13 So it's an honor to be here. We
14 thank Senator Tkaczyk for the warm welcome and
15 for all her work on behalf of the constituents
16 that she cares for so well.
17 So let us pray.
18 Lord, we thank Thee today for
19 another chance to serve Thee and the State of
20 New York. Before Thee, we are like children who
21 know not how to carry out our duties. Therefore
22 we ask, like King Solomon, not for a long life,
23 not for wealth for ourselves, not for the death
24 of our enemies, but that Thou givest us
25 discerning hearts to administer justice and to

1 distinguish between right and wrong.
2 Let us heed the word of Apostle
3 John: If we love one another, God dwelleth in
4 us and His love is perfected in us. Let us hope
5 that this spirit becomes the order of the day
6 right here in Albany.
7 We pray for our Governor, the
8 leadership in the New York Senate and Assembly,
9 all our brothers and sisters in the Senate and
10 Assembly, and for our servicemen and women and
11 their families. We pray for our beloved state

24 I'd like to rise and welcome Pastor
25 Eli Clement and Johann Huelett, who are here

1 from the Bruderhof Community. And I would like
2 the Senate to know that there are a significant
3 number of members of the Bruderhof Community
4 throughout my Senate district and even in the
5 Capital Region, including right here in Albany.
6 And just south of Kingston, the
7 Bruderhof bought and restored a magnificent
8 seminary, Mount St. Alphonsus. It was once a
9 seminary for the Redemptist Order, built in
10 1904. This magnificent facility overlooking the
11 Hudson River could have fallen into disrepair,
12 but the Bruderhof renovated it and turned it
13 into a beautiful high school.
14 I was fortunate enough to attend
15 their very first graduation ceremony at what's
16 now called the Mount Academy High School this
17 past weekend, and it was a beautiful and
18 extraordinary event for their entire community.
19 I just would like to encourage my
20 fellow Senators to join me in welcoming the
21 Bruderhof Community to our chambers today, and
22 to thank you for being here with us.

11 State of New York.

15 much, Mr. President.
16 Once again, this will be our second
17 year in memorializing a week for New York State
18 Museum Week. And the purpose of doing so is to
19 make everyone in New York State more aware of the
20 huge number of museums that we have to celebrate
21 the diversity and richness of the museums in our
22 state and to encourage people to visit one of the
23 museums in their locality.
24 Frequently people in their own
25 community have not visited the museum that's

1 right in their backyard, practically. And what
2 we're asking people to do and encouraging them to
3 do is to visit your museum.
4 There are over 200 museums
5 participating in Museum Week this week. They're
6 having special events, activities, and promotions
7 to give guests a sample of the exhibitions and
8 programs available.
9 Museum Week 2013 is being
10 cosponsored by the New York State Council of the
11 Arts and Museumwise/the Museum Association of
12 New York and the I Love New York program. There
13 are links on the I Love New York website to all
14 of the museums in New York State and the events
15 that are taking place.
16 So whether it's in New York City,
17 the Metropolitan Museum of Art or many of the
18 huge museums that they have in that city, to the
19 Hyde Museum in my own hometown of Glens Falls,
20 which this week, in celebration of Museum Week,
21 opens the exhibit entitled "Modern Nature:
22 Georgia O'Keeffe and Lake George." Georgia
23 O'Keeffe lived and summered on Lake George for
24 over 20 years. And this exhibition, which is
25 going to be at the Hyde Museum from June 15th to

1 September 15th, is going to then be a traveling
2 museum that will travel to New Mexico, where
3 Georgia O'Keeffe lived later on.
4 But it's an outstanding exhibit, and
5 I would encourage you all -- it's kind of right
6 in your own backyard, at least it's here in
7 New York State -- to see it before it travels to
8 other states.
9 The Empire State Aerosciences Museum
10 will be hosting open cockpit tours, military
11 aircraft, giving people an opportunity to sit in
12 a historic jet fighter or a helicopter. And
13 that's just an example of what our museums are
14 offering.
15 Many of our smaller museums do not
16 have the financial ability to advertise and to
17 promote themselves, so hopefully this week will
18 do so.
19 The week is also done in
20 collaboration with the Governor's Path Through
21 History, which took place the last two weeks,
22 highlighting the historically and culturally
23 significant sites and events throughout New York
24 State. And we know that many of those sites are
25 museums.

1 Museums are not only important for
2 their vital cultural resources for our state, but
3 they're important economic engines for the
4 communities where they exist. They play an
5 education, tourism, and community development
6 role for our cities, towns and villages
7 throughout this great Empire State.
8 There are abilities, I know, to pass
9 out blast emails, but mostly to just encourage
10 people in your district: Visit a museum and see
11 what wonderful things they have to offer.

5 SENATOR GIPSON: Thank you,
6 Mr. President, for this opportunity to speak on
7 Elder Abuse Awareness Day, which will be this
8 coming Saturday, June 15th.
9 I would encourage everyone in
10 New York State to stop for a moment and think
11 about how we can better assist our communities in
12 helping prevent elder abuse. As the cost of
13 living in New York State continues to rise and we
14 continue to have issues with unemployment, issues
15 are created within our families that
16 unfortunately lead to domestic abuse. Many, many
17 of these cases are not reported.
18 There are many elders in our
19 communities that are suffering from a great deal
20 of abuse that goes unrecognized and goes hidden.
21 And we need to do more to make the public aware
22 of this. This is an issue that there are
23 many organizations trying to rally around and
24 help our local seniors and elders deal with this
25 unfortunate circumstance.

1 I encourage everyone, if you know
2 someone who you think may be in danger of being
3 abused and who is a senior, please reach out to
4 the local authorities. There is assistance
5 available. And I would encourage my colleagues
6 here to continue to fight against this in any
7 legislative way that we can.
8 Taking care of our seniors is
9 critically important. When we lose our seniors,
10 we lose a valuable part of our communities, and
11 we should do everything we can to protect them.

11 SENATOR HASSELL-THOMPSON: Thank
12 you, Mr. President. And to the leader, I thank
13 you.
14 This resolution that has been put
15 forth is about a very young man, Eric Christian,
16 who was in his sixth tour of duty in Afghanistan
17 and who lost his life several weeks ago.
18 He actually lives in Senator
19 Bonacic's district, but as a young child he lived
20 in our community and my daughter used to babysit
21 him and his brothers. And there are four of
22 them, and they were magnificent boys. Just as
23 boys will do, they did everything. They did it
24 all. And Eric of course was the one who was the
25 ringleader.

1 Well, he did the same thing in
2 Afghanistan. And he was always ahead of his
3 time, ahead of himself, and an extraordinary
4 young child.
5 And I got a call several weeks ago
6 that he had been killed in Afghanistan. And I
7 had lost track of him and his family because they
8 had moved away. We knew that they moved to
9 upstate New York, but we had lost the contact.
10 And it was unfortunate that it took this incident
11 for us to reconnect with that family, but it is
12 what life does. It's what life allows, is for us
13 to somehow, in separation, come back together
14 with people who mean a lot in our lives.
15 And so I thank all of you for
16 signing onto this and for supporting and giving
17 to this mother and father some recognition by
18 this state body that their son was important to
19 someone other than to them. And certainly what
20 he did for his country and for his community
21 shall never be forgotten.

3 I want to thank Senator
4 Hassell-Thompson in speaking about this hero who
5 is now gone. I had spoken about this young man
6 late in May when he passed away on May 4th. At
7 the Memorial Day parades in Warwick, we talked
8 about his great sacrifice. And his mother lives
9 in Warwick, in Orange County.
10 And I know, Ruth, you know the
11 family well. And I asked you to carry this
12 resolution because of your personal relationship
13 with this family.
14 We can't say enough about this hero
15 and all the heroes that have sacrificed their
16 lives for our freedom. And I will assure you,
17 Senator Hassell-Thompson, that he will never,
18 never be forgotten.

13 bill would actually set up a No Lemon Law for
14 animals, and it would be a new mandate of new
15 regulations on businesses, which yesterday I
16 heard we were opposed to in this house.
17 So we would be creating a new set of
18 requirements on small businesses and setting up a
19 situation where animals could be returned and
20 then perhaps euthanized by the original
21 salespeople. And the last thing I would want to
22 do is vote for a bill that would increase
23 euthenization of animals that hopefully are being
24 sold or adopted into families.
25 So I understand the purpose of the

1 bill, but I don't think it really gets us where
2 we want to go. I'll vote no.

14 You know, Mr. President, it's been
15 three years since this chamber passed the Dignity
16 for All Students Act with great fanfare and
17 acclaim, and I think that was deserved.
18 But I am concerned, Mr. President,
19 that we are extending the Department of
20 Education's grace period another six months
21 before they have to enact training programs for
22 educators. And I do have concerns about it. But
23 again, I'm grateful for the Senator's efforts.
24 I did want to point out that hate
25 crimes in New York City have increased by upwards

1 of 70 percent since this time last year. And in
2 my district alone, Mr. President, there are have
3 been nine incidents of anti-LGBT violence,
4 including one murder. So, Mr. President, we have
5 our work cut out for us.
6 And I'm happy that the Dignity for
7 All Students Act is going to be enacted fully
8 hopefully within six months.

19 Well, I recognize that substituted
20 cathinone is a serious health risk and that
21 something we are referring to as synthetic
22 cannabinoid can also be a dangerous set of
23 chemicals. In fact, the Department of Health
24 describes it as a moving target as to what drugs
25 are being defined on the street in these two

1 categories.
2 I actually object to synthetic
3 cannabinoid being defined as a type of
4 marijuana. These kinds of drugs actually do
5 appear to be more dangerous. And they attempt to
6 perhaps replicate a certain kind of psychoactive
7 constituent of marijuana.
8 But actually I believe this state
9 made the right decision in decreasing the
10 penalties for drug use. This bill reverses that
11 pattern by increasing felony penalties for the
12 use of these drugs.
13 And frankly, we should not be
14 defining other drugs -- synthetic cannabinoids --
15 under the category of law that applies to
16 marijuana in this state, because I at least am
17 still in the hope we might as a chamber or as
18 both houses move in a positive direction on
19 marijuana policy this year.
20 I'll be voting no. Thank you,

1 SENATOR HASSELL-THOMPSON: Thank
2 you, Mr. President.
3 There is mounting evidence that the
4 side effects of synthetic cannabis are
5 substantially more dangerous than naturally grown
6 marijuana. Brand names like Spice and K2 were
7 and are widely used around the world as well as
8 here in the United States.
9 As the use of this drug increased,
10 there have been mounting medical reports that
11 that drug causes damage to kidneys, causes
12 paranoia, induces high blood pressure, and causes
13 stroke.
14 As the sponsor indicates, several
15 states have taken action to penalize the
16 possession and sale of synthetic cannabis. And
17 while I agree with the sponsor that possession
18 and sale of this drug should be penalized in
19 New York State, I'm not sure that the sale of any
20 amount of synthetic cannabis should be classified
21 as a C felony.
22 I do not believe that there is
23 sufficient evidence at this time to justify
24 making the sale of small amounts of synthetic
25 cannabis a felony. And I note that the

1 memorandum in support lists some of the side
2 effects. But additionally, it is not clear to me
3 how the bill concluded that the possession of one
4 quarter of an ounce of synthetic cannabis can be
5 a D and that over an ounce of synthetic cannabis
6 should be a C felony.
7 Current law around marijuana
8 possession in excess of 16 ounces but less than
9 10 pounds is a Class D felony and is punishable
10 by no more than seven years of imprisonment.
11 Possession of marijuana in excess of 10 pounds is
12 a Class C felony and is punishable by no more
13 than 15 years of imprisonment.
14 I submit that a more critical study
15 of the side effects of synthetic cannabis is
16 needed before a citizen can be exposed to up to
17 15 years in prison for possession of an ounce of
18 synthetic marijuana, up to 15 years in prison for
19 the sale of one stick of synthetic marijuana.
20 Therefore, Mr. President, I shall be
21 voting no.

22 Mr. President and my colleagues, if
23 you can imagine the horror of losing, on one
24 single afternoon, your daughter and your
25 granddaughter. That's exactly what happened to

1 Dale Driscoll, who, because of a violent
2 perpetrator entering into the home, lost her
3 daughter and her granddaughter Brittany, for whom
4 this law is named.
5 Brittany's Law establishes a
6 registry of those who have been convicted of
7 violent crime. A protection, if you will, of
8 those who are going out and meeting people,
9 knowing people, bringing them into their
10 business, their community or their home.
11 I believe this law will help stem
12 the tide of rising threats of domestic violence,
13 will help again send a signal that this New York
14 State is establishing a zero tolerance for
15 violence at all levels. And that it is certainly
16 a tribute and a memory of a young lady who was
17 helpless and defenseless against a heinous act of
18 violence.
19 Mr. President, it's a very good
20 bill. Thank you for the opportunity to speak on
21 it. And it has my full support. Thank you.

2 passion for his bill.
3 My concern is the bill talks about
4 being a registry for individuals convicted of
5 domestic violence offenses, but in fact it would
6 be anyone who goes to jail on any category of
7 violent felony offense under Section 70.02 of the
8 Penal Law. That's approximately 35,000 people in
9 our prison system currently, 35,000. And since
10 they get out most of the time, if this became the
11 law we would have the equivalent of a sex
12 registry system for easily 100,000 people within
13 a few years.
14 There's no cost analysis of this
15 bill, but we know it will cost the state a huge
16 amount of money. And I think though the goal is
17 sincere, the legislation is far too broad in its
18 impact and that this state should not move
19 forward at this time.

9 This is another example of a
10 one-house bill that, rightly so, addresses the
11 need to make sure that sexual offenders are kept
12 out of our public places. But my concern is that
13 we are not in this house doing enough to help the
14 victims of sexual violence.
15 Right now throughout this state
16 there are many, many people that are being
17 subjected to sexual violence, many of them
18 children. In my district recently, last year, a
19 little girl, a very little girl was raped over
20 and over and over again by her father. If you
21 can imagine how traumatic that experience must
22 be -- to be able to do anything to speak up on
23 behalf of what happened to her and all the other
24 people that are subjected to crimes like this is
25 incredibly difficult.

1 And it's why we have so many sexual
2 offenders that are unknown that continue to roam
3 around in society. And we are not convicting
4 them because we are not giving the victims a way
5 to testify against those who have committed these
6 awful, awful crimes.
7 But I have a bill that would change
8 that and would once and for all make sure that we
9 not only convict these horrible people but we
10 keep them behind bars. And it's a bill that has
11 a sponsor in the Assembly. It's called Rosie's
12 Law.
13 And in my case, in my district, this
14 little girl was able to go testify against her
15 father because she had the assistance of a
16 courthouse facility dog that's specially trained
17 to help these victims testify in really stressful
18 circumstances.
19 Her father was sent to prison for a
20 very long time, but he's now possibly going to
21 get out because the law itself does not state
22 that these dogs are allowed. Rosie's Law changes
23 that and says that these facility dogs are
24 allowed.

7 bill will cost my district enormous amounts of
8 money.
9 I primarily have part-time building
10 inspectors in my district. I suspect this is the
11 case throughout many parts of the state. They
12 will have to somehow find a way to all of a
13 sudden start inspecting all the state buildings
14 in their area, and that will not be paid for by
15 our state government.
16 This will cost our local governments
17 millions and millions of dollars. It is
18 undoubtedly a huge unfunded mandate, and I cannot
19 support it. And I will be voting no.

19 My fellow colleagues, I'm not sure
20 how many of you know what a central service
21 professional or a central service person is and
22 what work they perform. I'm not going to ask for
23 a show of hands. But basically they're ensuring
24 that the instrumentation and equipment used in
25 medical procedures, especially in surgeries, is

1 cleaned, disinfected, inspected and sterilized,
2 so this way you don't get sick after the
3 performance of a procedure.
4 So this legislation requires
5 certification of these technicians, which will
6 ensure that they have the ongoing education and
7 requisite knowledge to make sure that this is
8 being done. And it includes robotic equipment
9 just as well.
10 It passed both houses last year and
11 was vetoed by the Governor. A tireless effort
12 has been done by Assemblyman Bronson and his

17 Fellow colleagues, the Buffalo
18 School District, as we know, is a dependent
19 school district, dependent on the State of
20 New York for its money. And as such, I feel that
21 our residents of the City of Buffalo should get a
22 chance to vote on how the school district and the
23 school budget is allocated. And they don't have
24 that opportunity, unlike most school districts
25 who can vote on their budget.

1 And the District Parenting Council
2 that's in Buffalo contends that through their
3 research, that districts voting on their school
4 budget, they have higher graduation rates with
5 fewer persistently low-achieving schools and
6 fewer schools under review.
7 This legislation seeks to make the
8 district more accountable to a community that has
9 a budget of over $800 million. That's the City
10 of Buffalo School District budget, $800 million,
11 and the people of Buffalo don't get to vote on
12 it.
13 So with graduation rates in the
14 Buffalo school system at 50 percent, at
15 31 percent for African-Americans, and for
16 Hispanics at 31 percent, spending over $27,000
17 per student, it's a disgrace.
18 So it's vital that we allow our
19 parents to be involved with these type of
20 decisions to move forward with bioinformatics and
21 science technology. These kids are not even
22 given the opportunity to go to a secondary school
23 and further their education, where we have in
24 Buffalo "Say Yes to Education" that will allow
25 them to have free college tuition through a

1 program that's been set up. But they're not
2 going to get there because they're not graduating
3 from high school.
4 So the struggles of our school
5 district is that's not going to be solved
6 overnight. But I believe this, along with other
7 bills that have been passed, like moving the
8 elections of the school districts from May to
9 November, could help out tremendously. We need
10 greater accountability from our elected members
11 of the Buffalo Board of Education and also their
12 important employees.
13 And I urge you to vote for this
14 bill; it's important for the students in the City
15 of Buffalo. I vote aye, Mr. President.

17 say $30,000 new money -- if I could get an
18 assignment of the mortgage from the first
19 mortgage and we consolidate the loan with a
20 second bank for the additional 30 grand, I only
21 have to pay mortgage tax on the 30,000, the
22 additional new money, rather than repay a
23 mortgage tax on a mortgage that was previously
24 existing.
25 So it saves mortgage tax money, and

4 THE SECRETARY: Legislative
5 Resolution Number 3222, by Senator Klein,
6 honoring Danny Hay in recognition of his prompt
7 and heroic efforts to rescue three people on
8 New York City subway tracks from an oncoming
9 train.
10 "WHEREAS, It is the sense of this
11 Legislative Body to recognize and commend the
12 concerned and heroic acts of those citizens who
13 would voluntarily take immediate and appropriate
14 action to protect the health and safety of
15 others; and
16 "WHEREAS, At 8:30 a.m. on Sunday,
17 April 7, 2013, MTA train operator Danny Hay of
18 New York City was at the Delancey Street subway
19 station on his way to work when he observed an
20 unconscious man lying on the subway tracks; and
21 "WHEREAS, Responding without
22 hesitation or concern for his own welfare and
23 safety, Danny Hay immediately sought to render
24 assistance by calling for the power to the tracks
25 to be cut off; with the power still on, he

1 returned to the tracks and found two Good
2 Samaritans along with the unconscious man still
3 on the tracks in the path of an oncoming F train;
4 and
5 "WHEREAS, In response to this
6 life-threatening emergency, Danny Hay ran to the
7 end of the Delancey Street subway station and
8 flashed his flashlight to the operator of the
9 oncoming F train; the operator of the train was
10 able to successfully stop the train in the nick
11 of time; and
12 "WHEREAS, For his courage and
13 decisive action, taken without due regard for his
14 own personal safety, Danny Hay has aptly
15 demonstrated his character and compassion for the
16 welfare of others, personifying, by virtue of his
17 action, the collective concern of ordinary
18 citizens across the community --

8 his courage and decisive action, taken without
9 due regard for his own personal safety, Danny Hay
10 has aptly demonstrated his character and
11 compassion for the welfare of others,
12 personifying, by virtue of his action, the
13 collective concern of ordinary citizens across
14 the community of New York State who voluntarily
15 respond without thought of danger or reward when
16 others are in need of help; and
17 "WHEREAS, It is the sense of this
18 Legislative Body to recognize, honor and pay
19 tribute to those individuals within the State of
20 New York who perform rescue operations with
21 courage, diligence and precision, resulting in
22 heroic life-saving actions; now, therefore, be it
23 "RESOLVED, That this Legislative
24 Body pause in its deliberations to honor
25 Danny Hay of New York City in recognition of his

1 prompt and heroic efforts to rescue three people
2 on New York City subway tracks from an oncoming
3 train; and be it further
4 "RESOLVED, That a copy of this
5 resolution, suitably engrossed, be transmitted to
6 Danny Hay."

9 SENATOR KLEIN: Thank you very
10 much, Mr. President.
11 I'm deeply honored today to present
12 this resolution to New York's very own Danny Hay.
13 Each and every day, as you know,
14 public sector workers keep our state -- in this
15 case, our city -- running. Danny, as a dedicated
16 employee of the MTA for years now, has kept
17 millions of New Yorkers moving each day.
18 But I think it's incumbent upon all
19 of us here today to recognize him not only for
20 what he does each and every day as far as his
21 sacrifice and service, but his heroic act of
22 bravery in saving three people from a speeding
23 train.
24 It was that day when Danny was going
25 to work down on Delancey Street, and basically

1 saw what was going on and single-handedly, by
2 using grit and courage, forced the train to slow
3 down and not hit three individuals who were on
4 the track. One took ill, two other Good
5 Samaritans went to help him, and Danny wound up
6 saving each and every one of them.
7 He single-handedly stopped the
8 speeding train from hitting these people, and I
9 think we owe him really a debt of gratitude.
10 Each and every day he serves us, but on this very
11 special day I'm proud to call Danny a hero.
12 So with that, I hope everyone will
13 join us in recognizing Danny, because I think
14 Danny Hay is an inspirational service to each and
15 every one of us.
16 Thank you, Danny.

20 thank you, sir, for your heroic efforts.
