5 Mr. President.
6 Mr. President, I am proud to welcome
7 back to the Senate chamber and honor today with a
8 New York State Senate resolution, from my alma
9 mater and the 49th Senatorial District, the Union
10 College Men's Basketball Team.
11 If you're thinking to yourself
12 didn't you recently honor the Union College Men's
13 Basketball Team, you'd be absolutely right.
14 That's because this is the second year in a row
15 we've brought Union in, as they are repeat
16 Liberty League champions and NCAA participants.
17 Union defeated Skidmore College in
18 Saratoga Springs by a score of 82 to 65 in the
19 2018 Liberty League championship game held on
20 February 25th at Bristol Gym in Geneva, New York.
21 The victory earned Union College an automatic bid
22 to the school's fifth NCAA Division III Men's
23 Basketball Tournament.
24 In the tournament, the Union College
25 Dutchmen advanced to the NCAA Division III round

1 of 32 following a first-round victory over the
2 New Jersey City University Gothic Knights, before
3 a hard-fought loss to Plattsburgh State in
4 Round 2. And I was at that game, and they gave
5 everything they had. It was a very good team.
6 But that's an unbelievable event to get to the
7 second round of the NCAAs.
8 Union finished the season with an
9 overall record of 19 and 9. The whole season
10 represented an outstanding team effort by a
11 clearly well-prepared-and-coached group of
12 athletes. Senior guard Kevin Weckworth earned an
13 invitation to the 2018 Reese's NCAA Division III
14 All-Star Game in Virginia.
15 As an alum and former basketball
16 player at this great institution, it gives me
17 great pride to see the program flourishing. And
18 I think we'll see returning appearances in our
19 Senate of these outstanding athletes and our
20 Union College Men's Basketball Team.
21 In addition to the members of the
22 team, with us today are the school's coaches --
23 and I wish they would all stand up, the coaches
24 and the team, if we could see who they are up
25 there -- Head Coach Chris Murphy, Assistant Coach

1 Nick Ciresi, Volunteer Assistant Coach Mark
2 Traynor, and Sports Information Director Ross
3 LaDue. And the team captains are Greg King and
4 Matt Liquori.
5 Mr. President, please welcome to the
6 Senate chamber and congratulate the 2018 Liberty
7 League champions and the NCAA Tournament
8 participants, the Union College Men's Basketball
9 Team. And I'd ask you to extend them all the
10 cordialities of this august body.

16 SENATOR RANZENHOFER: Yeah, the
17 purpose of this bill is to expand the current
18 regulations concerning protocols for concussions
19 suffered by public school students to nonpublic
20 school students.
21 SENATOR KLEIN: Can the sponsor
22 yield for a question?
23 SENATOR RANZENHOFER: Absolutely.
24 ACTING PRESIDENT GRIFFO: Senator

1 SENATOR KLEIN: What is the genesis
2 of this legislation, I guess the local concern
3 for this bill?
4 SENATOR RANZENHOFER: Well, there's
5 a local concern and a state concern and actually,
6 quite frankly, a national concern. Everybody has
7 read a lot about concussions in the NFL, which is
8 where --
9 SENATOR KLEIN: I'm sorry,
10 Mr. President, I can't hear the response of the
11 sponsor of the bill.
12 ACTING PRESIDENT GRIFFO: I'd
13 ask -- I know we have a number of members coming
14 in and out of the chamber. I'd ask, if there's
15 conversations, they be taken outside the chamber
16 so that members can hear each other and exchange.
17 Senator Ranzenhofer, would you
18 continue to explain to Senator Klein?
19 SENATOR RANZENHOFER: Yeah, I'll
20 start from the beginning because of the noise in
21 the chamber.
22 Not only is this a local concern and
23 a state concern, but obviously everybody has read
24 a lot about concussions in the NFL. But when you
25 draw it down to the local level, what is actually

1 happening in public schools, the same rule does
2 not apply to nonpublic schools.
3 The public school rule is a good
4 rule. It's something that we all as legislators
5 support, it's state law, and feel that this
6 protection for our kids and our students should
7 be applied across the board to nonpublic schools
8 as well.
9 SENATOR KLEIN: Again through you,
10 Mr. President, would the sponsor agree to yield
11 for a question?
12 SENATOR RANZENHOFER: Yes, I will.
13 ACTING PRESIDENT GRIFFO: The
14 Senator yields.
15 SENATOR KLEIN: Can the sponsor lay
16 out, I guess, what the protocols presently are in
17 public schools that you want private schools to
18 adhere to?
19 SENATOR RANZENHOFER: Those are in
20 state law. And I'm happy to have a discussion
21 with you, but the purpose of the bill is to apply
22 those same protections across the board to all
23 schools.
24 SENATOR KLEIN: Again through you,
25 Mr. President, if the sponsor can just explain

1 what those special protocols are that public
2 schools are supposed to adhere to. Because
3 again, I don't have a bill memo in front of me,
4 unfortunately, because this bill was just pulled
5 out.
6 SENATOR RANZENHOFER: And this bill
7 memo would not help you.
8 But there is a law right now in
9 state public education dealing with what those
10 protocols are. And simply, to Senator Klein,
11 this bill would apply those same protocols to
12 nonpublic schools.
13 SENATOR KLEIN: Thank you,
14 Mr. President. I have no further questions.
15 SENATOR RANZENHOFER: Thank you.

17 Mr. President.
18 First I rise to thank my colleague
19 Senator Ranzenhofer for bringing this bill to the
20 floor of the State Senate.
21 And it just -- it strikes me,
22 Mr. President, this is what people hate around
23 the state about what goes on in politics. It's
24 sickening, it truly is, that we would put
25 politics -- some would put politics above health,

1 some would put politics above safety, that people
2 would look at an issue like this dealing with
3 brain injury, brain injuries to young people in
4 our state, and they would say we have an
5 opportunity here politically, because of the
6 numbers, so we can game this. We can make a
7 mockery of justice. We can say to hell with
8 safety, to hell with the kids.
9 And you know what? I know this to
10 be true. I know that many of my friends across
11 the aisle there, if you were to ask them do you
12 think this is a good bill -- and I won't name who
13 I know they are -- they would tell you this is a
14 very good bill. They would tell you, yes, I do
15 care about children. Yes, I do believe we should
16 protect children from concussions. They would
17 tell you that.
18 But instead, because of politics,
19 they vote no. On a bill that if you asked them
20 what they think on the merits, they would tell
21 you it's a good bill.
22 And I think it's disgraceful. It's
23 precisely what's wrong with politics in America.
24 I vote aye, Mr. President.

5 Mr. President.
6 I have been in this chamber about
7 eight years now, and this is the first time in
8 eight years I have had a bill presented to me
9 with absolutely no notice, not knowing what it
10 is, what's in it, or that it's coming to the
11 floor.
12 So if my colleagues want to talk
13 about what's disgraceful, let's talk about the
14 fact that they are concerned they don't have the
15 votes to pass a single thing in this chamber, and
16 their answer to that is to jam us with things
17 that we have no idea, we haven't had a chance to
18 read, talk about, discuss as a conference or
19 deliberate as a democratic body would be. And I
20 mean democratic with a small D.
21 So let's -- Senator Lanza is
22 correct. Let's stop the shenanigans, let's stop
23 the politics. A democratic institution is
24 supposed to be controlled by whoever has the most
25 votes after discussion, debate and deliberation.

1 You want to do it right? Tell us what we're
2 voting on, and we'll come out here and discuss it
3 and vote on it. Not this nonsense that's going
4 on today.
5 So we know who's -- we know who's
6 playing politics here. We know who's trying to
7 act responsibly. The majority is trying to avoid
8 taking votes on things they don't want to be
9 known where they stand. And their answer is to
10 throw bills at us that we don't even have the
11 opportunity to discuss or know what's happening.
12 That is what's disgraceful,
13 Mr. President. I vote no.

17 SENATOR DeFRANCISCO: Yes, that's a
18 point well-taken. This list that I'm reading
19 from is really the list that was the active list
20 that was on the calendar yesterday. And
21 everybody had that on their desks well before
22 session. We didn't add any bills to that list.
23 So for further information, the next
24 bills we're going to take up are the ones we gave
25 notice of for yesterday.

5 I'm going to remind members, I'm
6 going to keep you to the two-minute explanation,
7 too.
8 SENATOR SAVINO: I will do my level
9 best, Mr. President.
10 I have been a member of this chamber
11 for 14 years now, and I have tremendous respect
12 for the institution, I have genuine affection for
13 the majority of the members in this chamber. In
14 fact, I could say I might actually have genuine
15 love for some of them, including my good
16 colleague Senator Lanza.
17 But for any of us to pretend that
18 politics doesn't exist in a political body is
19 somewhat disingenuous. Politics exists here
20 every day. So let's not pretend to be outraged
21 by it.
22 What we should be outraged by is
23 that yes, in fact, politics does exist. And if
24 you want to get outraged by some of us using
25 politics to block a piece of legislation that

1 might have something to do with health, then we
2 should be equally outraged by the fact that
3 politics has blocked the effect of delivering on
4 women's health and wellness here in this chamber
5 for every year that I have been a member of the
6 New York State Senate.
7 So if we want to put aside politics
8 and address the issues of good pieces of
9 legislation that affect health, we can pass the
10 Reproductive Health Act and we can pass the
11 Contraceptive Coverage Act, and we can do it
12 jointly together with mutual affection for one
13 another and respect for this institution.
14 I vote in the negative on this bill,
15 but I still do so with an admiration and
16 affection and genuine love for some of you.

21 SENATOR KRUEGER: I'd like to
22 perhaps just rephrase my colleague Diane Savino's
23 comments.
24 I don't think we come up here for
25 love or affection. Whatever we do is our own

1 business privately. But we do come up here to
2 participate in a democratic process, which of
3 course is a political process.
4 And the highlight today is, because
5 this chamber refuses to allow a vote on the
6 health and safety of women in this state, we take
7 objection to other bills being moved when a
8 simple amendment to attempt a vote on
9 reproductive health is stymied and stopped and
10 even the lights are turned off and we leave with
11 nothing happening.
12 That is what is unacceptable, not a
13 no vote as a protest over the fact that important
14 bills don't get the chance to be voted on.
15 No guarantee any of our bills will
16 pass if they are brought to the floor. That's
17 not what the people expect of us. They expect us
18 to debate, deliberate and take votes on
19 legislation. And when one-half of this house's
20 bills are not given the same respect and
21 opportunity as the other half, that's politics,
22 and that's what's wrong.

6 I rise for two reasons. One is that
7 I'm just astounded that a bill that has gone
8 through committee that was on the calendar
9 yesterday, and everybody in their respective
10 caucuses had an opportunity to discuss this very
11 bill, this was the number-one bill on the
12 calendar yesterday -- but for a member of the
13 Senate, on the Senate floor, to stand up and say
14 they were not prepared for the bill that was on
15 the calendar yesterday, where there was full
16 opportunity to discuss, so it's been here for
17 24 hours, to make an admission of not being
18 prepared is just astounding.
19 But more importantly, I don't know
20 how a member of the Senate goes back to their
21 district, and when they're talking to a mom or a
22 dad in their community and their child goes to a
23 private school or Catholic school or yeshiva, and
24 they tell the mom that, you know, we wanted to --
25 we were trying to pass some legislation that

1 would protect your child if he gets a concussion
2 playing soccer or if she gets a concussion
3 playing soccer, or if they have a football game
4 and they can get a concussion -- because I've had
5 children that have participated in sports and
6 have had concussions -- how do you tell that mom
7 or dad that I voted no, I voted against allowing
8 your child to have the same protections as a
9 child that's going to another school in the
10 community because of a greater political reason
11 or a debate on another bill?
12 How do you tell that to a mom or
13 dad, that I don't care about your kid? I mean,
14 we're supposed to care about people, and
15 especially our kids and our grandkids. How do
16 you look into the mom's eyes and say I just don't
17 care about your kid and that's why I voted no?
18 Mr. President, I vote aye.
