5 SENATOR RHOADS: Thank you,
6 Mr. President.
7 I rise today to recognize
8 Nassau County Police Department -- now retired --
9 Captain Timothy Jaccard for the amazing work that
10 he has done in his professional and civilian
11 life, and in recognition of his receipt of the
12 2025 Liberty Medal from the New York State
13 Senate.
14 I have had the honor of knowing
15 Tim Jaccard since I was three years old. Tim and
16 I actually were backyard neighbors. My parents'
17 house backed up against his. In fact, our first
18 puppy as a kid came from his dog's litter.
19 So we know each other a long time.
20 Even though he's probably about 15 years older
21 than I am, he is truly an exceptional individual.
22 And to give you a set of circumstances, it was
23 1998 and Captain Timothy Jaccard, who at that
24 point was a 25-year veteran of the Nassau County
25 Police Department, found himself in the middle of

1 a circumstance unimaginable to most people.
2 Called to a crime scene as a member
3 of the Nassau County Police Department's
4 ambulance medical technician team, he discovered
5 the body of a dead infant in a garbage can. Not
6 for the first or last time, he was moved with
7 compassion for an innocent life cut short. And
8 so began the AMT Children of Hope Baby Safe Haven
9 Foundation.
10 Tim Jaccard's initial mission was to
11 bury every infant in Nassau County who was
12 abandoned and died or had been killed. To bury
13 the babies, however, Captain Jaccard had to
14 become their legal guardian. And since that day,
15 Tim has adopted and provided dignified burials
16 through his foundation of hundreds of children,
17 all with the surname Hope.
18 "What is heartbreaking over the
19 years is that I have buried more than 200
20 babies," Captain Jaccard said in 2023. "We bury
21 these children with honors. We have a ceremonial
22 baptism where the babies are dressed in a tuxedo
23 or baptismal gown and placed in a casket. We
24 usually have 50 to a hundred motorcycles that
25 escort the babies from the funeral home to the

1 church."
2 But as the AMT Children of Hope
3 Foundation grew, Captain Jaccard was moved beyond
4 that noble mission, realizing that the parents
5 who committed these unthinkable acts of cruelty
6 often did so because they made the wrong
7 decision, thinking they had no other option. And
8 so Tim asked himself, What if I provided that
9 other option?
10 And Tim began pushing for what he
11 called safe haven laws that would allow women who
12 have just given birth, or a father, to surrender
13 their infant at a hospital, firehouse or police
14 station, no questions asked, without penalty.
15 In 1999 he found an ally in
16 Texas Governor George W. Bush, pointing out that
17 the City of Houston had more than a dozen infant
18 abandonment deaths a year earlier. And
19 Captain Jaccard lobbied the governor to make a
20 safe haven law a legislative priority.
21 That year Texas adopted the
22 Baby Moses Law, named after the biblical hero who
23 had been abandoned at birth.
24 With the help of my predecessor,
25 Senator Chuck Fuschillo, New York enacted its

1 version of the law in 2000.
2 And thanks to his efforts, by 2008
3 all 50 states had enacted baby safe haven laws.
4 The only jurisdiction that hadn't was Washington,
5 D.C. And on Christmas Eve of that year, then
6 President George W. Bush called Tim to let him
7 know that he had signed a proclamation creating
8 the program in the District of Columbia,
9 completing his nationwide quest.
10 To date the AMT Children of Hope
11 Baby Safe Haven Foundation -- founded to bury
12 babies that were lost -- together with its
13 160 volunteers, has saved over 5,000 babies, and
14 he has personally rescued over 300, delivering a
15 hundred of those babies personally.
16 For his part, Tim Jaccard's greatest
17 joy is watching youngsters like
18 Brandon Laracuente grow up with parents who adore
19 them. Ilene Laracuente and her husband, Ed, who
20 live in Bethpage, in my district, adopted young
21 Brandon, who had been relinquished to the
22 Children of Hope when he was 6 weeks old.
23 "It was a godsend for us," said
24 Ilene, who was also adopted. "He's wonderful,
25 wonderful, wonderful, a smart, smart, smart child

1 and a loving child."
2 And Brandon, who is now a teenager,
3 hopes to be a doctor. "I'm happy that they care
4 for me and that they love me," he said of his
5 parents.
6 One of the most often told stories
7 is of a baby named Molly, who was born a day
8 before 9/11 in New York's Central Park. Molly's
9 biological mother gave birth to her in
10 Central Park just before sunrise on September
11 10th, with the aid of Medical Officer Tim
12 Jaccard. Molly was not abandoned but was legally
13 relinquished by law, through the NYPD and the
14 AMT Children of Hope Foundation. She is now
15 20 years old and living happily with her adopted
16 parents in New York.
17 Tim Jaccard, to me, is not only a
18 great friend, but he is a true hero. In a world
19 where the value of life is sometimes called to
20 question, he has dedicated first his professional
21 career, but now his career in retirement to
22 saving and preserving lives, making an
23 immeasurable difference in the lives of thousands
24 of babies who now have a chance to grow up and
25 contribute to this world.

1 It is our hope that we can always
2 use the gifts and talents that we've been given
3 to try and make our corner of the world a little
4 better place. Tim Jaccard has dedicated his life
5 to making our nation a better place, and has made
6 a tremendous difference.
7 And so, Mr. President, Tim Jaccard
8 unfortunately was a little under the weather and
9 is not able to be here today. I will be
10 presenting the Liberty Medal to him back in the
11 district. But I know that he is watching on
12 television.
13 I would just ask that you extend
14 congratulations on behalf of the Senate to Tim in
15 absentia and know that we gratefully appreciate
16 everything that he has done for the people of the
17 State of New York and for our nation.

21 First and foremost, Mr. Jaccard, get
22 better. We thank you for your service and
23 appreciate your heroic actions.

14 THE SECRETARY: Resolution 1131, by
15 Senator Rolison, posthumously honoring the life
16 and service of United States Army Air Forces
17 Staff Sergeant Eugene J. Darrigan, who was laid
18 to rest in his hometown of Wappingers Falls,
19 New York, on May 24, 2025, more than
20 eight decades after his death in World War II.
21 ACTING PRESIDENT BAILEY: Senator
22 Rolison on the resolution.
23 SENATOR ROLISON: Mr. President and
24 my colleagues, it is an honor for me today to
25 essentially tell a story, to tell a story about

1 an individual who, 81 years after he was shot
2 down over the South Pacific -- this is Staff
3 Sergeant Eugene Darrigan, a native of Wappingers
4 Falls in Dutchess County, in my district, he was
5 found, 81 years later.
6 And the story of his service is the
7 story of so many of our service members, their
8 service, their commitment, their bravery, their
9 heroism, and so many who have lost their lives.
10 So this past Memorial Day was a very
11 special Memorial Day in Wappingers because
12 Staff Sergeant Darrigan was buried Memorial Day
13 weekend. And he served in the Army, in the
14 Army's Air Service. And he was in New Guinea,
15 with other bombers. They were B-24 Flying
16 Fortresses. And even though the war was winding
17 down in Europe, it was not winding down in the
18 South Pacific. Actually, it was raging.
19 And on March 11th, he and his
20 10 crew members, brothers, went up from
21 New Guinea with multiple other B-24s to conduct a
22 bombing mission.
23 And he was a radio operator, and we
24 believe that he actually was radioing the bombers
25 that were behind, because they were in front,

1 that -- where the enemy aircraft guns were. And
2 tragically, that anti-aircraft gunnery got that
3 B-24, and they went down in the South Pacific.
4 And because the other B-24s knew it,
5 they actually circled the area for a while and
6 marked where that B-24 had gone down. And for
7 81 years, he was missing, he was gone, along with
8 his comrades.
9 And because of Project Recover,
10 which is a nonprofit organization dedicated to
11 recovering service members, they found the
12 remains of that plane in 2017. And five years
13 later they actually, with the assistance of the
14 Defense POW/MIA Accounting Agency, which is DPAA,
15 and researchers from the Scripps Institution of
16 Oceanography, they were able to go down there.
17 It was the deepest-ever recovery
18 mission held. Elite Navy divers went down to
19 where the plane was, and they collected material
20 from the ocean floor. And among those recovered
21 items were Staff Sergeant Eugene Darrigan's tags.
22 And he had a son when he went to
23 World War II, who was six months old. He's since
24 gone. His wife, since gone.
25 But interestingly enough, his

1 goddaughter, his niece, Ginny Pineiro -- who I
2 knew as a patrol officer in the 1980s, who was
3 the branch manager of a bank in Poughkeepsie --
4 was still alive. At age 85, she got to be in
5 Wappingers to welcome home the remains of her
6 uncle and her godfather.
7 And her two daughters, who I think
8 are listening today, Lisa Vetter and
9 Susan Mitchell, had been friends of mine since
10 then.
11 I never knew about Eugene until they
12 brought him home. And in conversations that I
13 had around the Memorial Day weekend, both with
14 Susan and Lisa, and then actually seeing
15 Mrs. Pineiro, which was actually heartwarming --
16 they gave her the flag, full military honors --
17 that I heard that he actually sent her cards from
18 New Guinea for like her birthday. And I believe
19 she still has one from New Guinea from her uncle
20 Eugene.
21 So as I conclude these remarks, I
22 mean certainly this is a great story. People
23 came from all over the Wappingers Falls area.
24 Over 200 people were there at the church for the
25 military funeral.

1 But here is something that I find
2 just absolutely just -- it's beautiful. The name
3 of that B-24 was called Heaven Can Wait. And
4 here we are, 81 years later. Heaven was waiting
5 for him. And heaven continues to wait and will
6 wait for every service member, Mr. President, who
7 has not come home.
8 We cherish them. We thought of them
9 over Memorial Day. But today, for me, and for us
10 as a body, we get to think about Eugene Darrigan.
11 Without his sacrifice and the sacrifice of so
12 many others, we wouldn't be here talking about
13 it.

13 This bill creates what we're going
14 to call the Overdose Prevention and Recovery Act,
15 a bill that meets the moment in the fight that we
16 are against with the opioid crisis.
17 Overdose deaths have soared across
18 New York State, devastating families and
19 communities alike. And even as the crisis grows
20 and actually fluctuates -- some numbers did go
21 down -- funding for recovery support services,
22 which is a lifeline that helps people rebuild
23 their lives, remains fragile and unsustainable.
24 As we've seen over the last few
25 months, federal services are being cut and

1 without prejudice. Without permanent, reliable
2 funding, these essential services cannot be there
3 for every person in need.
4 This legislation changes that. It
5 makes the Opioid Stewardship Fund permanent and
6 ensures that at least 20 percent of its resources
7 go directly to support recovery services, with a
8 matching investment in harm reduction.
9 At a time when indiscriminate cuts
10 are coming from the federal government,
11 stabilizing this funding is more critical than
12 ever. It's not enough to fight addiction on one
13 front; we must support every step of someone's
14 recovery journey.

20 Mr. President, for allowing me to explain my
21 vote.
22 All too often the debate around
23 incarceration is reduced to cold statistics,
24 budgets and regulations. But at the heart of
25 this issue are people, and we must never lose

1 sight of that. People who have made mistakes --
2 of course they have -- but people who are still
3 fathers, mothers, sons, daughters, mentors,
4 friends, and are human beings. And like all
5 human beings, they deserve something basic and
6 essential: The dignity of human connection.
7 Protecting in-person visitation is
8 not a minor bureaucratic adjustment, it is a
9 profound affirmation of our values. This
10 proposal assures that every person deprived of
11 their liberty has the right to real, meaningful
12 and humane in-person visits.
13 We are talking about visits that can
14 take place on weekends, at times that are
15 accessible to working families. Visits that last
16 more than just a few minutes. Visits that foster
17 real, lasting bonds. And visits that cannot be
18 arbitrarily suspended for administrative reasons
19 made without transparency or fairness.
20 Why does this matter? Because study
21 after study has shown what we already know in our
22 hearts: People who remain connected to their
23 loved ones while serving a sentence are more
24 likely to rehabilitate, less likely to reoffend,
25 and more likely to rebuild their lives upon

1 release.
2 This is a policy of humanity. It is
3 a policy of public safety. It is a policy of
4 common sense. That is why, as a New York State
5 Senator and a proud representative of the Bronx,
6 as a proud servant, and as a human being, I am
7 proud to sponsor this legislation and ask my
8 colleagues to support it by voting aye and join
9 my conviction.
10 Let's make New York a model of
11 connection, compassion and dignity. Let's
12 protect in-person visitation. Let's protect our
13 families. Let's protect the right not to be
14 forgotten.

17 teacher, my math teacher Tom Harvey, reached out
18 to me to tell me a story about how he had
19 remarried and he wasn't able to change who his
20 beneficiary is on his teacher pension. He told
21 me the story, we wrote a bill, we introduced the
22 bill. It got the support of NYSUT.
23 Unfortunately, it didn't make it.
24 A year later he called me to tell me
25 that he had terminal cancer and that he didn't

1 have long to live. But we introduced the bill
2 again; unfortunately, it didn't make it.
3 But I'm glad it's passing today
4 because there are so many others that are in the
5 same situation. You know, we live longer now.
6 We retire. Life changes. You get divorced, you
7 get remarried. They should have the opportunity
8 to change who their beneficiary is. They worked
9 hard. They paid into that pension system 20,
10 30 years or more.
11 It was a simple request. I wish we
12 could have done it for Tom Harvey, but I'm glad
13 we're doing it today. Thank you.

2 Our schools all around the state
3 teach art and music but because the subjects are
4 not required in statute, when there are
5 rollbacks, cutbacks in a school district, one of
6 the first things to go tends to be art and music
7 education.
8 When I think about my experience in
9 elementary school, I can't remember any facts I
10 learned, but I remember every song we sang. And
11 I remember that glow of pride when the teacher
12 hung one of my pictures on the wall.
13 Arts and music develop us as
14 human beings. They develop the whole child. For
15 some kids, they are the only reason they show up
16 at school, or the only thing they look forward to
17 in the school day. Arts and music are just part
18 of what makes us human.
19 I'm very grateful to my colleagues
20 on both sides of the aisle who support this bill,
21 to the Education chair and the Education staff
22 who helped get it to this point.
23 This has been a multiyear effort,
24 and I am thrilled to vote aye.

3 This bill addresses the devastating
4 impact of the crisis that we know that enters the
5 workplace. Because if you're suffering with
6 addiction, it's not just something you do at home
7 or in your time off. It can happen in the
8 workplace.
9 And this bill makes sure that when
10 emergencies strike, every second counts. We
11 already require that first aid materials in
12 certain workplaces to handle injuries and
13 emergencies are available, and this bill would
14 require that the same workplaces also have
15 opioid antagonists on hand and in the area.
16 It is a simple lifesaving step. It
17 ensures that if someone suffers an overdose in
18 the workplace, help is immediately available,
19 giving them a fighting chance for survival.
20 The legislation is about building
21 workplaces that are supportive of those most in
22 need. It recognizes that addiction doesn't
23 discriminate. It affects coworkers, employees
24 and their families.
25 By making opioid antagonists a

2 we are affirming our commitment to protecting
3 New Yorkers.

4 Few things are as foundational as
5 access to healthy and nutritional food. And that
6 is so important in communities like the ones I
7 will represent in East Harlem and the South
8 Bronx, and communities all across the State of
9 New York.
10 But we've seen a very troubling
11 trend when it comes to skimming of EBT benefits,
12 SNAP benefits on EBT cards. And the way that we
13 remedy that, that we help remedy that, is by
14 using technology that is available to us in the
15 form of chip technology on these cards, to ensure
16 that these needed benefits help those who are the
17 most vulnerable in our society to access their
18 healthy food and nutritious foods.
19 So I'm grateful that we are passing
20 this bill here today. I'm very grateful for the
21 leadership of Assemblymember González-Rojas in
22 the Assembly, so that we can ensure that our
23 communities are able to not have their benefits
24 stolen and be able to support themselves, support
25 their families.

11 As was mentioned, since 2022
12 New Yorkers have lost $40 million in stolen
13 benefits. This has become a growing trend, and
14 this is the step that we can take to correct it.
15 Also good news, while it will
16 cost -- and I've heard estimates anywhere from
17 20 to 40 million initially to institute this --
18 the federal government will split that
19 fifty-fifty with us.
20 So while the bill does ask that we
21 get this done no later than June 21st of 2027,
22 for any of the departments listening, please
23 don't wait that long. Let's get this done as
24 soon as possible. You've got needy New Yorkers
25 who are counting on this.

9 life advocating for the predecessor to SNAP, the
10 Food Stamp Program, helping hundreds of thousands
11 of New Yorkers to successfully apply and
12 participate.
13 It's scary enough that we're now
14 facing a federal government who's proposed
15 dramatic and dangerous cuts to SNAP program
16 dollar benefits and eligibility. But the concept
17 that we know that there are thieves stealing
18 these benefits from the debit cards, called EBT,
19 that we could stop because the technology exists.
20 I challenge any of my colleagues to
21 open their wallets right now, look at their
22 credit cards, and find a non-chipped card.
23 Everyone has moved to a chipped card because it
24 is so much harder to scam them at a register when
25 you are shopping.

1 And yet the state keeps promising to
2 move forward with the exact same technology for
3 EBT used for SNAP, public assistance, and I
4 believe WIC benefits, and these people are the
5 people who are least able to afford to lose these
6 benefits.
7 So I'm very glad that we're passing
8 this, and I hope the Governor understands we're
9 all on the same side. We just need to move
10 faster. We just have to move faster.

8 I rise today to lift up this
9 important legislation that recognizes something
10 we know to be true and, quite frankly, we should
11 have done a long time ago, and that is we
12 recognize that nurses are the backbone of our
13 healthcare system and their voices belong in
14 every room where decisions are made, especially
15 at the highest levels.
16 This bill would require hospitals to
17 include a registered professional nurse as a
18 sitting and voting member of the governing body
19 responsible for shaping the hospital's strategic
20 plan, their systems and policies.
21 It is a simple but powerful change,
22 and one that is long overdue. Nurses bring a
23 unique and essential perspective to patient care.
24 And as frontline providers, they offer hands-on
25 support, they identify early signs of

1 complications, they advocate for patients and
2 their families, and uphold the safety and dignity
3 of everyone who enters a hospital.
4 Yet, far too often their voices are
5 excluded from key decisions that shape how care
6 is delivered. Mr. President, by adding a
7 registered nurse to the hospital governance
8 structure, we ensure that decisions around
9 staffing, quality of care, and patient safety are
10 grounded in real-world clinical experience.
11 This isn't just good for nurses,
12 it's good for our patients, families, and the
13 entire healthcare system.
14 I want to thank all the nurses
15 across our state for their tireless advocacy on
16 this issue, but also for the care that they
17 provide. I am proud to stand with them today and
18 also offer that, yes, they deserve a seat at the
19 table.

9 I rise today in support of this
10 legislation, and I just want to note that this is
11 about providing dental loan repayment and
12 practice support for dentists who agree to serve
13 in underserved areas.
14 Right now dental deserts are in
15 about 161 areas across New York State. We are
16 about 500 dentists short in order to just meet
17 current standards. And we only graduate about --
18 of the dentists we have, only about one in five
19 take Medicaid recipients.
20 In one of my counties, in
21 Montgomery County, we have just 19 registered
22 dentists in the entire county of 50,000 people,
23 which is a ratio of about one dentist to every
24 2600 persons with access to those dentists.
25 And again, because our Medicaid

1 reimbursement rates are so low -- often
2 40 percent of what insurance covers -- they are
3 refusing to take Medicaid.
4 This would create a loan repayment,
5 and it would urge those to serve in rural
6 New York as well as our underserved urban areas.
7 It is very similar to the successful program of
8 Doctors Across New York. And we hope that this
9 will go a ways toward filling a very serious
10 crisis.

8 I rise today with gratitude to the
9 lawmakers of New York State, our Leader
10 Stewart-Cousins, and public health advocates from
11 Buffalo, Erie County, and again across the state.
12 I also rise today as a mother who
13 was at one time told by my son's pediatrician
14 that his blood lead levels had spiked while at a
15 doctor's visit. I rise as the sister of younger
16 siblings who contracted lead poisoning when they
17 were toddlers. I rise today, Mr. President, as
18 the district representative of Buffalo, New York,
19 where children in Black communities are 12 times
20 more likely to contract lead poisoning than
21 children in predominantly white communities.
22 I rise today as the representative
23 of Buffalo, New York, the home of some of
24 New York State's oldest housing stock.
25 I rise today, Mr. President, feeling

1 accomplished. As a county legislator back in
2 2019, I introduced a resolution calling on
3 New York State to make early intervention
4 services automatically available to children with
5 elevated blood lead levels.
6 As it stands, early intervention
7 services are reserved for babies, children who
8 are born with very specific disabilities. The
9 law currently reads: Fetal alcohol syndrome,
10 physical or mental conditions or sensory
11 delays are the sole circumstances in which a
12 child in New York State can receive early
13 intervention services.
14 As it stands, before today's vote, a
15 child who has lead poisoning is not automatically
16 allowed to have early intervention services.
17 Early intervention services allow
18 children who have been identified as having
19 delays because of environmental disorders the
20 services that they need to get prepared to become
21 quality students when they then enter into grade
22 school.
23 I passed this resolution in 2019,
24 and today I'm no longer a county legislator, I'm
25 a State Senator who's sponsoring the bill that I

1 called on the state to pass. And so I'm pretty
2 proud of April Baskin, my team, and my community.
