16 SENATOR TEDISCO: Thank you, Madam
17 President.
18 And my colleagues, I ask you to join
19 me in welcoming and saluting and congratulating
20 an outstanding group of student-athletes. They
21 hail from Union College, which happens to be my
22 alma mater, in Schenectady, and from the
23 49th Senatorial District. They are the Men's
24 Varsity Basketball Team of this past year.
25 And joining them, believe it or not,

1 are three of the players who played with me many
2 years ago, who are excited to be here with me and
3 with you to honor them and salute them for the
4 tremendous and unbelievable season they have had.
5 And the reason why we're excited
6 about this is because we got the opportunity to
7 see several of their games this year. And we're
8 proud of the fact that we're Union graduates,
9 we're proud of the fact that we competed
10 athletically as they did, but what we're most
11 proud of is the way they came together and jelled
12 as a team and got to that place, that sweet spot,
13 where everything will go right if no individual
14 cares who gets the credit, and they work for the
15 team. And they did that in an unbelievable way
16 this year.
17 To let you know what they've
18 accomplished, they had 17 wins this year, which
19 is great. They got to the Liberty League
20 Tournament because of the place they had. They
21 beat St. Lawrence in the first round in double
22 overtime, with a shot by Deshon Burgess. And I
23 told them they could have made it a little bit
24 more dramatic; there was 0.9 seconds left when he
25 hit a three-point shot in double overtime to win

1 that game to get them into the finals. I said,
2 "You could have made it 0.5 seconds or something
3 like that."
4 But that was a tremendous win in
5 double overtime. Then they went on to the
6 championship game. They beat Hobart 71 to 67 to
7 win the Liberty League Championship. And it's
8 Division III, but a tremendous competitive
9 league. Very competitive.
10 And when I spoke to them today, I
11 talked about the fact that anybody who plays
12 basketball -- and Senator DeFrancisco knows that,
13 and I told him earlier I went to see a few games
14 with the Syracuse team. In fact, I got to the
15 finals. Unfortunately, it was when Smart hit
16 that shot, Senator, and that wasn't a good thing,
17 in New Orleans.
18 But this is a team that we're very
19 proud of. Wins are good, winning a championship
20 is good, but anybody who plays basketball knows
21 they want to get to the NCAA tournament, the big
22 dance. They not only got there, but they won one
23 of their games; they beat Wesleyan in the first
24 round, 89 to 83.
25 So this is something historic for

1 them. They'll remember this for the rest of
2 their lives. They'll come back like my
3 colleagues do every year. And believe it or not,
4 there's three of my colleagues, but this year
5 we're having the 45th reunion of our varsity
6 team, and 11 out of 12 of the players will be
7 coming back to that to have a reunion.
8 It's bittersweet for us, and that's
9 why we live vicariously through a team like this.
10 We had a tremendous year back when I was a
11 senior. We were picked to go to the tournament,
12 which is the number-one thing you want to do.
13 What happened is somebody read the rules of our
14 league, and the rules of our league said we could
15 not compete in post-tournament play.
16 I have to tell you, not only were we
17 disappointed, but the school itself -- and the
18 student body almost burnt down the president's
19 house. And they closed down the field house for
20 a while.
21 So we went to a lot of games, we saw
22 them go up and down, but we saw them compete at
23 the end when they should have.
24 And here with me are my three
25 colleagues: Bob Pezzano and Mike Doyle, who went

1 to Linton High School in Schenectady now, and
2 Geoff Walker, from Colonie.
3 And we can't say how proud we are of
4 this particular team and the coaching staff, who
5 did an unbelievable job. This is something
6 they'll remember for the rest of their lives.
7 And I hope they continue to come back, and I know
8 they will. Watching them play, we saw the guys
9 on the bench, saw the guys who were playing --
10 they were one team acting as one group.
11 And they're up for a lot of
12 successes in the future -- the coaches are, the
13 future teams are, but so are these players, in
14 anything they attempt, because I think they
15 learned some tremendous lessons.
16 Let me just tell you who is here.
17 Their head coach is Coach Chris Murphy, who was
18 the starter on the 2004-2005 Union team, which
19 was the last one to make it to the NCAA finals.
20 So he had some experience, and he brought this
21 team to the tournament. Assistant Coach Nick
22 Ciresi, and Eric McDowell, assistant athletic
23 director for sports information.
24 And these are the team players,
25 which I'd like to put in the archives so they're

1 remembered: Deshon Burgess, who was First Team,
2 All Liberty League; Wade McNamara, Second Team,
3 All Liberty League; Zachary Bouton, Benjamin Lee,
4 Kevin Weckworth, Aaron Gordon, Shiraz Mumtaz,
5 Greg King, Mike Palleschi, Garrett Johnson, Kevin
6 McNoble, Matt Liquori, Martynas Simanavicius,
7 Brendan Laing, Kevin Jefferson, Weston
8 Hannon-Bogosh, and Guiseppe de Spuches.
9 Congratulations for a great season,
10 something you, us, the Union College alumni and
11 the student body over there will always remember.
12 Madam Speaker, I ask you to welcome
13 them, congratulate them, and offer all the
14 cordialities of this august body.
15 Congratulations, and have a safe
16 trip back.

20 all I've got to supplement what Senator Tedisco

22 First of all, Syracuse University
23 did lose to the last-second shot by Keith Smart
24 in New Orleans. I happen to have been there, and
25 I haven't stopped crying since.

2 SENATOR DeFRANCISCO: But they won
3 a national championship since, so I want to be
4 clear on that.
5 Secondly, I'm glad the three former
6 teammates of Senator Tedisco are here, because
7 all I hear about is his seven or nine records
8 that he set when he was there and all of this
9 stuff that he did.
10 So my name is John DeFrancisco. If
11 you send a letter to the Capitol, Senator John
12 DeFrancisco, I want to know some other stuff so
13 that I can discuss this issue with him about his
14 expertise in the game of basketball with a little
15 bit more detail.
16 (Laughter.)
17 SENATOR DeFRANCISCO: However, with
18 all that said, congratulations. Being a member
19 of a championship team is just the most
20 incredible thing in the world. You will be
21 friends forever. Your stories will be
22 embellished. Each year they get more and more,
23 just like Senator Tedisco.

1 that, because that's part of the fun of winning a
2 championship.
3 So congratulations, and best in
4 everything you do.

6 Madam President. I rise for the purposes to
7 speak on this resolution.
8 You know, every year a different
9 theme is selected, and this year's theme for our
10 National Day of Prayer is "For Your Great Name's
11 Sake! Hear Us ... Forgive Us ... Heal Us." The
12 theme is from Daniel 9:19.
13 You know, in the upcoming 66th
14 Annual National Day of Prayer, millions of
15 Americans will join together and pray together at
16 thousands of events that are held across our
17 great nation. Prayer has always been an
18 important part of our heritage, our history, and
19 our national identity.
20 The National Day of Prayer is a
21 tradition that was first proclaimed by the
22 Continental Congress in 1775. And then in 1983,
23 in Marsh v. Chambers, the United States Supreme
24 Court affirmed the right of state legislatures to
25 open up their sessions with a prayer -- a proud,

1 honorable tradition that we carry forward here in
2 the New York State Senate.
3 By observing the National Day of
4 Prayer in New York on May 4, we acknowledge our
5 blessings and express our profound gratitude for
6 them. We can ask that God hears us, forgives us,
7 and heals us, and help strengthen our religious
8 and moral values in our state and in our nation.
9 Thank you, Madam President, and my

19 And this bill, Kendra's Law, was
20 first enacted several years ago in honor of
21 Kendra Webdale, who grew up in Fredonia,
22 New York.
23 She was on the platform and was all
24 of a sudden pushed in front of an oncoming
25 N train, and her life was ended that day. The

1 person who pushed her was Andrew Goldstein, who
2 had a long history of schizophrenia.
3 And her family worked tirelessly to
4 get Kendra's Law passed. And since that time it
5 has provided so much support, so many positive
6 things to people who have severe mental illness,
7 because it allows for a court-ordered mechanism
8 for people with serious mental illness to get
9 assisted outpatient treatment.
10 And this is an extraordinarily
11 important bill because study after study has
12 proven that Kendra's Law has decreased
13 homelessness, decreased violence, decreased
14 suicide, and really put people on a much better
15 path toward a better quality of life.
16 So, Madam President, I vote aye and
17 I encourage all of my colleagues to vote aye
18 also.

1 I want to thank the sponsor for her
2 bill and her explanation.
3 I am not opposed to the goals of
4 Kendra's Law, but I am very concerned that having
5 implemented it X number of years, and now this
6 bill would make it permanent, we haven't
7 completed the assignment. Unfortunately, there
8 isn't yet research showing us that coercive
9 assisted outpatient treatment is effective.
10 And unfortunately, we are seeing
11 over and over again -- particularly in the City
12 of New York, where that terrible incident did
13 happen -- larger numbers of people with mental
14 illness who are homeless on the streets who are
15 not getting the kinds of services we should be
16 requiring -- and that I believe, if they were
17 included in this bill, I could support. Issues
18 such as assuring that people being released from
19 our prisons, our jails, our state programs, would
20 be guaranteed both access to immediate Medicaid
21 to cover mental health services, access to
22 outpatient mental health care, and of course
23 housing. Because if you are mentally ill and
24 left on the streets homeless, you know things are
25 going to go wrong.

1 So I respect that the goal here is
2 both to assure that people with severe mental
3 illness -- and of course the vast majority of
4 mentally ill people are not violent to themselves
5 or others. But that percentage of severely
6 mentally ill people in the State of New York are
7 still desperate for the kinds of services and
8 access to health insurance that would make it
9 more likely that they could be taken care of and
10 that we wouldn't see the incidents that
11 unfortunately, despite the existence of
12 Kendra's Law, we see.
13 So I will vote no and continue to
14 hope that we, working together, can move forward
15 with the kinds of programs, services, and
16 legislation that truly address the problems we're
17 seeing.
