25 We're on our fourth extender on this

1 late budget at this point. And my understanding
2 is that this extender takes us through Monday,
3 and it's adding an additional $79 million in
4 additional spending, bringing our total
5 extenders' amount of these four to $7.2 billion.
6 Is that correct?
7 SENATOR GIANARIS: No, because the
8 extender takes us to Monday, not through Monday.
9 But otherwise, yes, you're correct.
10 SENATOR O'MARA: Okay.
11 Through you, Madam President, if the
12 Senator will continue to yield.

19 we will need to do -- if the nine budget bills
20 aren't done by Monday, and passed, we'll need to
21 do another extender in Monday.

23 that to happen, Senator O'Mara.

8 us what is being covered with this $79 million in
9 additional spending to get us to Monday?
10 SENATOR GIANARIS: Well, as you
11 pointed out, it's a very nominal amount in the
12 scheme of the over 7 billion we've appropriated
13 so far. So these are just routine additional
14 appropriations that the state needs to make
15 payments.
16 SENATOR O'MARA: Through you,
17 Madam President, if the Senator will continue to

19 ACTING PRESIDENT MAYER: Do you

21 SENATOR GIANARIS: Yes.

24 SENATOR O'MARA: Well, $79 million
25 may not be a huge percentage of the overall

1 budget that's going to be about 270 billion.
2 Seventy-nine million dollars still is not a
3 nominal amount, in my opinion, and I'm sure
4 neither in any opinion of any constituent that I
5 represent.
6 So can you give us some detail on
7 what the $79 million is actually going to go to?
8 SENATOR GIANARIS: Sure.
9 I'll give you the whole list, since
10 you asked, and since you like longer answers,
11 from what I remember.
12 (Laughter.)
13 SENATOR GIANARIS: Twenty-five
14 thousand for personal service; $23.5 million for
15 Social Security, 675,000 for the metropolitan
16 commuter transportation mobility tax, 350,000 for
17 SUNY pensions, 178,000 for auto accidents,
18 4.28 for the Department of Health Center for
19 Community Health. What else do we have here?
20 196,000 for the Community Support Program at the
21 Justice Center. Thirty million for unemployment
22 benefits -- I'm sure you want those to go out.
23 Thirteen-point-1 million for the MTA support;
24 3.9 million for OPWDD non-Medicaid residential
25 services; 960,000 for non-Medicaid day services;

1 1.08 million for non-Medicaid family support and
2 services; 624,000 for non-Medicaid employment
3 services; 24,000 for homeless veterans housing;
4 and 160,000 for other non-Medicaid payments.
5 SENATOR O'MARA: Thank you.

15 for us why not? What are the sticking points to
16 getting to table targets?
17 SENATOR GIANARIS: The sticking
18 points are the same they've been since we've been
19 having these conversations. We continue to
20 negotiate with the Executive over CLCPA
21 rollbacks, SEQRA reform, auto insurance issues,
22 immigration, aid to New York City, and various
23 others.
24 I will say this week has been
25 somewhat more promising, as discussions seem to

1 be making slow and steady progress.
2 SENATOR O'MARA: Through you,
3 Madam President, if the Senator will continue to

5 ACTING PRESIDENT MAYER: Do you
6 continue to yield?
7 SENATOR GIANARIS: Yes.
8 ACTING PRESIDENT MAYER: The
9 Senator yields.
10 SENATOR O'MARA: At least I've read
11 in the news in recent days there's been a new
12 proposal thrown out there on policy, and that's
13 the pied-a-terre tax on second homes in New York
14 City. That's something new that's been thrown
15 out. Is that thrown out by the Governor or is
16 that thrown out by Mayor Mamdani through the
17 Governor?
18 SENATOR GIANARIS: Senator O'Mara
19 has been here long enough to know that it was
20 originally a Senate Democrat proposal by then
21 Senator Hoylman-Sigal, now borough president of
22 Manhattan.
23 And so the idea has been in
24 existence for several years. It's something that
25 the Governor has thrown her support behind in the

1 last couple of days.
2 SENATOR O'MARA: Thank you,

4 Madam President, if the Senator will

12 the CLCPA issues that are a stumbling point at
13 this point, can you describe for us what
14 proposals the Governor has put forth in regards
15 to extending some of these deadlines on the
16 CLCPA?
17 SENATOR GIANARIS: No.
18 SENATOR O'MARA: Through you,
19 Madam President, if the Senator will continue to

2 put forth specific issues with regards to changes
3 to the CLCPA?
4 SENATOR GIANARIS: Yeah, there have
5 been conversations back and forth around elements
6 of the CLCPA.
7 SENATOR O'MARA: Through you,
8 Madam President, if the Senator will continue to
9 yield.
10 ACTING PRESIDENT MAYER: Do you
11 continue to yield?
12 SENATOR GIANARIS: Yes.
13 ACTING PRESIDENT MAYER: The
14 Senator yields.
15 SENATOR O'MARA: Another one of the
16 major stumbling blocks seems to be auto insurance
17 reform. Can you tell us where the proposals on
18 that stand in the discussions?
19 SENATOR GIANARIS: The Governor's
20 is what's publicly known through her proposals
21 and statements. And we are going back and forth
22 to try and find the right balance for what is in
23 the best interests of New Yorkers.
24 SENATOR O'MARA: Through you,
25 Madam President, if the Senator will continue to

4 SENATOR GIANARIS: Yes.

7 SENATOR O'MARA: And another major
8 issue is Tier 6 reform that could be
9 all-encompassing or it could be certain aspects
10 of it.
11 Where do those proposals stand up at
12 this point on reforms to Tier 6?
13 SENATOR GIANARIS: Well, I think
14 there's a genuine interest in making significant
15 reforms.
16 Senator O'Mara was also here, I
17 believe, when that was first enacted and the
18 then-members of our Democratic Conference walked
19 out in protest rather than supporting that.
20 So we recognize there's a need to
21 make changes, and we're trying to figure out
22 what's feasible while minimizing the burdens on
23 our local governments.
24 SENATOR O'MARA: Through you,
25 Madam President, if the Senator will continue to

8 on the various SEQRA changes, proposals that are
9 out there on -- with regards to housing?
10 SENATOR GIANARIS: I think that's
11 something that all sides want to get to yes on.
12 And so I think, of all the issues we've talked
13 about, that may be the one that's furthest along
14 in terms of reaching agreement in line with what
15 the Governor is seeking.
16 SENATOR O'MARA: Through you,

21 SENATOR GIANARIS: Yes.

25 general outline of where you think that is, where

1 everybody seems to be comfortable with?

8 helpful information for us, as usual on these
9 extenders, which is concerning.
10 And more importantly, no information
11 for the citizens of New York State on what is
12 really being discussed behind closed doors with
13 three people in a room on what will be somewhere
14 between a $263 billion and $270 billion budget.
15 As I've said before, New Yorkers
16 deserve to know what's being talked about behind
17 those closed doors and what progress is being
18 made so that they can actually weigh in to us and
19 tell us what they think about them, rather than
20 just coming out in the middle of the night --
21 which is par the course around here -- and voting
22 on them within a few hours.
23 We need the time to review these
24 things. The public needs the time to review
25 these things and provide us their input on those.

1 Where this extender takes us:
2 Three more days, gets us through Friday, Saturday
3 and Sunday into Monday. You know, I'll continue
4 to support this -- extenders at this point, but
5 it's growing increasingly concerning, the lack of
6 progress and, more importantly, the lack of
7 details on what is actually being discussed so
8 New Yorkers can know exactly what we're talking
9 about here behind closed doors in Albany.
