 2   Animal Advocacy Day in the State of New York.  

 3                "WHEREAS, It is the sense of this 

 4   Legislative Body that all living creatures have 

 5   value and to recognize and appreciate the  

 6   service, companionship, loyalty, unconditional 

 7   love and happiness animals bring to the lives of 

 8   New Yorkers; and 

 9                "WHEREAS, Attendant to such concern, 

10   and in full accord with its longstanding 

11   traditions, this Legislative Body is justly proud 

12   to memorialize Governor Andrew M. Cuomo to 

13   proclaim June 4, 2019, as Animal Advocacy Day in 

14   the State of New York; this year marks the 

15   9th Annual Animal Advocacy Day; and 

16                "WHEREAS, Animals are a beloved and 

17   cherished member of many of our families and play 

18   a positive role in the lives of so many of 

19   New York's citizens; and 

20                "WHEREAS, Pets offer companionship  

21   in more than 71 million United States households, 

22   and studies have shown companion animals can  

23   provide a variety of health benefits; and 

24                "WHEREAS, Companion animals provide 

25   comfort and assistance to seniors and people with

 1   disabilities; and 

 2                "WHEREAS, Companion animals play an 

 3   important role helping police, fire departments, 

 4   and search and rescue efforts to keep our 

 5   citizens safe; and 

 6                "WHEREAS, Animal abuse, cruelty and 

 7   neglect result in unnecessary pain and suffering 

 8   to animals; and 

 9                "WHEREAS, Violence against animals 

10   is a bridge crime that can and has led to 

11   violence against people; and 

12                "WHEREAS, Buster's Law created the 

13   felony category of 'aggravated cruelty to 

14   animals,' punishable by up to two years in prison 

15   and a $5,000 fine; prior to this bill becoming 

16   law, animal cruelty resulted in only misdemeanor 

17   penalties, if any charges were imposed at all; 

18   and 

19                "WHEREAS, It is vital that we 

20   encourage empathy and compassion for our 

21   companion animals, and that we provide a voice 

22   for those who cannot speak for themselves; and 

23                "WHEREAS, On June 4, 2019, New York 

24   pet owners and citizens come together to support, 

25   protect, and acknowledge all animals' positive

 1   contribution to society and the family of 

 2   New York; now, therefore, be it 

 3                "RESOLVED, That this Legislative 

 4   Body pause in its deliberations to memorialize 

 5   Governor Andrew M. Cuomo to proclaim June 4, 

 6   2019, as Animal Advocacy Day in the State of 

 7   New York; and be it further 

 8                "RESOLVED, That a copy of this 

 9   resolution, suitably engrossed, be transmitted to 

10   the Honorable Andrew M. Cuomo, Governor of the  

11   State of New York."

12                ACTING PRESIDENT BENJAMIN:   Senator

14                SENATOR MARTINEZ:   Thank you, 

15   Mr. President.

16                Good afternoon.  Today we ask the 

17   Governor to memorialize Animal Advocacy Day here 

18   in the State of New York at the Legislature.  

19                And we have a special guest with us 

20   today here in the chamber.  You don't really see 

21   many four-legged friends in the chamber, and we 

22   have Hudson here today.  Hudson, also known as 

23   the "Railroad Puppy," among other siblings that 

24   he had, and has, unfortunately experienced 

25   some -- not such a great life for four-legged

 1   friends.  They were found here in Albany nailed 

 2   down to the railroad tracks, where Hudson also 

 3   was found with his paw cut off.  

 4                He is the first dog in the State of 

 5   New York to actually be fitted for a prosthetic 

 6   leg, and he is wearing his brace today.  

 7                He has become a therapy dog for 

 8   many.  He visits schools, they visit hospices, 

 9   just to make sure that people have that comfort 

10   level.

11                But unfortunately, one of his 

12   siblings did not make it, and that's Carina.  And 

13   unfortunately, even with the medical treatment 

14   given, she did not survive.  Though Pearl, his 

15   other sibling, did make it, and they are a 

16   dynamic duo working to make sure that animals are 

17   taken care of.  

18                And today in the State of New York 

19   we are trying to express the importance of animal 

20   welfare.  And the reason being is because when 

21   you look at several cases of animal abuse and 

22   that abuser, the one who is committing the crime, 

23   you can see that there is a direct link between 

24   that animal abuse and crime not only on other 

25   humans but other crimes across our state.

 1                And it's time that we take this 

 2   serious.  It's time that we start protecting our 

 3   animals.  Because when we protect our animals, 

 4   we're also protecting our people.  

 5                And I am so happy to be here as the 

 6   sponsor of this event, along with Assemblyperson 

 7   Linda Rosenthal and my colleague here -- where is 

 8   he -- Senator Tedisco.  But him -- all three of 

 9   us made this day a special day for our furry 

10   friends.  

11                And I also want to thank Senator 

12   Boyle for also being a champion of our animals 

13   here, and Senator LaValle.  We definitely have 

14   something in common that has nothing to do with 

15   politics.  Because when we're taking care of our 

16   animals, we're taking care of the entire State of 

17   New York.

18                So thank you for giving me this 

19   opportunity.  And, Mr. President, if you do not 

20   mind recognizing Hudson to the rest of my 

21   colleagues here today.

24                SENATOR SANDERS:   Mr. President, I 

25   want to thank the sponsor for this on behalf of

 1   my animals; I have two dogs myself.  

 2                I had the pleasure of speaking to 

 3   Hudson a few moments ago, and I can attest that I 

 4   felt even better.  I was a little apprehensive 

 5   coming into the hall, I get a little bit timid 

 6   here, it is true.  And he brought me -- made me 

 7   much calmer.  

 8                So I think that all of this is 

 9   fantastic.  We are supposed to be stewards of the 

10   earth, and sometimes I think it might be a little 

11   healthier if they were stewards and had to look 

12   over us.

13                I encourage all of us to support any 

14   of these actions that say that animals have a 

15   place and that we should support them as they 

16   support us.

17                Thank you very much, Madam.  And 

18   thank you, Mr. President.

14                As I was saying, we're constantly 

15   acknowledging athletes from across our state 

16   coming to this chamber to be recognized.  And I 

17   wanted to ensure that everyone saw that I have 

18   great athletes in Senate District 19 -- such 

19   great athletes that last year, when the South 

20   Shore High School Girls Team and Boys Team won 

21   the basketball championship, they made history.  

22   They were the first PSAL Division AA school to 

23   win the championship in the same year.  

24                So what did they do?  They did 

25   better.  They repeated this year.  So we have

 1   fabulous athletes in Senate District 19.  

 2                So I want you to acknowledge the 

 3   Boys Team and the Girls Team who are here with us 

 4   today visiting with their coaches:  Coach Anwar 

 5   Gladden, from the Girls Basketball Team, and 

 6   Coach Pat Trani from the Boys Basketball Team.  

 7   So as you can see, they're not all here; there's 

 8   only a small percentage of them who are here 

 9   today, but they wanted to represent their school.  

10                Both teams are excellent.  Not only 

11   do they excel on the court while they're playing 

12   basketball, they excel as students and they excel 

13   in the community.  There was one who was saying 

14   to me, you know, they want to do things, they 

15   want to play basketball, and one even wants to 

16   become an elected official.  He may be replacing 

17   me in the chamber.  You know, God bless him for 

18   that.

19                So on behalf of all of Senate 

20   District 19, I welcome the basketball teams from 

21   South Shore High School here today.  

22                In addition to the basketball teams 

23   who we're all talking about them, I have Law 

24   Enforcement Explorers representing many of the 

25   precincts that I have.  I represent -- and I'm

 1   going to rattle them off, they're here -- the 

 2   NYPD Precincts 63, 69, 73, 75, Transit Bureau 33, 

 3   and PSA 2.  They're also here representing.  

 4                In addition to those youth, we have 

 5   students from the Middle School of Science and 

 6   Professions here and the High School of Medical 

 7   Professions here.  

 8                So my staff came from the city 

 9   escorting them here.  I would love you, 

10   Mr. President, to welcome them -- welcome them 

11   and encourage them to come back to visit us in 

12   Albany, because we're going to give them such a 

13   warm welcome.

13   Alzheimer's and Brain Awareness Month in the 

14   State of New York.

15                ACTING PRESIDENT BENJAMIN:   Senator 

16   May on the resolution.

17                SENATOR MAY:   Thank you, 

18   Mr. President.

19                As chair of the Senate Committee on 

20   Aging, I would like to call the Senate's 

21   attention to one of the most serious health 

22   challenges facing older Americans today, the 

23   scourge of Alzheimer's disease.  It is an illness 

24   that has very likely touched or will in some way 

25   touch each one of us here at some point in our

 1   lives.  

 2                Today nearly 6 million Americans, 

 3   including an estimated 400,000 New Yorkers, live 

 4   with Alzheimer's.  Anybody who has been touched 

 5   directly or indirectly by Alzheimer's or dementia 

 6   can speak to the devastating toll this cruel 

 7   disease takes on the lives of those who live with 

 8   it and all who care for them.  

 9                And we have with us several visitors 

10   from the Alzheimer's Association.  I spoke with a 

11   young woman who is caring for her father as he 

12   slowly and agonizingly slips away; a woman whose 

13   husband had early onset Alzheimer's and she had 

14   to care for him and their three children, and the 

15   children had to watch their father disappear from 

16   their lives little by little.  

17                My own mother cared for her parents 

18   into their 90s, and she only survived them for a 

19   few years.  And I have always thought that that 

20   was partly because of the stress of caring for 

21   her parents.  And what I just learned is that 

22   30 percent of caregivers for Alzheimer's patients 

23   actually do not survive the person they are 

24   caring for because the stress is so great.

25                While there is no cure as yet, an

 1   early diagnosis can provide access to 

 2   medications that may lessen the effect of the 

 3   disease and give them more time to locate 

 4   critical resources and support networks for those 

 5   living with the disease and for their caregivers.  

 6   Most importantly, an early diagnosis means more 

 7   time to plan for the future in a way that 

 8   prolongs quality of life and enhances peace of 

 9   mind.

10                For those reasons, we must increase 

11   public awareness of Alzheimer's disease and do 

12   all we can to support efforts at every level to 

13   address this devastating illness.

14                I invite my colleagues to join me in 

15   welcoming the brave advocates for Alzheimer's 

16   that we have here and ask that we pause in our 

17   deliberations and memorialize Governor Andrew 

18   Cuomo to proclaim this month, June 2019, as 

19   Alzheimer's and Brain Awareness Month in the 

20   State of New York.

 1                I thank my colleagues for continuing 

 2   to recognize June as Alzheimer's and Brain 

 3   Awareness Month here in the State of New York.

 4                Alzheimer's disease and dementia are 

 5   issues that unfortunately probably almost all of 

 6   us in this chamber are familiar with, because 

 7   almost everyone knows someone whose lives have 

 8   been impacted by these devastating diseases, 

 9   whether it's someone with the diagnosis or a 

10   caretaker or a loved one.  

11                However, it wasn't till I became 

12   involved with the Aging Committee that I really 

13   began to understand the full scale of the problem 

14   here in New York.  According to the Alzheimer's 

15   Association, worldwide 50 million people are 

16   living with Alzheimer's and other dementias.  

17   While many of us think of Alzheimer's as a memory 

18   disorder, the terrible reality is that it is 

19   actually a disease that kills more patients than 

20   breast cancer and prostate cancer combined.  One 

21   in three seniors dies with Alzheimer's or another 

22   dementia.  

23                Currently there is no robust 

24   treatment or cure for Alzheimer's or dementia, 

25   and the burden of caring for someone struggling

 1   with these diseases often falls on the shoulders 

 2   of family members and unpaid caregivers.  The 

 3   Alzheimer's Association estimates that 

 4   16.1 million Americans provide unpaid care to 

 5   those suffering with these diseases.  

 6                As you've heard me say before, 

 7   New York's caregivers provide over 1 billion 

 8   hours of unpaid care to their loved ones with 

 9   Alzheimer's.  But I can tell you from speaking 

10   with so many of them, they will rarely ever 

11   complain about that time or the thousands of 

12   dollars that they spend each year to maintain 

13   quality of life for these patients.

20   home base and cultural center of Long Island's

23   celebrates its Old World traditions and customs.  

24   And it is a community that has contributed so 

25   much to my district and all of the State of

22                I am pleased to honor today Jo Ann 

23   Raia, who is my Huntington town clerk.  And she 

24   was actually my Woman of Distinction honoree, but 

25   because of her public duties, including her

 1   duties with the New York State Town Clerks 

 2   Association, she was unable to attend.  So she's 

 3   here with us today.

 4                She has served in this position for 

 5   38 years.  And if you think of the span of the 

 6   years, she has transformed not only her office, 

 7   but her office has served as model for all the 

 8   town clerks offices across the country.  She has 

 9   modernized it, bringing us from the old paper 

10   days to now everything we can instantaneously 

11   get, with websites and every other thing that she 

12   has done as town clerk.  

13                But the other thing which she has 

14   done which is so important is she has made sure 

15   that we really archive, both in Huntington and I 

16   know this is going on around the state, every 

17   single document, piece of paper, photo, anything 

18   that had to do with our towns and our town 

19   governments.  And she has done that, she has been 

20   the leader.

21                And one of the other cool things 

22   she's done is that she has once a year a 

23   Valentine's Day wedding ceremony, which has 

24   become infamous in my town, and I can't tell you 

25   how many people she has married.

 1                She's also instilled in her family 

 2   public service.  And we are also pleased to be 

 3   joined by her son, Andrew Raia, who is our 

 4   colleague serving in the New York State Assembly, 

 5   and she also has a daughter Diane who works as a 

 6   law secretary to a State Supreme Court justice.

 7                And finally I just want to say 

 8   Jo Ann is the most popular person in my town, and 

 9   she clearly could have been elected to any other 

10   office.  She could have sat in this chamber, she 

11   could be in the halls of Congress.  But she was 

12   so dedicated to that job for 38 years that I 

13   commend her, I congratulate her.  

14                And Mr. President, I would ask that 

15   you recognize Jo Ann Raia and provide her all the 

16   privileges and courtesies of this house.

 3   around for quite some time, and that is a 

 4   compliment and high praise.  No one ever assumes 

 5   anything other than Jo Ann is going to run and

 7                So I compliment Senator Gaughran for 

 8   recognizing her as a Woman of Distinction.  And 

 9   I'm elated to see her here.  Jo Ann helped me out 

10   very early in my own career.  She was always 

11   there, as a stalwart and a supporter and 

12   everything else.  

13                And I'll just close on this because 

14   I just can't resist.  Senator Gaughran spoke 

15   about how many marriages our town clerk has 

16   performed, decade after decade, year after year 

17   after year.  The one marriage she has not been 

18   able to get finished is the young man seated to 

19   her right, her son Andrew, our colleague here for 

20   17 years in Albany.

 3   had the opportunity to visit with some well-loved 

 4   and cared-for companion animals as part of Animal 

 5   Advocacy Day.

 6                Unfortunately, not every animal is 

 7   treated as they should be.  This legislation will 

 8   provide additional and important standards of 

 9   care that pet dealers and breeders must follow, 

10   helping to end abusive practices like those that 

11   take place in unscrupulous puppy mills.  It will 

12   ensure that all companion animals have high 

13   standards of care and treatment.  

14                Included within this legislation are 

15   requirements for maintaining sanitation 

16   standards, exercise and nutrition standards, 

17   provision of regular diurnal light cycles, access 

18   to veterinary care, and provisions for nursing 

19   and pregnant animals.

20                Pet dealers must be held to 

21   standards that will promote the safety, good 

22   health and overall well-being of animals in their 

23   care.  

24                Assemblywoman Paulin has introduced 

25   this legislation every year for the last five

 1   years, and I am very pleased to help her carry it 

 2   over the finish line today.  I'm proud to sponsor

13   someone receiving services with DHSS can be 

14   sanctioned for not showing up for an appointment.  

15   In some cases that's because childcare didn't 

16   arrive or a bus didn't come on time or there was 

17   some illness that held the person back.  But the 

18   sanctions that are extracted from that person can 

19   be terribly debilitating.  They take away their 

20   social services, take away whatever payments 

21   they're receiving, and suddenly they can't afford 

22   their rent and they can't keep going to their job 

23   and they start falling deeper and deeper into 

24   poverty.

25                What this bill does is create a

 1   system where people can have a little 

 2   forgiveness.  If they miss one appointment, 

 3   they're not immediately thrown into this downward 

 4   spiral of ever-increasing poverty.  

 5                So I think this is a great bill.  I 

 6   Appreciate my colleagues for supporting it and 

 7   the leadership for bringing it to the floor, and 

 8   I proudly vote aye.

14                I want to congratulate Senator May 

15   for accomplishing statewide what I was able to do

17   fact, this body passed this very same bill as it 

18   applied only to the City of New York.  

19                What it does is it gets people back 

20   in compliance and back to the welfare-to-work 

21   program quicker, rather than string it out longer 

22   and wind up having to go to long and extensive 

23   fair hearings.  

24                And sitting up there, the incoming 

25   commissioner of OTDA, the Office of Temporary and

 1   Disability Assistance, is nodding his head in 

 2   approval because he knows this will put people 

 3   back on track faster, saving the state money and 

 4   getting people back in compliance quicker.  It is 

 5   actually a good thing, which is why you all voted 

 6   for it when we assigned it to the City of 

 7   New York just a few years ago.

 4                This is part of our animal advocacy 

 5   agenda today, and an important bill to finally 

 6   stop animal fighting in New York State.  

 7                We passed important legislation 

 8   which became law a couple of years ago which 

 9   allowed law enforcement to do surveillance on 

10   animal fighting rings.  This is the next step.  

11   It will treat an animal fighting ring basically 

12   as an organized crime, RICO statute on a state 

13   level.  It's going to allow our prosecutors to 

14   get in there, use their surveillance to make the 

15   arrest, and then arrest all of them.

16                When you find animal fighting, that 

17   inhumane, terrible -- those terrible acts, it's 

18   also usually that you're -- often that you're 

19   going to find drugs and guns and a lot of other 

20   bad stuff and behavior.  

21                I proudly vote in favor and thank my 

22   colleagues for doing so as well.

 1                This bill is hugely important 

 2   because we know that there's a link between 

 3   animal abuse and human violence.  I rise to 

 4   support this bill because, as I said yesterday, I 

 5   think we need to be doing all that we can to 

 6   prevent child abuse.  As I mentioned yesterday, I 

 7   carry a bill, S1257, that would also expand the 

 8   mandated reporting requirement.  It passed 

 9   unanimously here in the Senate but failed to move 

10   in the Assembly, so I wish Senator Martinez the 

11   best of luck on that front.

12                My bill would also close a dangerous 

13   loophole.  Current law only requires mandated 

14   reporters to report cases where abuse happens at 

15   the hands of a parent or guardian, not anyone 

16   else.  So you can leave your child with a coach 

17   or a volunteer, it doesn't matter -- something 

18   most parents would be shocked to learn.  In fact, 

19   I didn't even learn it until my constituents 

20   brought the bill to me.

21                My bill would require anyone working 

22   with children to report abuse, which would also 

23   bolster this bill.  I urge this body to pass this 

24   bill.

16                The 2019-2020 State Budget 

17   incorporated legislation that I had introduced 

18   earlier this session to expand primary voting 

19   hours in upstate communities from 6 a.m. to 

20   9 p.m., which was a big victory because the polls 

21   had not opened until noon.

22                This was very important for rural 

23   communities.  It allows people to vote, you know, 

24   in the morning, which many people do on their way 

25   to work, on the way to drop their kids off at

 1   school.

 2                However, the fruits of that 

 3   legislative victory in the budget won't be 

 4   realized in this current -- in the next 

 5   presidential primary election because the 

 6   legislation doesn't go into effect until two days 

 7   after that primary.  So this legislation will 

 8   correct that to make sure that rural 

 9   communities -- that voters in rural communities 

10   will be able to actually vote morning, afternoon, 

11   or evening in the 2020 presidential primary.

13   State Commission of Correction.  It permits an 

14   inmate to transfer from one county jail to 

15   another, with the consent of the sheriff of both 

16   counties, in order to attend specialized 

17   programs.  For example, some jails have grants 

18   for innovative sexual abuse treatments, others 

19   have grants for specialized units for military 

20   veterans.  

21                Any such transfer would have to be 

22   approved by the State Commission of Correction, 

23   and in writing.  The bill would permit some of 

24   the smaller jails to benefit from extensive 

25   programs offered in bigger jails or to combine

 1   resources when appropriate.  

 2                I strongly support this in order to 

 3   provide a broader range of rehab programs for 

 4   jail inmates without incurring additional costs 

 5   to the state or to the counties.

 1   before you once again to discuss a very important 

 2   piece of legislation that is before us right now, 

 3   and it's to be named Tucker's Law.  And in recent 

 4   events that took place on Long Island, Mineola, 

 5   there was a case of an individual who killed two 

 6   dogs, injured the third, within a three-week 

 7   period.  

 8                The way the current law stands right 

 9   now is that if convicted, this individual will 

10   face a maximum of two years.  What this amendment 

11   would do to the law as it stands right now, it 

12   would remove the language that requires 

13   aggravated cruelty to be treated where a judge 

14   can now issue consecutive charges of animal 

15   cruelty if convicted.

16                And what this does is that it allows 

17   for individuals to understand that you cannot 

18   hurt an animal.  And we have to understand, 

19   again -- I said it before -- is that there is a 

20   direct link.  If we start using animals as a way 

21   to protect our people, I think this state would 

22   be safer.  It would be healthier for our 

23   communities, it will be healthier for our kids.  

24                It is something that has become 

25   rampant in our state, it is something that we see

 1   on an everyday basis.  It is something that we 

 2   need to take care of, because if we continue down 

 3   this road, we are going to see more crime 

 4   increase.  Because what people are doing, they 

 5   are preying on the most vulnerable.  

 6                And our animals are by far the most 

 7   vulnerable, as they do not speak.  We need to be 

 8   their voice.  We need to make sure that we're 

 9   there for them just like they're there for us 

10   when we come and they're wagging their tails.

11                Mr. President, I vote in the

 8                This legislation is going to go a 

 9   long way towards helping provide a more humane 

10   and less barbaric society.  A lot of people who 

11   engage in the process of declawing their cats 

12   don't realize just how barbaric it is.  They 

13   think it's the equivalent of cutting off your 

14   nail or just somehow done to protect one's 

15   furniture from being scratched.  

16                But in fact there is bone removed as 

17   part of this procedure.  It's actually the 

18   equivalent of severing a finger at the first 

19   knuckle.  And maiming animals just to protect 

20   furniture, to keep things from being scratched -- 

21   which is in the very instinctive nature of a 

22   cat -- is wrong.

23                It is said that a society can be 

24   judged by the way it treats its animals.  And by 

25   allowing this practice to continue, we have not

 1   been setting a good example.  Today we begin to 

 2   move that in the right direction by banning this 

 3   practice and treating our animals with the 

 4   respect they deserve.

13                On this wonderful Animal Advocacy 

14   Day, I want to recognize my hero who I've watched 

15   from afar, Senator Tedisco, and I've watched his 

16   career with not only Buster's Law, but the way he 

17   saved Luna last year.  So I want to thank you, 

18   Senator, for all of your hard work.  

19                I participated today with my baby 

20   Abby, who's a cockapoo puppy dog.  It's not that 

21   I'm not a cat person, but I will be voting no 

22   today.  

23                I want to take you back.  Today is 

24   my 26th wedding anniversary.  And about 30 years 

25   ago when I met my wife, she had a kitty cat named

 1   Sandy.  And Sandy at that time was declawed, and 

 2   I -- she didn't like me, so thank God she was 

 3   declawed.  But my wife thought nothing of it.  It 

 4   was a condition of where she needed to live.  And 

 5   Sandy lived to be a ripe old age of 18.  

 6                I take this bill very seriously.  I 

 7   appreciate Senator Gianaris's comments.  I did 

 8   reach out to my veterinarian, Abby's doc, I 

 9   reached out to local animal shelters.  And what I 

10   have found is that this is a very rare procedure 

11   in today's day and age.  And it's also a last 

12   option.  

13                But I think it's a complex and 

14   deeply personal decision.  And I don't think 

15   government should be involved.  I think we should 

16   leave it to the vets and the owners.  I'm worried 

17   about euthanasia.  I'm worried about a kitty cat 

18   being euthanized because the owner has to move to 

19   a nursing home or a facility that doesn't allow 

20   for cats.  I'm worried that it might affect 

21   adoptions.  

22                And I note that there are no 

23   exemptions for the humans -- you know, if there's 

24   an immunosuppressant disease at the house or 

25   another reason why the cat may be declawed.

 1                I don't have a fundamental problem 

 2   with the intent of the bill, but I think that it 

 3   could have been a better written bill.  And I do 

 4   think we need to stay out of people's business 

 5   when it comes to these type of matters.  So I'll 

 6   be voting no, Mr. President.

11   individuals of great character, integrity and 

12   public service.  Those that have the exceptional 

13   track record that they do all across this state 

14   in various capacities of leadership, we truly are 

15   privileged to have you in the positions that you 

16   are being confirmed in today and advocating for 

17   the public all across the State of New York.  And 

18   we thank you for your willingness to take on the 

19   respective roles.

20                I'd like to speak specifically on 

21   one particular individual who I know very, very 

22   well, have known most of my life if not my entire 

23   life, and certainly my entire adult life as well 

24   as my time in public service, and that is Mark 

25   J.F. Schroeder, who we're confirming as the

 1   commissioner of the Department of Motor Vehicles 

 2   in New York State.

 3                With him, as already has been 

 4   mentioned, Kate Horan Schroeder, Siobhan McMahon, 

 5   and Mary Reid.  Welcome to each and every one of 

 6   you, from the great South Buffalo neighborhood to 

 7   which I also reside in, each of them come from 

 8   and reside in.

 9                I also want to recognize the sons 

10   and daughters of Mark and Kate Schroeder:  

11   Michael and Allison and the late Matthew, who are 

12   all here with us in spirit.

13                Mark Schroeder is a man of 

14   tremendous integrity, a man of faith, of family 

15   and of community, with an extraordinary track 

16   record of public service in a voluntary role.  

17   Before he was elected to office back in 2004 to 

18   the New York State Assembly, he was serving as an 

19   Erie County legislator, a position that I 

20   actually succeeded him in.

21                He then went on to serve almost two 

22   full terms as the Buffalo city comptroller, and 

23   he did so with tremendous, tremendous honor and 

24   pride and privilege.  We have been so lucky to 

25   have his work over a decade, nearly two decades

 1   in public service.  But he brought with him to 

 2   public service a track record in the private 

 3   sector.  He recognizes what people need in the 

 4   communities across this state.  He served nobly 

 5   in his positions, respective positions, as I've 

 6   already mentioned.

 7                I want to quote the Buffalo News, 

 8   which I think it's important to quote.  And Mark 

 9   Schroeder has done a tremendous job of 

10   regurgitating this quote, as any one of us 

11   politicians would do in his position, but it's 

12   worth regurgitating again:  "If Teddy Roosevelt 

13   came back to life to oppose Mark Schroeder, we'd 

14   have to think long and hard before backing TR."

15                Now, if that's not an endorsement, 

16   Mr. President, I don't know what else is.  

17                But they've gone on to say:  I 

18   think, most importantly, is that he stands up for 

19   what he believes in and what he knows is right.  

20   That's who we're getting as commissioner of the 

21   Department of Motor Vehicles.  

22                In his work he's been an independent 

23   voice.  He's fought for progressive legislation 

24   like banning texting and driving, saving lives 

25   across the State of New York, standing up,

 1   fighting against sexual predators in our state, 

 2   working with small businesses, creating chambers 

 3   of commerce in the community that he represented, 

 4   standing up for the most vulnerable across this 

 5   state, including individuals with disabilities, 

 6   recognizing that we have to create new economies 

 7   and create jobs and opportunities for those that 

 8   have been left behind in the past, working to 

 9   create the Buffalo River Fest Park and enhancing 

10   the waterfront development opportunities along 

11   the Buffalo River and along different commercial 

12   districts in the area that I now represent, 

13   including the Seneca Street redevelopment zone.

14                He has just been an effective and 

15   extraordinary public servant.  And now he brings 

16   with him all of these accolades and experience to 

17   this tremendous position as a statewide 

18   commissioner of the DMV.  I couldn't be more 

19   proud and honored to second and support his 

20   nomination by the Governor.  

21                And again, I want to thank the 

22   Governor for bringing this amazing public servant 

23   to the floor to be approved today.

20   it spanned nearly 20 years.  Well, nearly twenty 

21   years ago, I remember a day when we were much 

22   younger and much more nimble, along with another 

23   friend or two of ours, we were out jogging one 

24   day.  And I was jogging with Mark Schroeder, and 

25   Mark said, you know, "What's it like to be an

 1   elected official?  Do you like it?  I feel like I 

 2   should be doing something for my community, and I 

 3   want to be in public service."  

 4                And he left a very successful 

 5   private career to then sit in all the offices 

 6   that Senator Kennedy talked about, and did an 

 7   outstanding job, of course, in all of them.  

 8                But I think what I remember, in 

 9   going back to that, is what drives an individual 

10   like Mark, and it's to his credit.  Certainly 

11   Western New York is better for it.  Now New York 

12   State will again enjoy your services.  No doubt 

13   you'll do a wonderful, wonderful job.  And I want 

14   to congratulate you and Kate and your family here 

15   today and the kids back home.  Outstanding 

16   nomination by the Governor.  

17                I'd also like to comment about the 

18   Governor's nomination for State Police 

19   superintendent.  Many know that I'm a former 

20   member of the New York State Police, and I'm very 

21   proud of that fact.  I was also Erie County 

22   sheriff, proud of my time in law enforcement.  

23                When we look at the State Police, 

24   though, and its reputation across the country, it 

25   is recognized as -- well, certainly it's one of

 1   the largest state police and police agencies in 

 2   the country and recognized as one of the most 

 3   respected and most professional.  And that of 

 4   course is a credit to the nearly 5,000 members of 

 5   the New York State Police, who all do an 

 6   outstanding job throughout the state protecting 

 7   us.  

 8                But it's incredibly important, I 

 9   think, that we have a true professional that 

10   heads up a professional agency.  The Governor 

11   reached into the ranks, which I think is very 

12   important.  Keith Corlett has served in nearly 

13   every position and every rank in the State 

14   Police, and he is incredibly respected.  

15                As the Governor has put his name 

16   forward and I've traveled the state and talked to 

17   different individuals and members in the State 

18   Police, many of whom are my friends, and former 

19   members, many of whom I worked with who are my 

20   friends -- not one person has a bad word to say.  

21   As a matter of fact, they're effusive in their 

22   praise, and they talk about his professionalism 

23   and what a great pick, what a great choice that 

24   the Governor has made in leading this agency 

25   through its challenges.

 1                I must also say the other members of 

 2   the executive staff form a team.  Keith worked 

 3   with former State Police Superintendent George 

 4   Beach, a good friend of mine.  And I think the 

 5   stage is set for you to continue to lead an 

 6   agency that's professional and enhance its 

 7   professionalism if you're able to do so.  

 8                But I'll be proudly voting in the 

 9   affirmative for this appointment as well as all 

10   of them.

16                I too rise to congratulate our four 

17   nominees this afternoon.  As the ranking member 

18   on the Senate Finance Committee, I had the 

19   pleasure and the great opportunity to meet with 

20   each and every one of these nominees.  And after 

21   those meetings I went away very, very impressed 

22   with each and every one of them.

23                Certainly Keith Corlett, as 

24   superintendent of the New York State Police, as 

25   Senator Gallivan pointed out, he has risen from

 1   the trooper rank right out of the academy right 

 2   up through the State Police agency, holding a 

 3   variety of titles throughout that agency.  He 

 4   knows the Division of the State Police inside and 

 5   out.  And he will make an outstanding 

 6   superintendent of that very, very important 

 7   agency.

 8                And Michael Hein will be our new 

 9   commissioner of OTDA.  Since 2012, when four 

10   towns in Ulster County became part of my Senate 

11   district, that's when I had the opportunity to 

12   not only meet and work with Mike Hein, but also 

13   observe him as the county executive in 

14   Ulster County -- an outstanding, outstanding 

15   public servant.

16                And I think that county experience 

17   is going to serve him very, very well in this 

18   capacity at OTDA because there is very much a 

19   link between the county governments and the state 

20   agency involved with delivering those very, very 

21   important services and benefits.

22                And Mark Schroeder.  I cannot expand 

23   upon the comments of Senator Kennedy and others 

24   on Mark Schroeder except to say, you know, the 

25   Department of Motor Vehicles I think is -- I

 1   think that's the agency, the state agency that 

 2   most New Yorkers have some contact with in terms 

 3   of their state government.  And it's very much a 

 4   service, a public service agency.

 5                And I think that Mark Schroeder's 

 6   experience as a county legislator, as a state 

 7   legislator, very much those skills that he's 

 8   honed in those legislative positions is going to 

 9   serve him and DMV and the people of the State of 

10   New York very, very well.  

11                And of course Robert Williams is our 

12   executive director of our Gaming Commission, a 

13   man of integrity, greatly respected.  And I know 

14   he will continue to do a great job in that 

15   capacity.

16                So Mr. President, I congratulate 

17   each and every one of our nominees here today.  I 

18   am very pleased to support each and every one of 

19   them.

 5   With his experience and his leadership as a

 7                You know, as an elected official 

 8   representing Ulster County, when I first was 

 9   introduced to Ulster County back in 2012, Senator 

10   Larkin took me along.  And Senator Larkin's 

11   advice to me was "Get to know County Executive 

12   Mike Hein."  And the reason for that was because 

13   of his ability to lead, his ability to listen, 

14   and his ability to get things done.

15                And it is a great honor to support 

16   Mike Hein, as well as Keith Corlett, as well as 

17   Mark Schroeder and Robert Williams on their 

18   leadership and their roles in being the 

19   commissioner or the superintendents or the 

20   leaders of these agencies and the services that 

21   the residents of the New York deserve and need.  

22   And I appreciate all four of them, and I 

23   congratulate them.

 4                I want to congratulate all our 

 5   nominees.  And I want to speak specifically to 

 6   the nomination of Mike Hein, who I have known 

 7   personally and professionally for I think more 

 8   than a decade in the service -- as he served as 

 9   our county, Ulster County's county executive, our 

10   first county executive and our only county 

11   executive until he was snatched up by our 

12   Governor.  And I have to say what is a loss to 

13   our county government is a huge win for our 

14   state.

15                Mike Hein really demonstrated a 

16   record of unparalleled leadership and innovation.  

17   He thinks out of the box.  He set out challenges 

18   for our county, and he just met them time and 

19   time again, whether it was addressing 

20   homelessness among veterans, whether it was 

21   making Ulster County the first carbon-neutral 

22   county in the state.  He developed innovative 

23   programs in the areas of mental health and 

24   efforts to reduce the epidemic of suicide.  He 

25   greatly improved the Meals on Wheels program,

 1   ending waiting lists, making sure that people got 

 2   better, more nutritious foods.  

 3                In every single area, he has made a 

 4   difference.  And he always asked, What can we do 

 5   better?  And he always listened to ideas from 

 6   other people, good ideas.  And we need that kind 

 7   of leadership at the head of OTDA.

 8                So I am absolutely thrilled to 

 9   support this, and I hope to be seeing more of him 

10   now that he's in Albany.

 4   stands out so extraordinarily, at a time when 

 5   often you need people -- the Roosevelt comparison 

 6   is perfect -- need people to be profiles in 

 7   dedication and courage to their constituents, not 

 8   to their parties or leaders, no one has stood up 

 9   more to Governors or leaders in any chamber more 

10   than Mark Schroeder.  And we need people like 

11   that.

12                And certainly the highest compliment 

13   I could give, my dad used to say "Judge the 

14   people who don't just talk the talk, but walk the 

15   walk."  Mark has done that.  And we need somebody 

16   like that at DMV, where it's very much conscious 

17   and heavy on serving the public and putting those 

18   constituents first, more than the system.  The 

19   Governor could not have picked a better person.  

20                So I want to congratulate Mark 

21   personally, as my coworker, friend.  And I hope, 

22   Mark, the speech, when I call on behalf of my 

23   colleagues with DMV issues, we will go to the top 

24   of the list.

11                I've known Mark for quite some time.  

12   And when I was a school board member, worked with 

13   him years ago when Mark was a newly elected -- I 

14   was a newly school board member, he was a newly 

15   elected county legislator.  I was so impressed by 

16   Mark in many ways.  One area was for his county 

17   legislative district that he had, he did a 

18   business plan for the district and goals that he 

19   wanted to achieve through working through input 

20   of the community for those goals.  

21                But the other thing of interest was 

22   he produced an annual report every year to report 

23   back on his success or not success on achieving 

24   those goals.  So he was all about accountability 

25   and transparency.  And I think that's the way

 1   he's conducted himself in government.  And I 

 2   think that that kind of leadership is sorely 

 3   needed here in the state as well.

 4                As was mentioned, his experience up 

 5   here in the Assembly, at the state level, serving 

 6   at the county level, serving for the City of 

 7   Buffalo level, and also his many years in private 

 8   sector are all of experience that he has garnered 

 9   to bring now to this position to make him a great 

10   impactful leader in the Department of Motor 

11   Vehicles.

12                Also, I believe just from my 

13   experience as being a county clerk and running a 

14   local auto bureau, I know that Mark will view 

15   local county clerks as an asset and as a partner 

16   and work with them and know that is the best way 

17   to deliver quality service to the constituents 

18   throughout the State of New York.

19                Again, to Mark, to Kate, to his 

20   whole family, congratulations to you and look 

21   forward to working with you up here in Albany.

 8   more than any other elected official in Ulster 

 9   County, earned the respect of both Democrats and 

10   Republicans wherever he went or whatever he 

11   touched.

12                When we think of Democratic politics 

13   in Ulster County, we naturally think of Kingston 

14   and New Paltz.  But there are many communities in 

15   Ulster County that are not nearly as Democratic 

16   as those.  I represent a couple of them.  And 

17   Mike Hein, through demonstration of his elections 

18   and otherwise, has proven that he has won support 

19   across the aisle because of his ethics and 

20   because of the great job he did as county 

21   executive that he now gets to do on behalf of all 

22   New Yorkers around the state.  

23                Congratulations, and thanks for your 

24   service, Mike.

 3   and continues to be important as we continue with 

 4   some of the issues that we are working on with
