11 congratulating Ulyses Jackson upon the occasion
12 of celebrating his 103rd birthday.

15 SENATOR SANDERS: Thank you,
16 Mr. President.
17 This is a day and age where, if we
18 live 10 years, we've done well; 20 years, we're
19 ahead of the loop; 30, 40, 50, around average.
20 But if we live to 103 years, we've seen some
21 things. We've seen a nation that has fought
22 several wars. We've seen a nation that has had a
23 black president. We've seen some things on that
24 journey.
25 And today we are saluting Ulyses

1 Jackson for living to 103 years. Now, I just
2 want to know what his secret is, and I'm trusting
3 that before long, someone is able to tell me.
4 But --
5 (Baby cries out.)
6 SENATOR SANDERS: I agree with you
7 totally.
8 (Laughter.)
9 SENATOR SANDERS: You've heard the
10 secret of 103 years just then.
11 But not simply to live 103 years,
12 but to participate. Mr. Jackson was a veteran,
13 and that means something in this hall -- a
14 veteran of the U.S. armed forces, where he stood
15 against tyranny and had his moment to say that we
16 would not go backwards. And that should be
17 applauded.
18 I could say some things about
19 Mr. Jackson and his love -- and his brother and
20 his love of Cab Calloway and the dancing that
21 they did. But I'm scared that it may inspire
22 Mr. Jackson to get out there and start dancing
23 again. Though that might be interesting to see,
24 at 103 we might not want that.
25 Now, today we are joined by several

1 generations of Jacksons. We're really -- and I'm
2 hoping that you figure out how to take these
3 103 years, the 103 years where he showed that he
4 was not simply an American citizen, but an
5 American citizen of an outstanding nature.
6 I hope that he inspires every
7 generation. I'm glad that you brought the
8 youngest Jackson. Is this a young Jackson too?
9 Oh, all right, I'm glad that you brought her here
10 to this great place where we are honoring her
11 grandfather, I believe, in a day like this. I
12 see her shaking, shaking. You know, I'll turn
13 over this way, then.
14 I hope that she understands that in
15 the State of New York, we honor such heroes,
16 heroes that have done amazing things not simply
17 for the country, but for family too, which is
18 also an important trait, where we want to
19 ensure -- now, sadly, Mr. Jackson was not allowed
20 to come out here today. We might have -- that
21 would have been interesting, but some other minds
22 said that they wanted to make sure that he is
23 safe and secure.
24 But his family came out in big time.
25 His daughter, I suspect granddaughter -- and

1 great granddaughter? My goodness. We have
2 several generations.
3 Just one question for the youngest,
4 and then I'll stop. Are you going to join the
5 Army?
6 (Laughter.)
7 SENATOR SANDERS: Tell me that you
8 want to be a good Marine. I'll take that as a
9 yes.
10 (Laughter.)
11 SENATOR SANDERS: You heard it
12 first, my friends.
13 So, Mr. President, I am really glad
14 that we were able to grab the generation of
15 Ulyses, a name surrounded by mythology itself,
16 that we were able to bring them out to this great
17 place, Albany, and stand before this entire body
18 and understand that we honor the 103 years --
19 (Baby cries out.)
20 SENATOR SANDERS: Yes, we do. We
21 honor the 103 years. And not only that, we want
22 him to have another 103 years. Mr. President, I
23 don't know if you can order that, that he can
24 have another 103 years. But if you can, I would
25 appreciate not only you doing that, but giving

1 them the honor and the recognition that they
2 deserve from this body.
3 And I thank you very much,
4 Mr. President.
5 ACTING PRESIDENT GRIFFO: Thank
6 you, Senator Sanders.
7 I think if we just lifted our heads
8 and looked up, we might ask for those blessings
9 for another 103 years, that they be bestowed upon
10 Mr. Jackson.
11 I think I heard the young lady also
12 say "Air Force," Mr. Sanders, so I'm not sure.

15 to congratulate Mr. Jackson on the celebration of
16 his 103rd birthday. It's truly a milestone.
17 We extend our best wishes to the
18 family who are assembled here today. Thank you
19 for being here. We extend the privileges of the
20 house to you. We also extend our best wishes for
21 good health, continued health, and God's
22 blessings. Thank you very much.

21 congratulating Ignazio Terranova upon the
22 occasion of his retirement after many years of
23 dedicated service to the New York City Department
24 of Sanitation.

2 SENATOR SEPĂLVEDA: Thank you,
3 Mr. President.
4 Today I stand to celebrate the
5 retirement of a person who embodies what a true
6 public servant should be. He dedicated 20 years
7 of his life to the City of New York, dedicated
8 20 years of his life to the Department of
9 Sanitation, and rose through the ranks of
10 different capacities.
11 Iggy Terranova -- as we call him
12 Iggy -- was born in Ribera, Italy. And because
13 his parents didn't know very well, they raised
14 him in Queens rather than the Bronx.
15 (Laughter.)
16 SENATOR SEPĂLVEDA: But Iggy, as I
17 said, has been a great public servant and the
18 pinnacle of his career was when, in 2005, he rose
19 to the rank of supervisor in the Department of
20 Sanitation, where he became one of the heads of
21 the Community Affairs Office.
22 In that capacity, Iggy has helped so
23 many public officials, has helped so many
24 communities, has created engagements and events
25 for our youth, for our community, has helped

1 myself, and I know there are other people on this
2 floor who he has helped, throughout his years of
3 service, with minimal or large issues involving
4 sanitation in the City of New York.
5 At one point Iggy was a supervisor
6 to my son, who is here today, who came to
7 celebrate this momentous occasion for
8 Mr. Terranova. His wife is also here today to
9 celebrate this recognition and this
10 congratulations.
11 Iggy, you are a true great American.
12 You are a true great person. You will be sorely
13 missed in the Department of Sanitation and as a
14 public servant in the City of New York. You will
15 be sorely missed by myself, my family. Please
16 remain engaged in community service, and I hope
17 to see you in community service in other
18 capacities in the future.
19 So I want to congratulate you today,
20 and I want to ask the President to offer him the
21 cordialities of the house and congratulate him
22 for the wonderful work that he's done in that
23 illustrious 20-year career that he provided for
24 the City of New York.

2 Senator Klein.
3 SENATOR KLEIN: Thank you,
4 Mr. President.
5 I want to join my colleague
6 Senator SepĂșlveda in congratulating Ignazio --
7 otherwise known as Iggy -- Terranova on his
8 20-year service to the New York City Department
9 of Sanitation.
10 You know, when someone does public
11 service well, it has an impact on so many people.
12 And over the years I came to rely on Iggy to help
13 my constituents on a whole array of various
14 issues. No problem was too big or no problem was
15 too small.
16 We also share a fondness for the
17 same restaurant in the Morris Park section of the
18 Bronx, in my district. And I see Iggy so much in
19 the Bronx doing his job, I actually thought he
20 lived in the Bronx. I didn't know that he
21 actually lives in Astoria, Queens.
22 But he's somebody that's very
23 special. The only thing is I wish he could stay
24 on another 10 years and retire a 30-year career.
25 But we're going to miss him, and we congratulate

1 him for a job well done for the New York City
2 Department of Sanitation, as sort of the
3 ambassador to elected officials in the community.

6 Comrie.
7 SENATOR COMRIE: Thank you,
8 Mr. President.
9 I wanted to lend my voice to those
10 members that are celebrating and applauding Iggy
11 Terranova on his 20-year retirement. I just
12 found out when I walked in the chambers that he
13 is retiring.
14 But everything that my colleagues
15 have said is true. He was a person that you
16 could depend on to defuse hostility at a
17 community meeting. His gregarious attitude, his
18 love of the job, his ability to express his
19 opinion on exactly what was going on so that
20 people understood it was infectious. It made a
21 hostile meeting a simple meeting. It made a
22 difficult issue an issue that everybody could
23 understand. It made problems with snow removal
24 in Queens go away, because he was focused on
25 getting solutions done and being honest with

1 people.
2 He will be missed as a public
3 servant. His style and his manner is infectious.
4 And I would hope that we have other people that
5 serve as well in public service, and especially
6 in the Department of Sanitation, which can be
7 contentious, such as Iggy Terranova.
8 So I wish him a happy, healthy, long
9 retirement, but I need him to stay in Queens. I
10 don't want him to go anywhere. You've got to
11 stay here in the borough so that you can continue
12 to show the next generation of people how to be
13 good public servants.
14 Congratulations.

19 SENATOR GIANARIS: Thank you,
20 Mr. President.
21 New York City is full of
22 distinguished characters and people that leave an
23 impression. Iggy Terranova is certainly one of
24 them. I think any of us that have dealt with the
25 Department of Sanitation and have been fortunate

1 enough to have him represent that agency have
2 been impressed by not only his skill and his
3 ability but by his outsized personality as well.
4 And the fact that he lives in
5 Astoria and is within my district is something
6 I'm also proud of.
7 I would just say while there are
8 great restaurants in Morris Park and other parts
9 of the city, there's no place like Astoria for
10 good eating. And I think I'll have to ask Iggy
11 where his favorite restaurant is in his home
12 neighborhood so we can go there together.
13 Thank you, Mr. President.

15 you, Senator Gianaris.
16 As noted, the resolution was

18 On behalf of the Senate, we want to
19 extend a warm welcome to your entire family,
20 Mr. Terranova, for being here today. I think the
21 youngest member was really excited about being in
22 the chamber.
23 And we want to extend again our
24 congratulations on a distinguished career of
25 public service to the citizens of the City of

1 New York in a very challenging field. But from
2 everything we've heard today, you've done that in
3 an extraordinary manner with great dedication and
4 commitment to the people that you served
5 throughout your career.
6 So we extend our best wishes to you
7 and your family. We welcome you to the chamber.
8 And we hope that you have many, many happy,
9 healthy years in retirement. God bless you.

22 memorializing Governor Andrew M. Cuomo to
23 proclaim June 2018 as Immigrant Heritage Month in
24 the State of New York.

2 SENATOR RIVERA: Thank you,
3 Mr. President.
4 As I've said many times on the floor
5 of the Senate before, I have a very diverse and
6 beautiful district. I have individuals in my
7 district -- I represent probably more Dominicans
8 than any other state legislator in the country.
9 I have a growing Mexican community. I have some
10 Bangladeshis, some folks from Ghana and other
11 West African countries, the Garifuna community.
12 This diversity makes my district
13 beautiful. And it is -- every day, when folks
14 come into my office, whether it's to ask for
15 assistance or whether it's just to pay us a
16 visit, I see the rainbow, if you will, of
17 humanity coming into my district office. And I
18 thank them for being there. I thank them for
19 making the Bronx a little bit better and the
20 United States a little bit better.
21 And so this resolution today is to
22 celebrate Immigrant Heritage Month. But I would
23 be remiss if I did not at this time that we are
24 saying that we stand here -- I stand here to
25 celebrate immigrant communities that are in my

1 district that make our state and my district
2 great, it would be intolerable for me not to
3 mention the horrors that happened, that are
4 happening right this second within our country.
5 If we are here to celebrate
6 immigrant heritage in this country, immigrant
7 heritage in our state, we must at the same time
8 acknowledge what the administration of this -- in
9 DC is doing against immigrant communities.
10 What's happening right now is a moral test of our
11 character as a nation. If we're going to stand
12 on this floor and say that we celebrate all the
13 immigrants that make our particular districts
14 great, then we should also stand up and say, in a
15 loud voice, in a clear voice, that right now in
16 our name this country is ripping families apart.
17 It is destroying them.
18 This is your moment. This is our
19 moment. We stand and celebrate the folks that
20 are parts of our districts, certainly, but we
21 also must remember those who we don't see often.
22 They're not in air-conditioned Senate rooms,
23 they're in the desert running away from death
24 squads. And what are we doing as a country? In
25 the State Senate, we're celebrating these folks

1 with this resolution. And across the country,
2 thousands of miles from us, families are being
3 ripped apart.
4 This is a moral test as individuals,
5 as elected officials, as a country. And so I ask
6 all of you to not only support this resolution --
7 which is easy enough to do. It's in the
8 abstract, just signing a piece of paper and
9 saying that we celebrate those folks who live in
10 our districts who are -- who make our districts
11 and our country and our state great. But I ask
12 you to take an extra step and say very clearly
13 that what this country is doing in our name is
14 criminal, it is cruel, it is inhumane, it is
15 unjust. We must ask it to stop.

19 SENATOR SEPĂLVEDA: Thank you,
20 Mr. President.
21 I too want to rise to speak -- first
22 of all, to congratulate Senator Rivera on this
23 resolution.
24 But I too would be remiss if I
25 didn't discuss or mention the heartless

1 atrocities, the ripping of families, the behavior
2 of our federal government destroying families
3 that have come here looking for a better life.
4 Individuals that are looking for nothing but for
5 asylum because they fear death squads in their
6 country.
7 And to see mothers, fathers suffer,
8 and to see children, to hear audio recordings of
9 children crying in desperate fear because their
10 parents are being taken away from them, to see
11 mothers crying because their children are being
12 yanked away from them.
13 We are in a period now in this
14 country where we are testing our morality. We
15 are in a period of our country where people will
16 look at us, where generations in the future will
17 look at us and say, How did we allow this to
18 happen?
19 We have people that are criticizing
20 this policy -- a policy that our current
21 president can put at rest in five minutes, but is
22 trying to blame others -- a policy that an
23 attorney general and the head of homeland
24 security are pushing to try to get a better deal
25 in terms of an immigration bill at the federal

1 level. And it's a shame. It is heartless.
2 When you have religious leaders like
3 the pope, the cardinal, bishops, people of all
4 walks of life, First Ladies from Mrs. Bush to
5 Mrs. Obama to even, to some degree, Melania
6 Trump, criticizing a policy that no matter how
7 you look at it, no matter how you try to justify
8 it, at the end of the day is cruel and heartless.
9 It is something that I think in the annals of
10 history will be compared to decisions by the
11 Supreme Court like Dred Scott, Plessy, and
12 certainly the internment camps during the
13 Korematsu decision.
14 This is not what this country should
15 be about. This country was built on the backs of
16 immigrants, and we should be celebrating their
17 contributions to this country and not trying to
18 rip families apart the way we've been seeing for
19 the last couple of weeks. It is a shame that we
20 are allowing this to happen. We should all stand
21 up and protest against this, be it Republican, be
22 it Democrat, regardless of race, color and creed.
23 This is inhumane, and we should all stand up
24 against it and take a strong stand, because that
25 is not what the United States of America is

1 about.

9 SENATOR DeFRANCISCO: I'm just -- I
10 just would like to stand up, I know there's a
11 couple more speakers, and this could get into a
12 debate that is going to consume the balance of
13 the two days of the session.
14 So I would just request that if
15 you're going to speak on the bill, to confine it
16 to the topic of the bill. And the more -- the
17 least political it is, the better, so we don't
18 have responses and sur-responses and go on ad
19 infinitum.
20 So I'm just making a plea. You're
21 all Senators, you've all got the right to speak.
22 But hopefully we can follow a rule similar to
23 what I just tried to express.

2 SENATOR BAILEY: Thank you,
3 Mr. President.
4 "The ultimate measure of a man is
5 not where he stands in moments of comfort and
6 convenience, but where he stands at times of
7 challenge and controversy." Martin Luther King,
8 somebody who we like to quote on both sides of
9 the aisle.
10 And I commend Senator Rivera for
11 this resolution. Immigrants are incredibly
12 important, and we are a nation of immigrants.
13 Immigrants are what make my district incredible.
14 From the West Africans in the western portion of
15 my district, to the Caribbean-Americans in the
16 Northeast Bronx, to the folks from Latin America
17 and South America and everywhere else in the
18 world, in the 36th Senatorial District immigrants
19 make my district great.
20 And I understand the concern about
21 making this overly political. But I must say, as
22 a father and as a Senator, I found it incredibly
23 difficult to listen to those recordings with
24 those children pleading for their families.
25 The ball is in our court. This

1 isn't about politics. This isn't where you stand
2 on what side of the aisle. This is about doing
3 what's right. Immigrants are people like anybody
4 else. I will say nothing further.

8 SENATOR ALCANTARA: Thank you,
9 Mr. President.
10 I want to thank my colleague Senator
11 Rivera for bringing this resolution. As an
12 immigrant from Latin America, for me it's an
13 honor to be here celebrating the contributions
14 that immigrants have made to this country -- not
15 just to the State of New York, but to the entire
16 country.
17 I wear this shawl quite often on the
18 Senate floor, and that was made in Mexico, in
19 MichoacĂĄn, Mexico, to remind myself and my
20 colleagues of the contributions that
21 immigrants have made to the United States. And
22 at a time that immigrant communities from Mexico,
23 Central America, and Muslim immigrants I feel are
24 under attack by our current administration, I
25 wear this with pride. Because anyone that sees

1 this shawl, you can see that this was made in
2 Latin America by indigenous people.
3 And I hope that as we sit here and
4 we celebrate the contribution of immigrants that
5 came before us, whether they were the first
6 African slaves that were forced into immigration
7 here, or they were Jewish fleeing the European
8 regime, or Italians and Irish that came because
9 of economic reasons, I would like to remind my
10 colleagues that Latin American immigrants, or
11 immigrants from anywhere, they come to America
12 for the same reasons that your parents did: To
13 work, and for a better life.
14 And as we are celebrating Immigrant
15 Month, let's celebrate -- also let's remember the
16 123,000 farmworkers that pick the food that we
17 eat every day in the State of New York, that make
18 the thriving agricultural economy in New York
19 what it is. And let's remember that our
20 farmworkers also need justice, that the car wash
21 workers -- who are immigrants -- also need
22 justice.
23 And I would like us to remember,
24 like my colleagues have said before, that right
25 now the Statute of Liberty sits there welcoming

1 everyone. Unfortunately, under our current
2 administration, if you are a black or brown
3 immigrant or a Muslim, you don't feel welcome in
4 this country. And we should remember that this
5 country was built on the backs of African slaves
6 that were brought here in forced immigration, and
7 that this country today thrives on the poor and
8 cheap labor that is provided by immigrant
9 workers.
10 Immigrants don't come here to commit
11 crimes, like some of us like to pretend.
12 Immigrants come here to do the job that a lot of
13 people in this country don't do. Immigrants come
14 here for the same reason that some of your
15 ancestors did, to work and make a better life.
16 In the name of all the immigrants in
17 the State of New York, we should celebrate
18 them -- not just by standing here and speaking on
19 Immigrant Month, but by doing justice, by passing
20 laws and bills that affect everyday Americans,
21 especially American immigrants. {In Spanish}

1 I also rise to commend my colleague
2 Senator Gustavo Rivera for bringing this
3 important resolution today, and to remind
4 everyone pretty much all of us are immigrants or
5 the children or grandchildren or
6 great-grandchildren of immigrants in this room
7 today.
8 And this country can never forget
9 that an open policy of welcoming immigrants
10 fleeing danger in their homeland, fleeing abuse,
11 fleeing war, is in fact the entire history of
12 this country. I am the grandchild of people who
13 fled the pogroms in Eastern Europe pre- and
14 post-czars, I am the relative of people who fled
15 the Nazis before World War II, and I am the
16 relative of family who survived the Nazis and got
17 here after the war.
18 It is fundamental to this country to
19 remember our history of being the refuge for
20 immigrants from around the world, and it is the
21 only guarantee of a successful and democratic
22 future for this country. So thank you for the
23 resolution and reminding us all about the role of
24 immigration and immigrants in all our lives.

16 the books and then say that law enforcement
17 cannot enforce them. So this is not one
18 political party or another. This issue has been
19 an issue for 20 years. And it's incumbent for
20 both Republicans and Democrats in Congress to
21 change the law so it's workable and fairer to all
22 parties.
23 And I think enough has been enough;
24 now it's time for action. And hopefully the
25 recent efforts that are being reported, anyway,

1 are supported in some compromise bill that
2 becomes law that will resolve some of these very
3 critical issues that everyone is talking about
4 today.

5 I rise to oppose this legislation
6 because I believe it violates the First
7 Amendment's Establishment Clause, which prohibits

9 establishment of religion, not only from

11 prohibiting government taking actions that favor
12 one religion over the other.
13 This hymn -- and I don't know if my
14 colleagues on the other side of the aisle have
15 read the words -- specifically makes reference to
16 Christ by noting "the King and blessed One,"
17 "Thou David's royal Son," "Thee, Redeemer, King,"
18 and even more.
19 The point being that this is not
20 just a religious hymn, this is not just now
21 making a state hymn official, but it's also
22 making a state hymn a Christian hymn. And for
23 those reasons, I will be voting in the negative.

16 to the Paid Family Leave Act to include
17 bereavement. This I believe was an oversight
18 when we first passed the paid family leave
19 legislation, and it was brought to my attention
20 by a former colleague and constituent, Jennifer
21 Johnson, who lost her daughter Grace at the age
22 of a year and a half.
23 I want to thank Assembly Majority
24 Leader Morelle for his leadership on this as
25 well. Leader Morelle and I share something in

1 common, as do our wives, Mary Beth and Pat,
2 something that we would not wish on any parent.
3 Joe lost his daughter Lauren last year; I lost my
4 son Rich.
5 Those who have suffered similar
6 tragedy in their lives understand that there's no
7 timetable on grief. Everyone is different. I
8 went back to work right away. I tried to be
9 strong for my family at the time, and that's how
10 I thought I was going to get through this. About
11 a month later I was crushed by the emotion of it
12 all.
13 This amendment is going to give
14 people the time and the flexibility that they
15 need to grieve. It will not add time to the Paid
16 Family Leave Act; it will not cost more money.
17 But it will help people heal and regain their
18 strength and their focus as employees after the
19 loss of a loved one.
20 So I vote aye, and I thank my
21 colleagues very much for passing this important
22 bill.

5 growing problem in the State of New York. Back
6 in 2003, Senator Little and I did a report to the
7 Senate on tax-exempt lands in the State of
8 New York. At the time the amount of tax-exempt
9 lands was $340 billion. Today, 15 years later,
10 it's over $800 billion tax-exempt lands.
11 And why is that? Whenever you allow
12 something to be tax-exempt, the burden moves to
13 people who are paying the taxes on their homes.
14 What has happened over the last
15 30 years is that the courts have made very
16 liberal interpretations that any organization can
17 get easily tax-exempt status. And there's many
18 abuses. We're running now about one out of three
19 parcels are partially or all tax-exempt. It's
20 rising exponentially. It's not sustainable.
21 And when we try to do things to give
22 relief to property tax owners, we do it through
23 the STAR and enhanced STAR, but we're not paying
24 attention with respect to legislation. We've put
25 six bills together to bring in the reins of

1 abuses to the tax-exempt. New York City will not
2 touch it, the Assembly will not touch it because
3 tax-exempt problems are not a problem in New York
4 City. The problem is to the rest of the state.

25 I wanted to thank the sponsor for

1 introducing this bill that would require school
2 administrators to contact the parents or
3 guardians of students when bullying or harassment
4 has occurred. And it comes from the best
5 intentions.
6 Unfortunately, I'm going to have to
7 vote no, because I believe that this bill still
8 opens the possibility of outing, outing LGBT
9 students to their school administrators, to their
10 principals and, worst, to their parents. The
11 reason that's of great concern is that when
12 you're outed as a kid in a family, your family
13 may not be accepting. And in many instances,
14 sadly, those youth are more likely to be kicked
15 out of their homes than their heterosexual peers.
16 In fact, statistics show that LGBTQ youth are
17 120 percent more likely than their heterosexual
18 peers to experience homelessness.
19 So while I thank the sponsor again
20 for his efforts, I think that greater
21 consideration is needed on this very, very
22 complicated effort, and I'm regretfully voting in
23 the negative.

9 I just want to point out -- maybe
10 you might have read this article in the Post
11 yesterday. This is a woman who's purported --
12 her son was bullying another individual who, in
13 terms of diversity, identified himself as gay.
14 This is from the Bronx in New York. Now, her son
15 was stabbed several times, stabbed to death. And
16 she says: "'Myself and other parents didn't know
17 about all these cover-ups,' Ms. Dennis said. 'If
18 it was to be reported, we would have known what
19 steps to take as far as protecting our kids.'"
20 This is a gay child whose parents
21 were not notified of the bullying that took
22 place. So he took it into his own hands. The
23 bullier, also the parents weren't identified as
24 the one who was bullying.
25 So we want to protect all of our

1 children. And I don't know, I asked this in the
2 Assembly when I was in there trying to promote
3 this bill. Is there anybody in this room -- just
4 raise your hand, because I'd like to know that as
5 I explain my vote -- who would not want to know
6 if their child was being bullied in school or was
7 a bullier in the school? Just raise your hand so
8 we can identify who you are. I'd just like to
9 know that.

16 I also wanted to thank the sponsor
17 for his efforts but highlight that, despite his
18 question, there are any number of scenarios where
19 perhaps none of us in this room face them, but in
20 real life people do face them.
21 What if you are a bullier who's an
22 abused child? And the school knows about that
23 and yet has not been able to accomplish anything
24 to resolve it, so knows that doing a mandatory
25 report to the parents of the bullier will

1 probably result in violence towards the child.
2 They may have to balance that against trying to
3 deal with the problem in other ways rather than
4 notifying the parent.
5 There are any number of scenarios
6 where one wants perfect families with perfect
7 children coming out of them who can talk about
8 anything and parents always have the right
9 responses. But in real life, we all know that
10 isn't the story.
11 And if this bill had broader
12 flexibility for the schools to not simply do a
13 mandatory report in to the parents of the bullier
14 and bullied, but rather a broader set of options
15 that in fact could result in the best options for
16 both children or multiple children, I would be
17 much more open to it.
18 So I do appreciate the sponsor's
19 efforts. I know it comes from a place of concern
20 for children. But sometimes we look through only
21 the prism of our own lives where we imagine we
22 would of course always do the right thing and all
23 parents would always do the right thing -- and we
24 don't live in a world where that's the story.
25 So I vote no, Mr. President.

18 So as I read this bill, the
19 legislation would reduce New York City's general
20 property tax revenue by approximately $5 billion
21 annually. What would you suggest we cut out of
22 the city's budget, since we'd be cutting their
23 revenue by $5 billion annually?
24 SENATOR LANZA: Through you,
25 Mr. President. So I don't think that number is

1 even close to being correct.
2 Over the last 17 years, 16 years
3 since this has been implemented, it has resulted
4 in $4 billion of additional property tax revenue.
5 Divide that by 16, and you come up to something
6 less than $300 million a year.
7 But I think it's important,
8 Mr. President, in answering the question, that I
9 give the background to this legislation. And to
10 do that, I need to take you back to 2001 --
11 September, specifically, of 2001. And of course
12 we all know that was the month, the day, that
13 New York City was attacked by terrorists. Nearly
14 3,000 people lost their lives that day. A
15 disproportionate number of those were my
16 neighbors on Staten Island.
17 Only weeks, months later, that
18 tragedy, that attack was used as part of a
19 narrative to raise property taxes in New York
20 City. And in fact while I was there in the
21 City Council, the City Council enacted an
22 18 percent increase in property taxes, the
23 largest increase in the history of the City of
24 New York.
25 Now, the argument being made then

1 was that it was necessary as an emergency
2 measure -- notwithstanding the fact,
3 Mr. President, that George W. Bush, the president
4 at the time, immediately pledged more than
5 $20 billion in federal aid to the City of
6 New York. Which I might add, more than that
7 actually was delivered to the City of New York to
8 deal with the emergency.
9 I then in the City Council was one
10 of three members who voted no. The reason is
11 because even at that early age, life had taught
12 me to be a cynic. First, I thought the increase
13 was far more than was necessary to meet the
14 emergency. In fact, not even close, given the
15 $20 billion in federal emergency aid.
16 Second, I listened as member after
17 member in the City Council got up to explain
18 their vote. Some of those members are right here
19 in the chamber now. The mayor of New York City
20 right now, Mayor de Blasio, was one of those
21 councilmembers. And each member got up and said
22 that the only reason they were voting for this
23 historic increase in property taxes was because
24 it was an emergency and, more importantly, a
25 temporary measure.

1 Now, sadly, I didn't believe it
2 then, and the 16 years has proven me right. The
3 emergency has passed. Sixteen years is far
4 longer than any interpretation of the word
5 "temporary." And in fact, New York City has a
6 huge tax surplus. Which, to explain to the
7 people back home, means that the money you work
8 hard for every year to support your family, a
9 chunk of which the city takes from you, well,
10 they've taken too much.
11 So I think after 16 years it's time
12 to make the City Council and New York City an
13 honest group of people. And that's the purpose
14 for this legislation. The emergency has passed.
15 For all those who said it was temporary, I'm
16 trying to make honest people out of you.
17 SENATOR KRUEGER: Through you,

24 esteemed colleague knows, the power to tax is a
25 power vested in the State of New York, this body,

2 necessary for the State Legislature to vote that
3 increase, and it's necessary for the State
4 Legislature to remove that temporary emergency
5 measure that was passed 16 years ago.

15 Here's my position. We say we
16 respect local rule. We say we respect the
17 concept that municipalities and counties have
18 certain rights that are provided to them under
19 state law. Except, it seems, when it comes to
20 this tiny little town called New York City, which
21 apparently is incapable of using their own City
22 Council, mayor, borough presidents, public
23 process, to make their own decisions for
24 themselves.
25 I wasn't in the City Council in

1 2001. I wasn't in any elected office. But the
2 fact that something was done in 2001 and called
3 an emergency doesn't mean that 30, 40, 50 other
4 things didn't happen between 2001 and 2018 that
5 have resulted in the City of New York needing the
6 amount of revenue they receive from their
7 property taxes.
8 Trust me, everybody yells about
9 their property taxes at home, and local elected
10 officials know that. But the concept that Albany
11 would say, We're going to order you to reduce the
12 one source of revenue you actually, in theory,
13 have control of yourselves and we're going to use
14 as an argument that back in 2001 a couple of us
15 didn't think it was a great idea when it was
16 passed by the City Council, and we're not in the
17 City Council anymore, but maybe we can use our
18 authority up here in Albany to dictate to the
19 City Council and the mayor what they ought to do
20 in 2018 and going forward, I think is a violation
21 of what we are sent to Albany to do.
22 I'm also pretty sure that New York
23 City doesn't really have that big a revenue
24 surplus from their taxes. In fact, they've just

1 new proposed budget. And we think rainy day
2 funds are a really great idea until somebody
3 thinks, ah, I'll claim it's a surplus and I'll
4 say give it back. Well, that's not actually the
5 fact about the city budget and the position
6 they're in. And shockingly, we, the State of
7 New York, keep reducing the revenue they can
8 receive in a variety of ways. The federal
9 government actually creates emergencies for our
10 localities and the states because they keep
11 cutting the money they provide.
12 It's simply unacceptable,
13 Mr. President, for us up here, sitting up here
14 dealing with our own budget, to suddenly announce
15 we're going to radically reduce the city's budget
16 and you figure out what you're cutting, what
17 schools are you closing, what parks aren't you
18 funding, what human services aren't you going to
19 provide anymore, what public transportation
20 commitments aren't you going to deliver on,
21 because we're telling you you have to reduce the
22 revenue because we decided that we didn't like a
23 decision that was made in 2001.
24 I can't even imagine what the State
25 Budget would look like if we went back and tried

1 to revisit every imaginable action that took
2 place in a previous legislative body and said
3 strike all that, we're starting again from
4 scratch.
5 And maybe we would decide to do that
6 on the State Budget. But frankly, if you want to
7 rewrite the city budget or rewrite how the City
8 of New York decides what it's doing with its tax
9 revenue and how it's spending, I would encourage
10 you to run for a city elected office, not a state
11 elected office.
12 I strenuously vote no. And now I'm
13 leaving to go to committee; you can decide to
14 count my vote or not. Thank you.

3 I'll tell you what's outrageous,
4 Mr. President, is that too often politicians say
5 something and either they're not careful about
6 what they're saying or they're downright lying
7 when they say it.
8 Senator Krueger mentioned some of
9 the things that may have happened between then
10 and now in 16 years. Let me tell you, there's
11 only one thing that happened. The passage of
12 time has proved one thing, that politicians get
13 up and lie too often to the people they
14 represent.
15 This is not about a decision I
16 didn't like -- which I didn't. I voted against
17 it. This is about the fact that one after the
18 other of my colleagues on the City Council said:
19 I am only voting for this, my constituents,
20 because it's temporary, because it's an
21 emergency, and it will go away.
22 Sixteen years later, it's still
23 there. So we're either going to be true to what
24 we say or we're not. And this is your
25 opportunity to choose which one you're going to

1 be.
2 And by the way, can anyone argue
3 that property taxes in the City of New York, the
4 most regressive of all taxes -- the less your
5 family earns, the more it hurts you. It is a
6 regressive tax. Can anyone argue that property
7 taxes in New York City are not too high, that
8 they are not hurting our seniors, hurting our
9 lower-income families, that they're not raising
10 the cost of rent, the cost of homeownership, that
11 they're not driving working people out of
12 New York City?
13 But put all that aside. When you
14 say something is temporary and you say it's an
15 emergency, when the emergency has passed and
16 16 years later, it's time to keep your word and
17 remove that tax.
18 Mr. President, I obviously support
19 my legislation.

19 purposes tonight, Ms. Gallo is a resident of
20 Battery Park City. And we recently in this
21 chamber passed a law requiring that this board of
22 seven have at least two residents. It's
23 something that my predecessor, Daniel Squadron,
24 worked on for many years and just got enacted
25 recently. My community and my colleagues in the

1 Assembly who represent that community had asked
2 the Governor to act promptly in compliance with
3 that law to name two residents.
4 The Battery Park City Authority has
5 many governance functions, and so it's very
6 important for us that we have local
7 representation on that board. So it's great to
8 see that Ms. Gallo is being nominated tonight. I
9 will be voting in favor of her nomination, along
10 with the other distinguished nominations that are
11 before us tonight.
12 I would also note that there is a
13 second nomination to this very board that is
14 before this house, and I think it might be
15 something we can take up tomorrow. And I would
16 urge my colleagues to join me in trying to get
17 that done as well.
18 But it's a great night for local
19 representation, a great night for Lower
20 Manhattan.

15 2017, there was a major announcement in my
16 district, and for the State of New York, the
17 closure of Indian Point. We have roughly 1200
18 workers at Indian Point. What this bill does is
19 put money aside to allow the workers to be
20 retrained in the possible decommissioning work.

14 of money in the cessation fund with regards to,
15 in my eyes -- we fought tooth and nail to get
16 $24 million. I believe we just forgot a zero on
17 top of that. It should have been $240 million,
18 because of what's going to happen over there in
19 the community. This alone -- Hendrick Hudson
20 School District is going to lose $25 million
21 overnight when this happens.
22 So the idea is to put a fund
23 aside -- it's like having your reserve fund -- to
24 make sure that the community doesn't get blighted
25 and doesn't fall, quote, unquote, into blight

2 all of us. So what we had was Entergy actually
3 put $15 million into a community fund. Entergy
4 put that money in there. I'm asking NYSERDA to
5 put in more money for the reeducation of the
6 workers, the 1200 workers up at Indian Point, for
7 the decommissioning. And where we get that money
8 is through the Clean Energy Fund. There's
9 supposed to be $2.5 billion over the next
10 10 years. There's a market development portfolio
11 that specifically puts it in for workforce
12 training.
13 So I would like to, at a minimum,
14 the state to put in another $15 million for the
15 retraining of these workers.

13 is that in the last budget we actually put
14 $15 million into the budget for a similar
15 program. And then there's supposed to be an
16 additional $15 million provided by Entergy, and
17 then this bill would be a third $15 million, all
18 going towards essentially the same cessation and
19 mitigation-type work in that community. Is that
20 correct? Through you, Mr. President.

24 Parker, that is incorrect.
25 What is -- what is -- we had

1 actually $24 million in this year's budget, not
2 $15 million. So that 24 is in a special fund.
3 On top of Entergy originally put in $15 million
4 for a community fund. We, as the state, in this
5 year's budget put in another $24 million in the
6 cessation fund, where I believe we're going to
7 need to be up to -- close to about $400 million,
8 not $24 million.
9 Now we have this -- I'm asking for
10 another $15 million to match Entergy's funding so
11 we can have the retraining of the 1200 workers
12 that are up at Indian Point to get retrained in
13 the decommissioning work of Indian Point. So you
14 not only have 1200 workers, but what we're trying
15 to do is make sure that they -- these people stay
16 in New York State.
17 Over the past eight years, we've
18 lost close to a million people in the State of
19 New York. What we're doing here is we are
20 exporting our people and importing energy.
21 Because the energy that's supposed to be coming
22 to Indian Point is supposed to be coming from
23 Cricket Valley and supposed to be coming from
24 CPV -- which is an entire another story -- and
25 also coming from Bayonne, New Jersey. So we are

1 now importing energy and exporting jobs in the
2 State of New York.
3 This is another reason why people
4 have left and we're ranked 50th, dead last in
5 America, as a business-friendly state.
6 SENATOR PARKER: Mr. President,

16 question right, the money will be used to retrain
17 some of the 1200 people up there in the
18 decommissioning work. Because what has happened
19 in Vermont Yankee, they had a company come in and
20 do the decommissioning work up there. So they
21 lost all the jobs up there.
22 The idea here is to try and keep
23 these families in our neighborhoods and in our
24 district. So the -- to have them there --
25 remember, we're talking about workers here. Now

1 they have a wife, they have kids that go to the
2 school districts. So they're going to have to
3 get up and move when this closes.

23 you want to make sure that they're in good health
24 in order to do a different task of the

2 where you start in case they get sick. So this
3 would be the baseline as far as physicals are
4 concerned. And I think that's what you're
5 asking.

22 that if notifications aren't met, that contracts
23 that are related to this closing will be
24 nullified, they won't be valid. And what the
25 impacts on the community will be if that in fact

2 SENATOR MURPHY: Well, the whole
3 idea is to keep the workers right there and to
4 keep them working within the plant themselves.
5 So we're going to go through attrition, you're
6 going to have, out of the 1200 workers, you're
7 going to have some nuclear physicists that are
8 not going to be involved in the decommissioning
9 process right there. You're going to have other
10 people that are going to leave through attrition.
11 So hopefully this won't be 1200
12 people, it would be roughly 400 or 500 people.
13 SENATOR PARKER: Mr. President,

2 should step up to the plate and make sure that
3 the state takes care of the 1200 people. I'd
4 like to see a plant close in your district, 1200
5 people overnight gone, worried about you come
6 home, Honey, are you going to have a job in a
7 year or two? Are our kids going to go to school
8 here?
9 I'm going to do whatever I can to
10 make sure that these workers are protected over
11 there, both physically, mentally and financially.
12 SENATOR PARKER: Mr. President,

18 for you. But it's -- the massive thing is going
19 to be taxes, are you kidding me, overnight. Like
20 I said to you, the school district is $25 million
21 a year. You have Entergy that was doing a bunch
22 of civic stuff, buying fire engines, there's
23 special districts over there, sewer districts,
24 fire districts that are -- now the taxes are
25 going to go through the roof.

1 This is to try and mitigate some of
2 that impact that's going to happen. The old
3 proverbial -- what happened, it's what New York
4 does great, is they shoot and then aim. And
5 that's what happened over there.
6 SENATOR PARKER: Mr. President, on

12 First let me thank Senator Murphy
13 for his indulgence and for answering my questions

15 I appreciate the predicament that
16 he's in and the predicament that his community is
17 in, and in fact the state is in, with losing an
18 asset like Indian Point and then having to figure
19 out, you know, everything from school taxes to
20 employment, you know, of some specially skilled
21 workers, you know, from the community.
22 I think that the state has, I think,
23 come up with a plan. They have certainly tried
24 to fund that plan. I certainly have some
25 sympathy and think that, you know, the plan could

1 be worked a little bit differently. And
2 certainly I think the timing could have been done
3 a little bit better as well.
4 But it certainly seems to me that in
5 the last budget, with the $24 million that was
6 put into the budget by the Governor, that we have
7 kind of done what we needed to do as it relates
8 to this specific instance. I certainly would
9 like to see itemization of where the sponsor
10 believes $400 million needs to be spent in this
11 particular stead. I know all about districts
12 that could probably use an extra $400 million in
13 terms of workers who need to be trained and
14 retrained, regardless of, you know, different
15 circumstances.
16 But I don't think that in this
17 particular case that there is enough in the bill
18 memo or the information that I've seen, as the
19 ranker on the committee, that justifies another
20 $15 million from the state to go into this
21 specific program.
22 And I also think that, you know,
23 we're already talking about $39 million, or
24 $24 million that's been put in by the state and
25 the $15 million that has been put up by Entergy.

1 And so you have both the state and the company
2 coming together, partnering to in fact, you know,
3 create an adjustment period and some significant
4 compensation for the workers in that community.
5 And so because of those reasons, I'm
6 unfortunately going to vote no on this bill and
7 I'm going to ask my colleagues to follow my lead
8 and also vote no.

9 This is incredibly important,
10 because this is just the first of many of what
11 New York State is trying to do. Nuclear energy
12 is the cleanest energy that you can get. And I
13 know the Governor has a plan by 2030 to go
14 50 percent reduction in CO2 emissions. These are
15 the plants that are going to take over for Indian
16 Point: Cricket Valley; CPV, Competitive Power
17 Venture, and now Bayonne, New Jersey. This is
18 the report from ISO, it's not my report, that has
19 changed numerous times, because the original plan
20 was coming down from Champlain, from Quebec. We
21 had a big extension cord, a hydro line.
22 I think we're all up for hydro,
23 solar, wind, even geothermal, no problem. But
24 this in itself -- New York City gets 25 percent
25 of their energy from Indian Point. So does

1 Westchester County. I asked NYSERDA, Can you
2 guarantee me that these rates are not going to go
3 up -- not double, not triple, but quadruple? And
4 I got a blank stare, not even a "No" or "I'll
5 check into it."
6 It's very, very concerning. And it
7 should be very concerning to the people in
8 New York City too. And three years from now when
9 it closes, you're going to have your people
10 coming to you telling you their electricity bill
11 is through the roof, I can't afford it. I don't
12 want to tell you I told you so, but this is
13 something that we should all be paying attention
14 to.
15 I think we're all open to green
16 energy, no problem. But this is the cleanest
17 energy. And it doesn't make sense, when the
18 Governor has his ambition to go from 20 to 30, a
19 50 percent reduction, when we're going to natural
20 gas. You can only go up. ISO came in -- it's
21 2200 megawatts Indian Point puts out. ISO came
22 in and told me they can come up with 1700 from
23 the three plants. The other 500 are going to be
24 renewable energy. We don't have the storage
25 capacity to carry that. 500 megs? Come on.

1 This is something that has to be
2 addressed. Twenty-four million dollars, thank
3 you, Governor, for putting it in this year's
4 budget. I appreciate that. I just think we're
5 missing a zero on the end of that. Maybe
6 $240 million might have been nice in order to
7 make the people okay over in my district.
8 There's families, there's kids, the houses.
9 Mr. President, I vote aye.

22 enough to pass a bill that was very important to
23 Senator LaValle, Senator Kaminsky, and me. And
24 it had to do with very similar issues. It wasn't
25 about a plant closing, but it was about a

1 potential six to $700 million hit for a power
2 plant in the community that I represent, along
3 with Senator Marcellino, and the plant is
4 physically in his district.
5 I want to correct both of my
6 colleagues. And they're going to appreciate this
7 correction. Because I pay attention to how we
8 say things, so when people listen, they
9 understand. The Governor did not do this by
10 executive fiat. It was not the Governor. It was
11 Senator Parker. It was Senator Murphy as an
12 advocate and someone fighting, fighting and
13 clawing for the people of his district.
14 This is the proverbial rug being
15 pulled out from under a community with no plan.
16 And he'll appreciate me saying this. Fifteen
17 million? I know Senator Murphy. I'm surprised
18 he didn't ask for $150 million. And I would have
19 supported that.
20 These issues involving energy, it's
21 just like so many other things. If it affects
22 Senator Murphy's district, it's going to affect
23 Senator Sanders and Senator Addabbo, Senator
24 Comrie, Senator Golden. So these things never
25 happen in isolation.

1 And when you take something of that
2 magnitude off the grid, by God we better come up
3 with some real plan that not only provides energy
4 to the City of New York and the rest of the
5 state, but protects real people.

15 SENATOR PHILLIPS: Yes, thank you,
16 Mr. President. So I rise to explain my vote.
17 So this is a community task force
18 for the Belmont NYRA racetrack that has been not
19 in place for many years, even though the other
20 racing -- Saratoga has it.
21 And the concept behind this task
22 force was to make sure that we had local
23 representation. So the way it's configured is
24 that the Senate will have five appointees, the
25 Assembly has five appointees, and NYRA has five

1 appointees. And let me clearly state that we
2 always envisioned making sure that both the
3 Minority and the Majority in the Senate have
4 representation.
5 The one thing that I can say with
6 the utmost clarity is Senator Kaminsky, Senator
7 Comrie and I have been working collaboratively on
8 an issue that's pretty complicated down there. I
9 don't think it's been easy for any of us. There
10 are constituent bases that we're all dealing with
11 that are for the development that's happening at
12 Belmont, and there are constituents that are
13 against it. But we have stayed together as a
14 team.
15 And I thank Senator Comrie and
16 Senator Kaminsky for their support and their
17 collaborative work here. So the Minority will
18 have two; I hope it will be Senator Comrie,
19 Senator Kaminsky who will be giving us
20 recommendations for who they believe.
21 And I think the other thing to
22 highlight, too, is everyone on this working
23 committee either has to reside, work or own a
24 business within five miles of Belmont, so you
25 truly have local representation.

1 So I thank my colleagues for voting
2 for this. If anyone has any questions, obviously
3 I'm willing to answer it. And thank you,
4 Mr. President, for allowing me to explain my

15 I want to thank Senator Phillips for
16 working collaboratively across the aisle on this
17 issue.
18 Belmont's racetrack, possibly arena,
19 the complex is at the heart of the intersection
20 of a number of our districts. It's critically
21 important what happens there. All residents need
22 a voice. So I appreciate the Senator
23 understanding that and coming to a resolution of
24 this important matter so that it can pass today.

3 done across the aisle. It's been a bizarre
4 couple of weeks, but it's been nice to work

12 I want to echo what Senator Phillips
13 and Senator Kaminsky said about Belmont Park. I
14 want to thank Senator Phillips for understanding
15 that there was a technical glitch in the language
16 that did not show that we had unity on this
17 issue, which we truly do.
18 Belmont Park is, as you know, a
19 jewel in this state that needs to be updated,
20 that needs to be preserved. Right now they don't
21 have heat in the main building. They can't work
22 there in the wintertime. Belmont Park, which is
23 the third leg of the crown jewel, needs to be
24 updated, needs to be modernized, needs to be made
25 sure that it can last for another thousand years

1 as a preeminent facility in our state, where we
2 can hopefully have other Triple Crown winners and
3 have an opportunity to make sure that
4 Belmont Park can still be a park where people
5 want to attend and people would use year-round.
6 So I'm glad that we have come to an
7 agreement on this. I'm glad that we were able to
8 make sure that we can still work together. I am
9 proud of the relationship that Senator Phillips
10 and Senator Kaminsky and I have had dealing with
11 the issues around Belmont Park, and hope to
12 continue that. And this acknowledgment by
13 Senator Phillips will make sure that that
14 happens.
