11 throughout their journey as the team won the
12 OCIAA Division 4, Section 9 Championship and then
13 went on, Madam President, to the New York State
14 Class D Championship, finishing undefeated with a
15 record of 4-0 in their division and 8-0 overall.
16 And I would like to take a moment to
17 personally introduce Addison Dymond -- if you
18 would stand, please -- Anna Furman,
19 Maria Gelsomino, Angelina Hinkley, Kenzie Krier,
20 Mia Murphy, Emma Richardson, Zoey Sullivan, and

18 we are joined today by none other than
19 Miss America, who is a proud resident of the
20 12th Senate District in Sunnyside, Queens.
21 Cassie Donegan is her name, if I could ask Cassie
22 to rise.
23 She currently serves as the
24 98th Miss America and is the eighth New Yorker to
25 hold the title, which is the most among all the

1 states in the nation.
2 She's dedicated to advocacy,
3 education and community service across the
4 nation. An Actors' Equity performer, arts
5 educator and COO, she has combined her
6 professional experience in the arts and
7 leadership with a passion for empowering young
8 people.
9 Her National Community Service
10 Initiative focuses on promoting arts education in
11 schools and expanding access to creative
12 opportunities for students of all backgrounds.
13 In an effort to bridge this gap, she is the
14 founder of three arts education scholarships.
15 Throughout her year of service as
16 Miss America, she has represented New York on
17 stages and classrooms and in communities across
18 the country, using her platform to advocate for
19 educational access, heart health awareness and
20 civic engagement.
21 Through her work and service she
22 continues to reflect the talent, resilience and
23 spirit of New York with distinction and pride.
24 And she is joined today by Miss Teen
25 New York, who is a proud Staten Islander. I'm

1 going to ask Senator Scarcella-Spanton to
2 introduce her.
3 And if you could welcome them both

10 And I am so excited to welcome, for
11 the second time, Miss New York Teen, Nadia Anwar,
12 who was here just a few weeks ago in a different
13 seat up in the gallery. We had the privilege of
14 having Nadia come to shadow us for the day.
15 A little about Ms. Nadia Anwar. She
16 is New York's Teen 2025. A student at
17 Sacred Heart University, Nadia is double-majoring
18 in chemistry and music and is the founder of
19 Ready Set Shine, Inc.
20 Through her nonprofit she has
21 inspired more than 2,000 students and raised
22 nearly $10,000 to support arts programs
23 throughout New York State, helping ensure that
24 young people have access to the transformative
25 power of the arts.

1 And she even got to come with us
2 last time she was here to our Committee on
3 Cultural Affairs -- which I hope you enjoyed --
4 and she got to meet the whole committee. So
5 we'll make sure that we take a look into the work
6 that you're doing more.

9 Senate floor.

14 I rise today with immense pride to
15 welcome an extraordinary group of athletes to our
16 chamber, the Hudson High School Varsity Boys
17 Basketball Team.
18 This past season the Hudson Blue
19 Hawks did something unprecedented. They rewrote
20 the school record books and lit a fire of
21 excitement across the entire City of Hudson.
22 They tore through their schedule to finish with a
23 spectacular 23-3 overall record, which included
24 being undefeated in the Patroon League to capture
25 the league title.

1 When the stakes were raised in the
2 Section 2 championship, these athletes showed us
3 what they were made of. They battled back from a
4 12-point deficit, under intense pressure, to pull
5 off a thrilling victory against Lansingburgh.
6 But that didn't stop at sectionals.
7 They kept their composure and pushed forward to
8 earn a spot in the state title game for the very
9 first time in program history.
10 Led by Head Coach Shawn Briscoe --
11 ACTING PRESIDENT MAYER: One

18 this team embodied unity, showing our community
19 that real success is built on hard work,
20 unselfish teamwork, and mutual respect.
21 While they didn't take home the
22 championship, they won with humility and treated
23 their opponents with the kind of sportsmanship we
24 should expect from all athletes.
25 The relentless dedication these

1 young men poured into their sport inspired
2 everyone across the City of Hudson. The trophy
3 case tells only a fraction of the story. It is
4 the unbreakable solidarity, discipline and
5 perseverance that will guide them to be better
6 teammates and friends as well as leaders in
7 whatever their futures hold.
8 This great team includes
9 Keith Robinson -- feel free to stand -- Keith
10 Robinson, Gannon Logue, Eli Conte, Dante Troy,
11 Jadiel Diaz, Ryan Conte, Elijah Walker, Kameryn
12 Clarke, Deangelo Beebe, Taydence Morrison,
13 Amarion Perry, Markel Johnson, Deandre Campbell,
14 and Capri Whitmore-McGriff.
15 Our coaches include Head Coach

19 Cooper Briscoe.
20 And we have to give a great
21 shout-out to all of the parents for their support
22 and their work through the season.

24 This bill addresses a serious
25 challenge for particularly veterans and others

1 who participate in our treatment courts. Right
2 now the practice is, at the beginning of their
3 entry into the court, they frequently plead
4 guilty to a charge and have a mandatory license
5 revocation in order to be in the treatment court.
6 Then they successfully complete the
7 treatment court program and they withdraw their
8 prior plea and they plead to a lesser offense.
9 On the plea to the lesser offense,
10 DMV again suspends their license for a period of
11 months. And so even though they've successfully
12 completed the treatment and gone through the
13 program, they then cannot drive even though they
14 want to go back to work and be present in their
15 communities.
16 This was an issue brought to me by
17 our Veterans Advisory Board. I appreciate the
18 support of the Office of Court Administration,
19 the Unified Court System, in recognizing that we
20 want to encourage people to engage in treatment
21 courts, get the treatment they need, without
22 losing their license twice for something that
23 they successfully completed.
24 Thank you for supporting this bill,
25 and thank you for this change in the current

21 I rise today in support of this
22 bill, this legislation that I was very proud to
23 take over from our former colleague Senator
24 Hoylman-Sigal, which strengthens the
25 accountability for repeat sexual offenders in

1 New York State.
2 Under current law, prosecutors are
3 limited to looking back just 10 years when
4 determining whether someone can be charged with
5 persistent sexual abuse. That means that prior
6 convictions outside that arbitrary window may not
7 be considered, even when there is a very clear
8 pattern of predatory behavior.
9 This bill removes that limitation.
10 Sexual abuse leaves lasting trauma
11 for survivors and for entire communities. When
12 someone repeatedly commits these offenses over
13 the course of a lifetime, we should not ignore
14 that history just because time has passed. A
15 pattern of abuse is still a pattern of abuse.
16 This legislation gives prosecutors
17 the ability to review a person's full criminal
18 history of sexual offenses when determining
19 whether enhanced charges are appropriate. It
20 ensures that repeat offenders are treated as
21 repeat offenders, regardless of when those prior
22 crimes were committed.
23 I believe that this bill is a
24 commonsense update to our laws that prioritizes
25 safety, survivor protection, and accountability.

25 This bill will decriminalize someone

1 knowingly spreading a sexually transmitted
2 disease. Let me tell you a story about what
3 happened in Chautauqua County, which is where I
4 live, back in the nineties.
5 Nushawn Williams, who was -- knew he
6 became infected with HIV, knowingly went out and
7 had sex with multiple partners, as many as 300
8 women in Chautauqua County and New York City.
9 His sexual conduct was intentional,
10 to infect more and more women. That's what he
11 did. He was finally convicted, but he created a
12 public health crisis -- one man created a public
13 health crisis in Chautauqua County. He went to
14 prison for his actions.
15 But this bill would no longer find
16 him guilty. This bill would let someone like
17 Nushawn Williams continue to walk the streets of
18 New York State. That's what this bill does.
19 This is a pro-sexual-predator bill,
20 an anti-woman bill, and I cannot believe that
21 something like this actually exists. Literally
22 one calendar earlier we're talking about multiple
23 repeat offenders. This guy intentionally
24 infected hundreds of women.
25 That's what this bill does. It

8 You know, we've heard many times
9 appeals to false hypotheticals in arguments made
10 in this chamber. But I've got to say the idea
11 that any person would intentionally, deliberately
12 seek to hurt another person solely by attempting
13 to spread an STI strains credulity.
14 It is absurd. But worse, it is
15 cruelty toward individuals living with an STI to
16 suggest this. It is not actually possible, any
17 more than it would be for me, if I were to
18 contract COVID-19, to deliberately direct that
19 virus to attack another person. It is not
20 possible for someone to actually direct a virus
21 from their body to infect another person, first
22 of all.
23 But additionally, we know that this
24 cruel law harms women, particularly survivors of
25 intimate partner abuse. Abusers frequently

1 weaponize HIV criminal laws, like this existing
2 law that we are repealing, by threatening false
3 exposure claims to control or punish their
4 partners. This is well-documented.
5 Criminalization traps survivors in
6 cycles of abuse and deters them from seeking care
7 or support. Ending HIV criminalization is
8 essential to these individuals' dignity,
9 autonomy, and safety.
10 Furthermore, this is essential for
11 public health, more broadly, and ending the
12 anti-LGBTQ stigma against individuals living with
13 HIV or other STIs. And I'm proud to vote aye.

20 So in 1996 my partner and I
21 personally arrested a Mr. Jose Arocho, who just
22 got let out of jail after doing 17 years for
23 manslaughter. We arrested him for rape 1. On
24 the way back to the stationhouse, in the police
25 car, he had mentioned that not only did he just

1 get released from jail and that he was
2 HIV-positive. In fact, he said "I have AIDS."
3 Subsequently, he was convicted of
4 rape 1, and the judge did make him get an AIDS
5 test, a test for HIV. He is in fact positive for
6 HIV and AIDS.
7 So currently Mr. Arocho -- I just
8 checked him not long ago -- he is serving 52
9 years to life in upstate New York.
10 So yes, the notion of somebody that
11 wants to intentionally give someone this -- these
12 sexually transmitted diseases are real.
13 And I'll be voting down on this
14 bill.

6 we were passing this bill.
7 But I can't help but chuckle that
8 it's a result of passing other legislation in
9 this body, moving our local elections from odd
10 years to even years that may be resulting in the
11 down-ballot drop-off. So I'm glad that the
12 sponsor realizes that this is an issue.

15 So I had the opportunity to vote
16 overseas in 2024, and I think we have a lot of
17 progress to make in the way that we handle
18 overseas balloting. I was actually concerned
19 that my absentee ballot wouldn't show up on the
20 time it was supposed to come. There's a way that
21 you can track the paper.
22 I was so fortunate, when I was
23 deployed, to actually have a computer and a
24 printer not too far off. But if you know
25 anything about a deployment environment in our

1 modern military, printers are pretty secure and
2 computers are pretty few across the whole
3 formation.
4 So the expectation that every
5 soldier is going to be getting onto an online
6 portal and then printing ballots out or dealing
7 with the Board of Elections through email isn't
8 really the right route to go.
9 I share these concerns. I think we
10 have a lot of progress to make when it comes to
11 overseas military ballots.
12 I'll be a no on this bill today
13 because I think it's the wrong direction. We
14 really need to focus on getting the paper right
15 and following the timelines through the federal
16 system that exists now.
17 So I'll be a no.

24 I'm glad my colleague voted in the
25 2024 election. There were only 11 percent of

1 eligible overseas voters who participated in that
2 2024 election, and that's relative to,
3 domestically, a 64 percent national voter
4 turnout.
5 In 2022, a midterm, it was even
6 worse: A mere 3.4 percent of eligible overseas
7 voters participated in the 2022 election.
8 And yes, these are servicemen and
9 -women. They're also individuals who are
10 overseas for work. They're students,
11 study-abroad participants. They're expats.
12 There are many, many types of individuals who --
13 millions of individuals who are eligible but do
14 not participate in our elections.
15 And it's our own federal
16 government -- that administers what's called the
17 FPCA, the Federal Post Card Application -- that
18 highlights barriers like the ones we are looking
19 to remove in this bill as one of the primary
20 reasons why those participation rates are so low.
21 There is nothing -- just to respond
22 to one point, there is nothing in this bill that
23 requires electronic delivery of requests. People
24 can still mail if they so choose. But we are one
25 of the few states in the country, very few

1 states, that prohibits individuals overseas from
2 sending an email back to the Board of Elections
3 in New York to complete their FPCA process.
4 And so whether it's that, whether
5 it's requiring colleges to advise study-abroad
6 students in advance of this particular process to
7 vote from overseas, there are many measures in
8 this bill that will facilitate higher
9 participation rates.
10 And I vote yes for those reasons.

15 SENATOR WEBB: Thank you,
16 Madam President.
17 I want to of course thank our
18 colleague Senator Brouk for introducing this
19 important resolution, and of course our
20 Majority Leader for continuing to lift up these
21 important issues related to maternal mental
22 health.
23 So maternal mental health issues,
24 known as MMH, are the leading complication of
25 childbirth. Over the last decade, the mental

1 health of U.S. mothers has worsened. Increasing
2 amounts of women show signs of anxiety,
3 depression and OCD during or after their
4 pregnancy.
5 Preexisting mental health conditions
6 like bipolar spectrum disorder or premenstrual
7 conditions like PMS or PMDD can often be
8 exacerbated during pregnancy.
9 Every year more than 800,000
10 families -- that's one in every five families in
11 our country -- are impacted by MMH disorders.
12 And we know this statistic is even more
13 disparaging for Black and brown mothers. Black
14 mothers are 40 percent more likely to experience
15 MMH, at nearly twice the rate of all women
16 combined.
17 These disparities are due to
18 systemic issues like racism in our healthcare
19 systems, underrepresentation of people of color
20 in the medical field, and higher levels of
21 chronic long-term stress for Black and brown
22 women.
23 Rural families have their own
24 systemic barriers, such as the lack of access to
25 healthcare in low-income and rural areas and the

1 compounded effects of poverty.
2 We must do better for our mothers
3 and our families. They deserve peace and good
4 health.
5 The stigma around MMH means that
6 many women do not seek out the help they need and
7 deserve. Mothers are often expected to show up,
8 to be strong, to prioritize their children and
9 their families before thinking about themselves.
10 But we want every mother that is
11 listening today, and most certainly beyond today,
12 to know that you cannot take care of others
13 unless you take care of yourself first.
14 And there is nothing, nothing wrong
15 with speaking to someone about your mental health
16 challenges and struggles. The strongest thing
17 that any of us can do is admit that we are
18 struggling.
19 I want to again thank Senator Brouk
20 for uplifting this issue, and of course our
21 Majority Leader for her support.
22 By bringing light to this issue, it
23 is my sincere hope that more women are encouraged
24 to seek the mental health support they deserve,
25 and that we in this chamber continue to make

1 strides in making sure more investments are made
2 through our state budget process to support
3 mental health services.
4 I proudly vote aye, and I encourage
5 my colleagues to do the same.

12 Thank you, Madam President.
13 I want to thank the sponsor and
14 thank Senator Webb for bringing this resolution
15 to the floor. My understanding is that Senator
16 Brouk is actually out on maternity leave, so I
17 hope she's doing well and watching this.
18 As a mom of three daughters and a
19 mother of four kids, it is very important that we
20 support mothers as they transition after birth to
21 being a mom and taking care of a little one.
22 It is extremely important that the
23 men in our lives listen and know that when they
24 see a woman who is a new mom, they may not be
25 able to ask for help. They may think, I'm just a

1 little overwhelmed, there's a lot of change in my
2 life. And it's hopeful that the men in our lives
3 support us and know that maybe you're struggling
4 a little too much. Maybe you need a little extra
5 help.
6 And that's what today is about,
7 bringing awareness to that and making sure that
8 we all realize that a new mom goes through an
9 awful lot -- lack of sleep, hormonal changes.
10 And there's so much that we don't
11 understand about it, and that's why it's
12 important that we bring awareness, do more
13 research and find out what we can do to support
14 those new moms in our communities.

21 Madam President.
22 Senator Canzoneri-Fitzpatrick, you
23 took the words out of my mouth. I think this is
24 a really important call to action.
25 I thank Senator Brouk and hope that

1 she is doing well. I hope that she's, frankly,
2 not watching this and she's getting some rest and
3 some bonding time with her incredible children
4 and her great husband Brian. A shout out to
5 Brian, a very supportive gentleman, by the way.
6 And I think that's what we need more
7 of. We need more men to make sure that we
8 support the women in our lives. Giving birth is
9 no walk in the park. There's a lot of debate
10 about cesarean sections versus different types of
11 birth.
12 And my wife might yell at me for
13 this, but I want to say it anyway. She had three
14 C-sections. And a C-section is not a minor
15 surgery by any stretch of the imagination.
16 And so not only do you have to carry
17 a child, the greatest thing in the world, but
18 you're carrying a child -- she did it three
19 times. And to do so in all types of
20 temperatures, in the rain, in the snow, the sun.
21 You don't get a day off. You don't get to be
22 unpregnant when it's hot. You don't get to be
23 unpregnant when it's cold or when it's snowing.
24 You have to worry about slipping and falling on
25 snow.

1 There's so many different things
2 that you don't really think about, that I know
3 women think about when they're pregnant. And
4 they think about it not just when they're
5 pregnant, but after they give birth. And then
6 there are the added societal pressures of
7 returning to the workforce. Right? And making
8 sure that, Hey, I am a skilled worker, how do I
9 not lose my spot, lose my space in the shuffle.
10 So as people, as a society, whether
11 you have children or not, whether you're planning
12 to have children or not, this is something that
13 we should all be incredibly aware of.
14 I'm incredibly appreciative of my
15 wife all the time. But in reflection, when
16 you've given three kids and you're still able to
17 be an incredible role model and somebody that for
18 our daughters and son to look up to, you know, I
19 salute her even more.
20 Senator Webb, thank you for standing
21 in stead and delivering the word, as they say, on
22 behalf of Senator Brouk and our Majority Leader.
23 All the women of our conference who have given
24 birth, haven't given birth, thinking about giving
25 birth -- we salute you, we appreciate you, and we

13 This is such an important issue for women.
14 I have the privilege of representing
15 an amazing constituent, Alexsis Gilles, who had a
16 traumatic birth herself. She's a resident on
17 Staten Island, and she started an organization
18 called The Post Care, which is simply just for
19 moms to get together and have conversations on a
20 weekly basis.
21 And it really turned into such a
22 bigger thing. She just got her nonprofit status,
23 and she's trying to raise the importance of
24 allowing women to have an outlet to talk about
25 these experiences.

1 I think there sometimes is so much
2 guilt associated with any sort of issue you're
3 having, whether you're depressed or you're
4 feeling more anxious, whatever comes along with
5 it, and actually talking about those things.
6 Because sometimes moms are expected to be moms
7 and shoulder the brunt and the burden of
8 everything.
9 But there are people who really go
10 through a lot. And for each cohort that Alexsis
11 has, I have the privilege of actually going in
12 and speaking to these women. And I see them, and
13 I see so much of myself. Early on -- my kids are
14 bigger now, they're 10 and 12, but I see so much
15 of myself early on.
16 When I was pregnant with my
17 daughter, I was young, I was 24 years old, and I
18 was in labor for 36 hours. I also had false
19 labor the first time, too, which I did not know
20 was a thing that could happen.
21 But I didn't have that type of
22 support or that type of group around me. So when
23 I speak to these young women who just have
24 newborns and they have each other, it's so
25 critically important to have that outlet for each

1 other.
2 So her organization is called
3 The Post Care. It's Alexsis Gilles. I'm very
4 proud to have her in my district. And I thank
5 her for the work that she's doing around maternal
6 mental health.
7 And to Senator Brouk, if you're
8 watching this: Hello. We miss you. And I hope
9 you're enjoying every minute with your new baby.

15 It is amazing to have the
16 opportunity to recognize Maternal Mental Health
17 Month in the State of New York and recognize the
18 leadership of Senator Webb and of Senator Brouk
19 in bringing this to the floor and highlighting
20 this important issue for all of us.
21 It is an opportunity for us to
22 recommit our efforts to reduce maternal mortality
23 as well, and improve mental health care in our
24 state in addition to eliminating stigma about
25 mental health conditions.

1 We also raise awareness about mental
2 health disorders that particularly impact
3 pregnant and postpartum New Yorkers who may be
4 struggling in silence. Individuals who are
5 battling postpartum depression or other
6 mental health conditions should not face stigma
7 instead of care and treatment.
8 And so I just want to show my
9 gratitude to Senator Webb, Senator Brouk, to our
10 Majority Leader, for always emphasizing this
11 issue and raising awareness about it so that we
12 can continue to responsibly address a maternal
13 health crisis in our state, and not least with
14 mental health care.
