3 congratulating Tyler Barnes upon the occasion of
4 capturing the 170-pound Division I wrestling
5 title at the New York State Public High School
6 Athletic Association Wrestling Championships on
7 February 25, 2017.

10 SENATOR TEDISCO: Thank you.
11 Thank you, Mr. President, and my
12 colleagues. I would ask you to join me in
13 welcoming and saluting and congratulating an
14 outstanding student athlete from the 49th
15 Senatorial District. He hails from Ballston Spa
16 High School, and his name is Tyler Barnes.
17 And he and his parents and sister
18 and grandmother and the administration of the
19 school and a lot of supporters are up there in
20 the balcony with him today to receive this
21 welcome. We passed the resolution not too long
22 ago honoring him.
23 He is this year's 170-pound
24 New York State Division I wrestling champion,
25 which is an outgoing feat. He had a record of

1 42 and zero. I told him I never won 42 games as
2 a basketball player, but I once scored over
3 42 points. But that doesn't come close to
4 winning 42 events.
5 One of the things you should know
6 about Tyler is he did this on February 25th at
7 Times Union Center here in Albany. And it's
8 always great to finish second, because you know
9 you're up there in the top, but it's nothing like
10 finishing first. And one of the things about
11 Tyler which is interesting is his father, Terry
12 Barnes, in 1995 finished second in the Division I
13 wrestling championship. And I attribute it to
14 the combination of Terry and his lovely wife Amy,
15 Tyler's mother, to bringing those genes forward
16 so Tyler could be number one and win that
17 championship. So congratulations to both the
18 parents for that.
19 He's a great student athlete who's
20 worked very hard during his entire high school
21 career for this championship. He's a junior at
22 Ballston Spa High School. And Tyler earned a
23 5-to-2 win at that time over the number-three-
24 seeded wrestler from John Glenn High School in
25 Elwood in that 170-pound division.

1 During this particular match, Tyler
2 had a late, in the match, 3-to-2 lead, and there
3 was 40 seconds left, kind of nip and tuck, but he
4 did what he had to do under that stressful
5 position and got a takedown with about 40 seconds
6 left to go, to make that 5 to 2.
7 And in a sport such as wrestling,
8 which demands athletic prowess, speed, agility,
9 Head Coach Harvey Staulters worked hard to hone
10 the skills of this champion, teaching Tyler
11 lessons which will prove invaluable both on and
12 off the mat.
13 And by the way, most importantly,
14 he's an outstanding student. And he says he's
15 going to go to, potentially, North Carolina
16 State. I'd love to see him go to my alma mater,
17 Union College, but I think he's a step above
18 Union College -- not academically, they're both
19 great schools, but I think athletically he's
20 going a little higher.
21 I'd like to introduce those who are
22 with him and supporting him and helped him get to
23 this point with all his hard work. As I
24 mentioned, Tyler is joined today by his mother
25 and father, Amy and Terry Barnes; his sister,

1 Lilly Barnes; grandmother Irene Orton; Coach
2 Harvey Staulters; Athletic Director David Sunkes;
3 Ballston Spa Superintendent Dr. Joseph Dragone;
4 School Board Vice President Sue Filburn; School
5 Board Member Nancy Fodera; and Vice Principal
6 Gianleo Duca.
7 I would ask that, Mr. President, you
8 and the body welcome Tyler, congratulate him, and
9 offer him all the cordialities of this august
10 body.
11 Tyler, we're proud of you and we're
12 proud of Ballston Spa High School. And best
13 wishes in your future.

9 State. As a University of North Carolina-Chapel

22 It's interesting to listen to
23 Senator Tedisco.
24 Tyler, I want to welcome you, along
25 with everybody else. And a couple of thoughts.

1 I think the best thing that Senator Tedisco said
2 was that you are a student athlete. Not an
3 athlete student. Being a student comes first,
4 and hopefully you never forget that.
5 And hopefully I'm going to make you
6 smile. I have an appreciation for wrestling,
7 although I never possessed any talent in that
8 regard. And at this point in my life, I'm like a
9 lot of people -- I kind of hate you, because I
10 remember when I weighed only 170. It was a long
11 time ago.
12 (Laughter.)
13 SENATOR FLANAGAN: But Senator
14 Marcellino and I happen to represent the Elwood
15 School District, so it sounds like you took down
16 one of our local guys. But props to you and your
17 family, and best wishes and good luck.
18 And, Tyler, to you and your family,
19 you're in an august body today known as the
20 New York State Senate. I want to recognize our
21 leaders, Senator Klein, Senator Stewart-Cousins.
22 And we have days that are great and
23 days that are bittersweet. So today I just
24 wanted to ask for everyone's indulgence to
25 recognize the passing of two people who are very

1 important, one of whom is Senator Marty Dilan's
2 wife -- and I want to make sure I'm reading it
3 correctly -- Debra Dilan. The funeral took place
4 today.
5 And she is survived, obviously, by
6 her husband, Senator Marty Dilan; our colleague,
7 of course, from the New York State Assembly, Erik
8 Dilan, who's a former New York City Council
9 member; daughters Melissa and Nicole; and two
10 grandchildren, Daniel Martin and Lea Georgina.
11 And we grieve for people in their
12 absence. So we extend our condolences and
13 thoughts and prayers to the Dilan family. And
14 like a lot of people, I think of people like
15 Senator Serrano, Senator Kennedy -- Senator Dilan
16 is a good person. He's a good guy. So we mourn
17 his loss, for him and his family.
18 And a former colleague, Senator
19 Skelos, just lost his dad, who lived to the ripe
20 young age of 95. And had he made it till
21 tomorrow, he would have been 96. So he had a
22 great run. And he is survived by his five
23 children, 10 grandchildren, and three
24 great-grandchildren.
25 And I don't think Senator Skelos

1 would be offended by me saying this, but I know
2 how much reverence and love and affection he had
3 for his father. I remember talking to Dean about
4 his dad when he was like 90 years old. He said,
5 "My dad's doing great. He's dating. He's got a
6 girlfriend, and he's 90 years old." So we should
7 all live so long and prosper.
8 But to the Skelos family as well,
9 our former colleague, we extend our thoughts and
10 prayers on behalf of the New York State Senate.
11 Mr. President, I appreciate you
12 giving me the opportunity. Thank you.

13 SENATOR CARLUCCI: Thank you,
14 Mr. President.
15 I rise to support this very
16 important legislation, and I want to thank my
17 colleagues for supporting it as well.
18 What this legislation does is try to
19 tackle the problem of the ever-increasing cost of
20 tolls. Tolls are a regressive fee. It doesn't
21 matter if you make $20,000 a year or $20 million
22 a year, we all have to pay the same toll. And
23 unfortunately, in New York we have some of the
24 highest and the most frequent tolls in the
25 nation.

1 In fact, if you want to drive from
2 the Tappan Zee Bridge to Boston along 95, you
3 won't have to pay a single toll once you leave
4 the Tappan Zee Bridge. But if I want to go from
5 Rockland County to visit my friend Senator
6 Kaminsky down in Long Island, I'm going to have
7 to pay toll after toll after toll.
8 So what this legislation does is
9 crack down on toll evasion. The New York State
10 Thruway Authority tells us we're losing over
11 $16.5 million a year to toll evasion. In fact,
12 we saw one individual that had over $28,000 in
13 unpaid tolls.
14 So this is not a victimless crime,
15 this is something where we have to step into the
16 21st century, we have to modernize our laws,
17 allow the commissioner of the Department of Motor
18 Vehicles to go after chronic toll evaders,
19 suspend their vehicle registration. We're not
20 talking about someone who goes through one, two,
21 three, four tolls as a mistake. We're talking
22 about the chronic evaders that are taking money
23 out of our pockets and forcing hardworking
24 families to pay more.
25 This is an important step in the

1 right direction, to go after the chronic toll
2 evaders and also codify it into law to allow us
3 to work in an interstate agreement, to work with
4 New Jersey, work with Pennsylvania and
5 Connecticut, to go after chronic toll evaders
6 residing in those states.
7 So, Mr. President, I want to thank
8 my colleagues for supporting this legislation,
9 and I enthusiastically vote yes. Thank you.

18 Year after year, the state has
19 mandated additional programs and services to be
20 provided by local governments for which these
21 governments receive no state funding. These
22 mandates place local taxpayers and local
23 officials in the position of paying for services
24 that they do not control.
25 This legislation is going to help

1 alleviate the financial challenges that local
2 governments face due to decisions made here in
3 the State Capitol. With New York State's high
4 tax climate, it certainly is important that we
5 address the financial burdens that the state
6 places on our local governments in order to
7 protect our residents from increasing property
8 taxes.
9 So by passing this legislation, we
10 are showing our local governments that we do
11 care, that we do understand the effects our
12 legislation has on their budgets. We are showing
13 our constituents and taxpayers that we hear their
14 complaints of high property taxes and that we are
15 doing something to try to correct that.
16 Thank you, Mr. President. I thank
17 my colleagues for voting for this legislation. I

19 in the St. Patrick's Day season that we're in
20 right now. But I just don't think it's incumbent
21 on the Legislature to have a day off for any
22 ethnicity. I think we need more days in school.
23 And this -- although we all could be
24 proud to either be Irish or to enjoy all the
25 things that the Irish have done for this country

1 and our communities, I don't think this is a good
2 bill and I'm voting no for that reason.
3 And just to show you I have nothing
4 against the Irish but respect, St. Patrick was
5 part Italian. So I just want to make sure that
6 that is clear on the record.
7 (Laughter.)
8 SENATOR DeFRANCISCO: So I'm going
9 to vote no for those reasons. Thank you.

15 I have some concerns about this bill
16 myself. I'm concerned when it says all schools
17 need to close. I'm concerned with $39 million a
18 day lost to the Board of Ed.
19 However, after sitting next to my
20 colleague and after getting further education
21 from him, I believe that I will vote in favor of
22 this bill.

9 Arthur S. Lussi, of Lake Placid, as a member of
10 the New York State Olympic Regional Development
11 Authority. He's a very qualified candidate, and
12 I believe that our colleague Senator Little would
13 like to say a few words about him.

16 SENATOR LITTLE: Thank you,
17 Mr. President. And thank you, Senator Young.
18 And thank you all for supporting the nomination
19 of Art Lussi to the Olympic Regional Development
20 Authority, commonly known as ORDA.
21 ORDA runs the facilities, the venues
22 that are in Lake Placid that have been used in
23 the Olympics of 1932, 1980, and continue to be
24 used for world-class winter athlete games as well
25 as economic development in the North Country.

1 The Town of North Elba, wherein lies
2 the Village of Lake Placid, has two nominees to
3 the ORDA board. Mr. Lussi is one of those, voted
4 on by the town board to serve in this capacity.
5 And I thank you for your support and
6 thank the Governor for supporting this nomination
7 as well. And I think that Mr. Lussi will do a
8 great job serving on the ORDA board.
9 Thank you.
