3 1806, by Senator Reichlin-Melnick, honoring
4 Piermont Firefighter Thomas Pomplin posthumously
5 upon the occasion of being the first
6 African-American Line of Duty Death in
7 Rockland County.

10 SENATOR REICHLIN-MELNICK: Thank
11 you, Mr. President.
12 And on this day here in February, in
13 the middle of Black History Month, I want to rise
14 to recognize the line-of-duty death of
15 firefighter Tom Pomplin, who passed away more
16 than 150 years ago on a summer day in 1854 in
17 Rockland County. But his death has just recently
18 come to light and been recognized as the first
19 line-of-duty death of a firefighter in Rockland
20 history.
21 Tom Pomplin was born in 1826 and, as
22 a young Black man growing up in Rockland County
23 in the early 19th century, surely he faced his
24 share of difficulties, of discrimination and of
25 difficulties as he went about his life. And yet

1 he was able to serve in the Piermont Fire
2 Department, surely one of the first integrated
3 fire departments in New York State -- until a
4 fateful day in the summer of 1854 when a fire
5 started to consume a factory a few miles away
6 from Piermont on the Nyack waterfront.
7 Along with his colleagues in the
8 Piermont Fire Department, Firefighter Pomplin
9 raced more than 3 miles to the scene, pushing the
10 fire apparatus by hand. When he got to the
11 scene, there was a fire consuming this factory
12 and he and many of his colleagues rushed to try
13 to save it. Tragically, a few days later, he
14 passed away from the strain and the injuries that
15 he sustained.
16 We don't know as many details as we
17 wish that we did, but we want to recognize his
18 sacrifice. And there has recently been a
19 movement in my community, in Piermont, to
20 recognize the sacrifice of firefighter Tom
21 Pomplin, the first line-of-duty death, to honor
22 him with a fitting memorial to the service he
23 gave to his community then, and to acknowledge
24 his efforts as a pioneer and a path-breaker in
25 the fire service in Rockland County.

20 death of Dream Shepherd, the inspiration behind
21 New York State's Dream's Law.

25 you, Mr. President.

1 And this is a somber resolution to
2 have to read because it honors the loss of a
3 beautiful and wonderful young lady,
4 Dream Shepherd, who passed away in 2021 at the
5 age of just 16 years old.
6 As a student at Ossining High
7 School, she had been an inspiration to so many
8 people in the community. And she and her mom led
9 to the passage directly of critical legislation
10 which passed this house just a few short years
11 ago, Dream's Law.
12 She was actually recognized as one
13 of the Women of Distinction in New York State,
14 surely one of the -- just 12 to 14 years old,
15 surely one of the youngest to have been awarded
16 that.
17 Dream suffered from sickle cell
18 anemia. She dealt with many challenges in her
19 life, and that inspired her to push for the
20 passage of Dream's Law to help other children
21 dealing with what she dealt with make sure that
22 they would not have to go through what she went
23 through.
24 And while that bill passed, we are
25 still working to pass another bill in her memory,

1 Shepherd Patterson's Law, which would make sure
2 that whenever a child such as Dream is diagnosed
3 with a serious medical condition that keeps them
4 out of school for an extended period of time,
5 that their doctor would notify the family that
6 they probably have the right to an educational
7 accommodation from their school district.
8 We passed this bill in the Senate
9 last year and are hoping the Assembly will pass
10 it this year, because what could be more fitting
11 than to remember the heroic life of this young
12 girl with passage of a legislation that bears her
13 name.
14 I'm proud to support this
15 resolution. I mourned with the entire community
16 in Ossining, and she was beloved and well-liked
17 by everybody who knew her. Ossining recently
18 dedicated a section of their Main Street and
19 called it Dream Shepherd's Way.
20 And we are happy to honor her today
21 and to remember her sacrifice and to remember the
22 life that she lived and the people she touched,
23 because she did more in her 16 years on this
24 earth than many people can do in 60.

7 Senator Reichlin-Melnick for ensuring that we
8 take this moment to remember and really honor the
9 contribution of this unbelievable 16-year-old
10 girl, Dream Shepherd, and the energy and passion
11 she brought to making a change in this world as
12 she struggled with sickle cell.
13 And prior to COVID, I met with her
14 mother, Diana Lemon, who is a force of nature
15 herself and determined to make a difference in
16 the lives of those who have children with sickle
17 cell. And she came to tell me this story, which
18 resulted in Senator Reichlin-Melnick introducing
19 and our house passing this important bill called,
20 ironically, the Shepherd Patterson Law.
21 And the reason it's called Shepherd
22 Patterson is because her mother told me the story
23 that Ms. Patterson, Dream's teacher when she was
24 five years old, recognized and heard the issues
25 that confronted this young child in kindergarten.

1 And because of Ms. Patterson, a teacher in
2 kindergarten being, as she said, vigilant and
3 hyperintuitive about Dream's normal behavior, she
4 noticed something that many others might have
5 disregarded. "But because Ms. Patterson listened
6 to me and paid attention to my child, her actions
7 prevented something that could have been tragic."
8 And she went on to say that "It
9 dawned on me, when Dream was in kindergarten and
10 I presented information about her disability to a
11 roomful of educators in our initial meeting, not
12 one person mentioned that I should request a
13 Committee on Special Education meeting in order
14 to get a 504 plan for Dream. It is very clear to
15 me that I should have been advised of this,
16 because it is a legal instrument and one of the
17 first U.S. civil rights laws offering protection
18 for people with disabilities."
19 So today while we honor the
20 extraordinary memory and contributions of
21 Dream Shepherd, let us also contribute and
22 continue her legacy by ensuring that the
23 Shepherd Patterson Law, which provides additional
24 protection for these parents and their children,
25 gets passed again in our house -- which I'm

1 confident it will -- and in the Assembly.
2 This is a moment of tribute to an
3 extraordinary young woman who made a mark not
4 only on her community of Ossining, but the whole
5 State of New York.

25 I rise to explain my vote in support

1 of this bill by Senator Gianaris. I think it is
2 a long overdue bill. I'm glad that we passed it
3 last year, glad we're passing it again this year,
4 because the problem of fraud and scams targeting
5 people in our communities has really reached an
6 epidemic level.
7 And many of them could be prevented
8 if banks took some simple and common sense steps
9 that this bill would require to notify customers
10 about the possibility of fraud.
11 I think of one of my constituents,
12 an older gentleman from West Nyack, who was
13 scammed into sending $35,000, nearly his whole
14 life savings, to scammers in Peru. They faked
15 his bank transcripts, they convinced him that
16 there had been a problem with his account. And
17 at no point when he went to his bank to try get
18 that problem dealt with and send that money to
19 Peru -- because the scammers had convinced him
20 that he needed to do that -- did the bank ask
21 him: Are you sure you want to do this? Why are
22 you sending $35,000 to Peru? That's all the
23 money in your account. Are you sure you want to
24 do this? Do you realize that this might be
25 fraud?

1 Nobody made these conversations with
2 him, and as a result this gentleman lost almost
3 his entire life savings.
4 And so if a bill like this can
5 prevent anybody else from having to deal with a
6 problem like that and suffer that fate, I think
7 it is something that is really valuable for this
8 house to pass, and I'm proud to vote aye.

20 friend Senator Kennedy. It's a well-intended
21 bill. However, unfortunately -- do you want me

7 SENATOR SAVINO: That's what you
8 call adding insult to injury. However, I will do
9 so.

11 SENATOR SAVINO: So, Mr. President,
12 I rise in opposition to Senator Kennedy's
13 well-intended bill.
14 We're all in support of buying from
15 New York, buying USA. However, the bill as it is
16 currently written would have an effect on a
17 business that has been in Staten Island since
18 1955, and it employs almost 200 people, Atlantic
19 Salt. Atlantic Salt provides rock salt for the
20 downstate region, for New York, New Jersey,
21 Connecticut.
22 If we were to pass the bill as it's
23 currently written, Atlantic Salt would no longer
24 be allowed to operate. They would literally go
25 out of business, because their salt is obtained

1 from South America.
2 So I have offered to work with
3 Senator Kennedy and the Assembly sponsor to find
4 a way to accommodate both the demand to help a
5 business in Rochester that has been affected by
6 this, without putting a business in Staten Island
7 out of business.
8 Unfortunately, at this time I cannot
9 support this bill. I vote in the negative.
