itinerant Vendor Bill
8 was adopted in 1995. And in dealing with --
9 when I chaired Consumer Protection for
10 10 years in the Senate, and dealing with the
11 Retail Council and law enforcement
12 authorities, they were concerned about certain
13 products that were still being sold
14 essentially on a black market, as they called
15 it, in flea markets, such as baby products and
16 other products that they feel could be
17 contaminated when they're not properly
18 refrigerated or taken care of, and there were
19 some other items there as well.
20 And as a result of dealing with law
21 enforcement and the Retail Council for a
22 number of years, this bill came out of
23 discussions with that to further protect the
24 public.
25 SENATOR SQUADRON: Thank you for

1 the explanation.
2 Will Senator Fuschillo yield for a

4 ACTING PRESIDENT FLANAGAN:
5 Senator Fuschillo, will you yield to a
6 question by Senator Squadron?
7 SENATOR FUSCHILLO: I'd be happy
8 to.
9 SENATOR SQUADRON: Senator
10 Fuschillo, first of all, I think it's an
11 admirable point, and certainly some of the
12 items in here I think do need to be regulated
13 and the law does need to be updated.
14 I would ask, though, it's a pretty
15 broad set of prohibitions, including herbal
16 products, dietary supplements, botanical
17 extracts, vitamins. For those items, what's
18 the definition of those items? Does it exist
19 elsewhere in the law, or is there another way
20 that as a Legislature we can direct to
21 understand that?
22 SENATOR FUSCHILLO: In answer to
23 your question, we got that from the Retail
24 Council many years ago as we were negotiating
25 this with the Assembly. That is in the

1 federal law, and that's how they clearly
2 define some of these languages which we're
3 going to try to adopt in state law.
4 We're not at it yet, we're not at
5 an agreement, Senator, with the Assembly. I'd
6 be happy to work with you to clarify any
7 questions you may have, or any ambiguity in
8 language here, because I think this is too
9 important for the public's concern as a
10 consumer protection issue that the Assembly
11 doesn't take this up. I'll be happy to work
12 with you in further talks and negotiations.
13 SENATOR SQUADRON: Through you,
14 Mr. President, one final question, if Senator
15 Fuschillo will yield.
16 ACTING PRESIDENT FLANAGAN:
17 Senator Fuschillo, will you continue to yield?
18 SENATOR FUSCHILLO: Yes.
19 ACTING PRESIDENT FLANAGAN:
20 Senator Squadron.
21 SENATOR SQUADRON: Thank you.
22 And I appreciate that offer, and I look
23 forward to it.
24 And the definition of cosmetics
25 does seem as if it is pulled from somewhere

1 and does have some sort of existing basis.
2 Does it, or is that just sort of a very
3 specific definition?
4 SENATOR FUSCHILLO: I'm sorry, I
5 didn't hear your question.
6 SENATOR SQUADRON: The definition
7 of cosmetics in the bill does seem to have a
8 specific basis.
9 SENATOR FUSCHILLO: Very specific
10 to the concerns that the Retail Council has
11 raised based on experiences with law
12 enforcement and what they experienced was
13 really being sold illegally. You know, a lot
14 of these products are being bought illegally
15 and then sold at flea markets, and this is
16 very specific to the language that law
17 enforcement was concerned about.
18 SENATOR SQUADRON: Thank you,
19 Senator.
20 On the bill.
21 ACTING PRESIDENT FLANAGAN:
22 Senator Squadron on the bill.
23 SENATOR SQUADRON: Thank you.
24 As I say, I think that Senator
25 Fuschillo's goal here is one that I share. It

1 makes a lot of sense. I think that
2 certainly -- I'm not sure if I've personally
3 been victimized by it, but I know many who
4 have, who have gotten those dead batteries.
5 And nothing is more frustrating. Certainly
6 that's a consumer protection issue that needs
7 to be dealt with when you talk about things
8 like food for infants, for those under two.
9 But, you know, I'm very concerned
10 about the fact that this definition seems
11 quite broad, especially as applies to -- as I
12 said to Senator Fuschillo, the cosmetics
13 definition seems quite specific. I would hope
14 that it has some basis also in federal law or
15 in some sort of common practice. It seems
16 likely that it does.
17 The other definitions, as relates
18 to dietary supplements, botanical extracts,
19 vitamins, herbal substances, seems simply too
20 unspecific to be enforceable. And one of the
21 great goals here that I'm sure Senator
22 Fuschillo shares with myself and many members
23 of this house is to have something enforceable
24 so that we all protect what we need to
25 protect.

1 I fear that the bill in its current
2 form doesn't. It's so broad as to be
3 ineffective. And as a result, I'll be voting
4 no.
5 Thank you, Mr. President.

8 Senator Marcellino on the bill.
9 SENATOR MARCELLINO: Yes, thank
10 you, Mr. President.
11 I commend Senator Fuschillo for
12 bringing this bill up. This is an extremely
13 important bill. Anyone who has gone to a
14 retail establishment, a drugstore or whatever,
15 to buy cosmetics or buy something,
16 over-the-counter drugs, whatever, you will
17 notice lately that there are plastic blocks on
18 the shelves so that in order to get an object
19 you have to slide one block over to reach in
20 to get it.
21 The reason for that is these
22 organized criminal gangs. These are
23 professional thieves. This is not the kid who
24 steals a couple of items and takes them home,
25 these are people who are making a living doing

1 this. They walk in, create a distraction
2 someplace else in the store, and then sweep
3 whole shelves off. They remove hundreds and
4 hundreds of items at one time.
5 These plastic blocks are designed
6 to prevent that from occurring, at great
7 cost -- which you and I are paying for in the
8 course of the products that these people are
9 selling to us.
10 So I think this is a great idea.
11 This kind of organized theft is getting out of
12 hand and has to be dealt with, and this is one
13 way of doing it. And I appreciate that, and I
14 support this bill and will be voting aye.
15 ACTING PRESIDENT FLANAGAN: Thank

18 SENATOR PERKINS: Thank you very
19 much, Mr. Chairman. I'd like to ask the
20 sponsor a question or two.
21 ACTING PRESIDENT FLANAGAN:
22 Senator Fuschillo, will you yield to a
23 question from Senator Perkins?
24 SENATOR FUSCHILLO: I'd be happy
25 to, Senator.

1 SENATOR PERKINS: I generally
2 speaking am very supportive of what is it is
3 you're trying to accomplish.
4 I have sort of a thriving vendor
5 group that operates in my district that sells
6 products that I'm not sure are being outlawed
7 by this particular bill, and I just wanted to
8 be clear what is covered and what may not be
9 covered.
10 For instance, a lot of these
11 so-called street merchants that sell products
12 in my district, they don't steal the products
13 that they sell, so they don't fall into the
14 category of those that you are rightfully
15 attempting to outlaw. But they nevertheless
16 sell like Shea rubber, which is like a cream
17 that is made from a seed that -- and I don't
18 know if that product, which is a popular
19 product, is one of which you might be
20 outlawing with this legislation. And certain
21 type of herbal ingredients that are part of
22 what they sell in their oils also.
23 So I just want to get some
24 clarification with respect to those types of
25 products.

1 SENATOR FUSCHILLO: Senator, I
2 would have to ask you, is that a cosmetic?
3 Because if it is, it may be prohibited on
4 this.
5 But let me just tell you the intent
6 of this legislation, just so you know.
7 Senator Marcellino alluded to it a little bit.
8 Organized theft throughout this
9 country is a multi-multi-billion-dollar
10 operation. And there's a grave concern here
11 for products that are in this organized theft,
12 whether it's products that are being stolen
13 from a legal operation or products that are
14 just made up from other illegal activities --
15 certain soaps and certain cosmetics that may
16 not be regulated are getting into the flea
17 markets, and law enforcement needs greater
18 tools to go after them.
19 It was mentioned baby formula.
20 Baby formula shouldn't sit out in a street
21 vendor operation with the sun beating down on
22 it, and other products.
23 You know, the purpose of bringing
24 this here today is to elevate the discussion,
25 get it approved by the Senate, work with the
Candyco Transcription Service, Inc.

1 Assembly. Senator Squadron has some
2 legitimate concerns which I'm going to address
3 with him. If that's a product that's
4 prohibited from a legal vendor, you and I will
5 work on that, because that's not the intent of
6 this at all.
7 SENATOR PERKINS: Well, I'd like
8 to believe that's not the intent. I'm afraid,
9 in supporting this, that I would be sending
10 them a message that their Senator, who
11 supports them, who's organizing them and who
12 wants to see them even grow, is potentially
13 crippling them.
14 SENATOR FUSCHILLO: I don't
15 think --
16 ACTING PRESIDENT FLANAGAN:
17 Senator, please address your question through
18 the chair.
19 SENATOR PERKINS: I'm sorry.
20 ACTING PRESIDENT FLANAGAN: Would
21 you like Senator Fuschillo to yield for

23 SENATOR PERKINS: Yes, through

25 SENATOR FUSCHILLO: Well, I think

1 he was finishing the first part.
2 But through you, Mr. President, I
3 think your message is greater than that. And
4 you and I will work on that to clarify that
5 issue if it's not clarified here now. Your
6 message is one of public safety, and that's
7 what my message is, to protect our citizens
8 that choose to go to the outdoor vendors.
9 It's not to prohibit legitimate businesses
10 that are there right now or pay a fee.
11 If there's a question of that, and
12 if something needs to be cleared up through
13 the questions that Senator Squadron had
14 raised, I'll be happy to do that. But this is
15 bigger than that. It's a larger operation of
16 public safety, and also dealing with law
17 enforcement, to clarify some language that
18 they need to go after individuals.
19 SENATOR PERKINS: Through you,
20 Mr. President.

2 SENATOR PERKINS: I believe that
3 you're after bigger fish than what it is that
4 I'm very concerned about. But very often
5 those big nets catch little fish, and not
6 intentionally. And I'm concerned about the
7 possibility that that might happen, especially
8 since these are small entrepreneurs that we
9 encourage who are decent, law-abiding and even
10 provide somewhat of a public safety value by
11 virtue of their presence in the neighborhood.
12 So --
13 SENATOR FUSCHILLO: And I agree
14 with you, Senator, and your comments are duly
15 noted.
16 SENATOR PERKINS: All right,
17 thank you. Thank you.

19 So just very briefly -- and again,
20 we are sharing a lot of values and goals here,
21 and I really do appreciate Senator Fuschillo's
22 willingness to debate this.
23 I worry -- and in fact, when I was
24 a freshman here last year I was repeatedly
25 told by more senior colleagues on other side

1 of the aisle to be very, very careful about
2 passing one-houses that weren't fully formed
3 and fully ready, frankly especially if there's
4 a same-as, for fear that before you know it,
5 it could become law before it's ready.
6 So I really would urge, again
7 Senator Fuschillo to hold the bill today so
8 that we can all be voting unanimously for
9 something that we support as a goal.
10 Certainly, as I've said before, if Senator
11 Fuschillo chooses not to hold it, I'll be
12 voting in the negative.
13 But we have an opportunity here to
14 do something bipartisan together and something
15 better formed when this house passes it. So I
16 would really urge that.

9 I want to extend my appreciation to
10 the sponsor for the laudable efforts that he's
11 making for what is clearly a very, very
12 important concern and something that we would
13 all normally want to be able to support.
14 Unfortunately for me, I'm not going
15 to be able to vote for this bill at this time.
16 I'd like to be able to join with the sponsor
17 and fix it, if you will, such that it
18 addresses some of the concerns that I believe
19 are legitimate that I have that reflect the
20 kinds of entrepreneurship that you probably
21 would want to be supportive of.
22 But I think you might not
23 appreciate how this net manages to capture
24 those folks unintentionally. So from that
25 point of view, I'm going to have to vote no.

11 I too echo the concerns raised by
12 Senator Perkins. I think that there are some
13 areas of specificity that we could do to make
14 this bill a little bit better.
15 I too would like to volunteer to
16 work with the sponsor to work on some of those
17 areas of glitches. In communities such as the
18 type that both Senator Perkins and I
19 represent, we have a large number of vendors.
20 And we have worked very hard to make sure,

2 create a legitimacy, which is what we've
3 striven very hard to do, we want to be sure
4 that the things that we do here on the floor
5 don't adversely affect their ability to do
