2 commemorating the 206th anniversary of Colombia's
3 Declaration of Independence on July 20, 2016.

6 SENATOR PERALTA: Thank you,
7 Mr. President.
8 This year marks the 206th year of
9 Colombian independence. Colombia celebrates
10 Independence Day each year on July 20th. The day
11 commemorates the Declaration of Independence made
12 on the date in 1810. That day, almost 206 years
13 ago, the citizens of Bogota, Colombia, Colombia's
14 capital, created their first representative
15 council, an action that led to Colombia's first
16 national government.
17 Even though it took another nine
18 years to achieve full independence from Spain,
19 Colombians annually celebrate the first "El Grito
20 de Independencia," or "Cry for Independence," led
21 by Simón Bolívar. Complete victory over Spain
22 was declared in August of 1819.
23 Colombian independence is an
24 occasion of great celebration in my district,
25 which is home to La Pequeña Colombia, or "Little

1 Colombia," and generations of Colombians and
2 Colombian families, including the actor and
3 comedian John Leguizamo, who grew up in
4 Jackson Heights. La Pequeña Colombia is right at
5 the heart of my district -- which, as you know,
6 is the United Nations of all Senate districts.
7 Like the United States, Colombia has
8 also a long tradition of constitutional
9 government. The United States and Colombia are
10 good friends, they are allies, a relationship
11 forged by a love of democracy, the rule of law,
12 and of course liberty.
13 By way of this resolution, we extend
14 our best wishes to our Colombian-American friends
15 across the state in advance of this important and
16 joyful day.

13 Certainly inciting violence against
14 an active member of the military is an absolutely
15 unacceptable act and one that we should
16 universally condemn.
17 Like a nearly identical bill
18 pertaining to police officers earlier in the
19 session, this bill has a standard just pulled
20 verbatim from a Supreme Court decision: "Such
21 advocacy is directed to inciting or producing
22 imminent lawless action and is likely to incite
23 or produce such action." That's the definition.
24 That is not a definition that law enforcement,
25 prosecutors, courts are going to be able to use

1 effectively.
2 Passing a law with a very important
3 positive headline that's going to take years and
4 millions of dollars in litigation to actually
5 understand and enforce doesn't do anyone any
6 favors. We should make a clear statement against
7 inciting violence against active-duty military,
8 absolutely, but we should do it in a way that has
9 meaning, not in a way that's going to create
10 endless litigation based on the copying verbatim
11 of a Supreme Court decision without putting any
12 flesh on those bones.
13 I unfortunately have to vote no,
14 Mr. President.

15 would reduce, by close to 90 percent, the
16 contribution by facilities within one mile, which
17 are crude oil storage facilities, to a similar
18 facility in another state.
19 That amounts to one facility, which
20 in my humble opinion would undermine the very
21 important environmental mechanism we have called
22 the Oil Spill Fund, whereby polluters pay for
23 their mistakes.
24 In this instance, the producers and
25 those who transport crude oil should have to

1 contribute to a fund in the event of a spill.
2 That's a principle we have in law, that polluters
3 pay. And no one should be exempt. Otherwise,
4 the public is going to end up paying,
5 taxpayers are going to end up paying if the Oil
6 Spill Fund is not supported by the industry.
7 So I'll be voting in the negative.

15 Although every time I say the word
16 "climate change" on this floor, I seem to get a
17 fizzle of noise behind me somewhere, I will just
18 go on record -- thank you. Thank you, people. I
19 appreciate everybody responding as I expected.
20 Climate change is real. We all know
21 it. We need to move quickly to respond to try to
22 reverse the damage that's already been taking
23 place. The Governor's REV package of moving us
24 into a sustainable energy model for the state --
25 allowing for new forms of energy, prioritizing

1 those types of energy that do not add to the
2 greenhouse gas crisis in our state, our country,
3 our planet -- is the right answer.
4 While we always want more
5 information as a Legislature, while we always
6 want everybody to be transparent and report to us
7 as to what is going on, what this bill would do
8 is slow down the entire process. And in fact I
9 do believe that the reports coming out of the
10 Governor's REV group of experts have been
11 providing a great deal of information to us.
12 So I would urge my colleagues not to
13 take a vote to slow down the kind of change we
14 need to be speeding up in New York State, not
15 slowing down. We have a commitment to change our
16 mix of energy within a very short period of
17 years. There are those who are advocating we
18 move even more swiftly than the commitments we
19 have made. We need to make sure our agencies, in
20 coordination with the private sector, can move us
21 quickly into a 21st-century model of sustainable
22 energy while decreasing our greenhouse gas
23 footprint.
24 And I don't believe any of us can go
25 home and explain why we didn't want to move as

1 quickly as we could towards that goal.
2 I vote no, Mr. President. Thank

8 Mr. President, this is as good a moment as any to
9 commend the Cuomo administration for their
10 Reforming the Energy Vision initiative, which is
11 a potential game-changer that will wean the State
12 of New York off of fossil fuels and on to more
13 sustainable forms of energy like wind and solar.
14 And to think that this body would
15 delay that implementation, given the existential
16 threat which we hear repeatedly termed for human
17 induced climate change, is baffling. I tend to
18 think our friends on the other side of the aisle,
19 you know, hate regulation unless it works to
20 their benefit.
21 In this instance they want to impose
22 a cost/benefit analysis on REV, but one already
23 exists. It's called "Order Establishing the
24 Benefit Cost Analysis Framework." So not only, I
25 think, is there a pernicious motive here to

1 undermine REV, but also it's duplicative and
2 unnecessary because the cost/benefit analysis is
3 already in place and ready to go.
4 So I'll be voting in the negative.

21 down. But I think people would want to know what
22 the cost of Option A is, Option B, Option C,
23 Option D, and choose from those various cost
24 analyses what's good for the environment and also
25 what's good for the taxpayers of the state.

2 slow it down seems to me to be a little bit
3 shortsighted. We should pass, on that analysis,
4 every bill and forget about a financial
5 analysis -- just do it. Like there's an
6 unlimited amount of money and taxpayers could

8 cost-effective or not.
9 So that's the intent of the bill.

11 the right reasons.

3 I rise to second the nomination of
4 George P. Beach as the next superintendent of
5 State Police. He did pass through the Crime and
6 Corrections Committee unanimously.
7 Many of you know that at one point
8 in time I served in the State Police. I worked
9 with George Beach for many, many years. He has
10 served over 30 years in the State Police, moving
11 up through the ranks, almost every single rank,
12 up to the executive level in the position of
13 lieutenant colonel.
14 He is incredibly qualified for this
15 professionally, personally. A man of honor,
16 integrity, intelligence. And I put all those
17 things first because that's the type of person
18 that we should have as the superintendent of the
19 nation's eighth or ninth largest law enforcement
20 agency, and New York's finest.
21 Beyond that, I also rise and am very
22 proud to second this nomination as a long-time
23 friend of George Beach's. And on that personal
24 note, I can't think of a finer, more upstanding
25 individual of honor, integrity, the type of

1 person that not only do we want in public
2 service, but to lead this great agency.
3 So I congratulate the Governor on
4 this nomination, and I congratulate you, my
5 friend, Colonel George Beach, now to be
6 superintendent, and look forward to walking with
7 you in that capacity.

15 And we are very fortunate in
16 New York State to have someone of such a high
17 caliber who is willing to serve as superintendent
18 of the State Police. Lieutenant Colonel Beach
19 has devoted his life to public safety, public
20 service. He has an extensive career, serving to
21 protect the public, serving in emergency medical
22 services, serving in firefighting and also
23 conducting investigations.
24 He is dedicated to promoting
25 positive change. And he also is devoted to

1 upholding the highest ethical standards. He has
2 led by example, because he has done the hard work
3 that our brave men and women in the State Police
4 accomplish every single day. He's been on road
5 patrol, he has been in manhunts, he has conducted
6 murder investigations -- all of the hard work of
7 the people who serve in our distinguished State
8 Police has been done by this individual. And
9 leading by example is critical if you are working
10 to be the head of such an important state agency.
11 So it is with great pride that I
12 also nominate and put forward the name of
13 Lieutenant Colonel George P. Beach, II, as
14 superintendent of the New York State Police.

1 In the course of my representation,
2 I've been honored to be in the confirmation
3 process of at least half a dozen superintendents,
4 and certainly many of them have served with
5 distinction, especially retiring Superintendent
6 D'Amico. Superintendent McMahon, who served with
7 distinction for many years, comes to mind.
8 Listening to Colonel Beach
9 discussing the mission statement that he brings
10 to this new job was extremely gratifying to me
11 and I believe demonstrates clearly that our new
12 superintendent is on the right track.
13 The demands on the State Police are
14 many, from helping in our schools, on our roads
15 throughout upstate, providing tremendous law
16 enforcement services. We see those each and
17 every day. But there are many services that our
18 New York State Police provide that we do not see,
19 particularly in the areas of cybersecurity as
20 that becomes much more of a growing threat across
21 the businesses and individuals and governments of
22 New York State. The new superintendent is
23 committed to working on those important issues.
24 That again, I wish Superintendent
25 Beach all good speed and success during his

1 tenure, and that I do hope that he will certainly
2 have a career that is among those most emulated
3 as the former superintendents of the finest
4 police force, I believe, in the nation.

14 superintendent of the State Police, Lieutenant
15 Colonel George Beach, is a constituent of mine in
16 the 46th Senate District. He lives in the town
17 of Hurley.
18 I had the opportunity to spend some
19 time with him, and after reviewing his impressive
20 accomplishments within the ranks of the
21 State Police, I have great confidence that he has
22 the experience, the courage, and the convictions
23 to excel in his new leadership role.
24 In more than 30 years experience of
25 service, he has worked his way up through the

1 ranks of the New York State Police, building
2 extensive experience in crisis response, in
3 emergency management, in policy development and
4 administrative operations. His experience will
5 serve the residents of the State of New York very
6 well in his new role.
7 Our State Police are on the
8 front lines of keeping our communities safe
9 throughout the State of New York, and I want to
10 congratulate you, Colonel Beach.
11 But more importantly, I want to
12 thank you for deciding to continue your public
13 service to this great state by taking on this
14 ambitious challenge. And I am sure we will all
15 continue to be protected, that as you serve and
16 as you lead our great State Police force, we will
17 all feel safe and know that we have a very good
18 leader at the helm.

2 nomination.
3 Certainly the men and women of law
4 enforcement know better than any other, this is a
5 time for law enforcement in this country that is
6 not for the faint of heart. It takes a very
7 unique individual to lead an organization of law
8 enforcement, especially at the scope and
9 professionalism of those of the State Police, the
10 state troopers.
11 This nomination comes at
12 particularly important juncture in our state's
13 history, with the threats of international
14 terrorism to New York and the new challenges that
15 domestic radicalization pose on our state and our
16 nation. I believe that Colonel Beach is
17 precisely the right man at precisely the right
18 time in New York's history to be leading this
19 organization.
20 And the men and women of the
21 troopers consider him to be a trooper's trooper.
22 And it's very rare in military or in uniformed
23 services, in law enforcement, that you get to
24 choose your own leader. But I have a feeling if
25 the troopers were to have the opportunity to

1 choose their own leader, it would be Colonel
2 Beach.
3 And so I compliment the Governor on
4 an excellent choice to lead the state troopers,
5 and I congratulate our new superintendent.
