Senator O'Brien Holds Drunk Drivers Accountable

ROCHESTER, N.Y. – Today, Senator Ted O’Brien’s bill requiring that individuals convicted of DWI pay for their medical transportation before their driver license could be reissued passed the New York State Senate.

“Individuals who break the law and drive while intoxicated put every other motorist in danger. When our emergency services personnel put themselves on the line to aid these impaired drivers, at a minimum they deserve a guarantee that they will be compensated,” Senator O’Brien said. “Insisting that these drivers pay the medical transportation expenses incurred as a result of their reckless actions is another way to deter this behavior and protect law-abiding drivers.”

New York State Senate Passes Klein Bill to Stop Homeowner Insurance Scams

ALBANY, NEW YORK – On Tuesday, the New York Senate passed legislation to protect homeowners from insurance scams by establishing a strict firewall between public adjusters and contractors. The legislation (S.3771A) was written by Senator Klein in response to a series of complaints filed by homeowners against City Island-based Adjustrite, a contracting firm that had established a coordinated scheme whereby a public adjuster directed homeowners to a local contractor with whom he worked and had a nefarious financial arrangement. The bill, known as the “Gayla Marsh Bill,” was named after Gayla Marsh, who fell victim to Adjustrite. Her son, Chancy Marsh, notified Senator Klein’s office and, together, identified other victims of Adjustrite.

Five of New York’s largest banks and mortgage servicers will have representatives available to offer one-on-one help to homeowners seeking the release of Superstorm Sandy insurance settlement funds at the Department of Financial Services’ Disaster Assistance Centers from Monday, March 4 through Saturday, March 9.The program is designed to help homeowners complete steps needed to have their banks endorse their insurance settlement checks, which are often written jointly to homeowners and their banks or servicers. Bank representatives will also be able to help people who are struggling to make their mortgage payments.

Department of Financial Services to Speek Resolution of Insurance Claims in Areas Affected by SANDY

The NYS Department of Financial Services (DFS) is setting new rules to speed the processing of insurance claims in areas affected by Storm Sandy. The new regulation reduces the amount of time an insurer can delay its decision on a claim, and requires insurers to report to the Department on how many claims it is delaying and the reasons for the delays.
